Fire Rescue Victoria (Firefighters Registration Board) Amendment Regulations 2024

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Fire Rescue Victoria (Firefighters Registration Board) Regulations 2022 to enable—

(a)the Firefighters Registration Board to extend the time within which it must make a decision on an application for registration or renewal of registration; and

(b)the mandatory revocation of the registration of a person who has resigned or retired from Fire Rescue Victoria.

2Authorising provision

These Regulations are made under section 159 of the Fire Rescue Victoria Act 1958.

3Commencement

These Regulations come into operation on 1 December 2024.

4Principal Regulations

In these Regulations, the Fire Rescue Victoria (Firefighters Registration Board) Regulations 2022[1] are called the Principal Regulations.

5Decision on application for registration

After regulation 43(2) of the Principal Regulations insert—

"(2A)The Board may extend the period within which it must make a decision under subregulation (2) to 45 days after receiving an application if—

(a)additional information is required by the Board to make the decision; or

(b)the Board needs to undertake any of the actions specified in subregulation (3).".

6Renewal of registration

After regulation 47(2) of the Principal Regulations insert—

"(2A)The Board may extend the period within which it must make a decision under subregulation (2) to 45 days after receiving an application if—

(a)additional information is required by the Board to make the decision; or

(b)the Board needs to undertake any of the actions specified in subregulation (3).".

7Mandatory revocation of registration

In regulation 48(1) of the Principal Regulations, after "dismissed" insert ", has resigned or has retired".

8Regulation 51 revoked

Regulation 51 of the Principal Regulations is revoked.

9Fire Rescue Commissioner to notify Board of dismissals of registered persons

In regulation 54 of the Principal Regulations, after "dismissed" insert ", resigns or retires".
