FIRE BRIGADES (AMENDMENT) ACT.

Act No. 23, 1941.

An Act to extend the application of the Fire Brigades Act, 1909-1927, to certain ports and navigable waters; to amend the said Act in certain respects; and for purposes connected therewith. [Assented to, 9th April, 1941.]

(1) This Act may be cited as the " F i r e Brigades (Amendment) Act, 1941."

(2) The Fire Brigades Act, 1909-1927, as amended by subsequent Acts and by this Act, may be cited as the Fire Brigades Act, 1909-1941.

(3) This Act shall commence upon a day to be
appointed by the Governor and notified by proclamation

2 . The F i r e Br igades Act, 1909-1927, as amended by

subsequent Acts , is amended—

(a)	by inser t ing af ter p a r a g r a p h (c) of subsection one of section four the following new p a r a ­
g r a p h :—

(d) Port Jackson, the Port of Newcastle, P o r t Kembla , and any other navigable wa te r s to which the Board , wi th the con­ sent of the Minister , may, by notification in the Gazette, apply this Act.

(b)	by inserting in subsection one of section nine­ teen, af ter the words " o r any p a r t the reof" the words " a n d in or upon any por t or navigable
wa te r s to which this Act a p p l i e s " ;

(c) by inser t ing af ter p a r a g r a p h (g) of section

twenty the following	new p a r a g r a p h :—
(h)	establish, maintain and conduct fire fight­ ing services in and in respect of any po r t or navigable wa te r s to which this Act applies .

(d) by inserting after section thirty-seven the fol­ lowing new sect ion:—

37A. (1) All moneys requi red by the Boa r d to meet the costs and expenses ar i s ing out of the appl icat ion of this Act to po r t s and navigable wa te r s in pursuance of p a r a g r a p h (d) of sub­ section one of section four shall be pa id to the B o a r d by the Colonial T r e a s u r e r out of moneys

provided by Pa r l i amen t .

(2) Moneys pa id to the B o a r d unde r th is

section shall be pa id into the fund and a separ­

a te account thereof shall be kept showing the amounts so pa id to the Boa r d a n d the amounts expended for and in respect of por t s and navig­ able wa te r s to which th is Act applies .

(3) Moneys pa id to the B o a r d under this

section shall be appl ied by the B o a r d for the purposes for which it has been provided by Pa r l i amen t .
