104 Qllernsfau^ ANNO QUINTO DECIMO ELIZABETH AE SECUNDAE REGINAE No. 13 of 1966 An A ct to Amend " The Fire Brigades Acts, 1964 to 1965,9 in certain particulars [ASSENTED TO 12TH DECEMBER, 1966J BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as " The Fire Brigades Acts Amendment Act of 1966." (2) Principal Act. " The Fire Brigades Acts, 1964 to 1965 " are, in this Act, called the Principal Act. (3) Collective title . The Principal Act and this Act may be collectively cited as " The Fire Brigades Acts, 1964 to 1966."
Fire Brigades Acts Amendment Act of 1966, No. 13 105 2. Commencement of Act. (1) Sections three and four of this Act shall come into operation on a date to be fixed by the Governor in Council by Proclamation published in the Gazette. (2) This Act, other than sections three and four, shall be deemed to have commenced on the first day of July one thousand nine hundred and sixty-six and shall have retrospective effect accordingly. 3. (1) Amendment to s. 19. Section nineteen of the Principal Act is am.:nded by, in subsection (2), omitting the word " five " and inserting in its stead the word " seven " and omitting provision (a) and inserting in its stead the following provision:- (a) The Minister shall appoint- - (i) one member who shall be Chairman of the Council; (ii) one member, appointed from a panel of names of three persons submitted to the Minister by the Metropolitan Fire Brigade Board, as a representative of that Board; (iii) one member, appointed from a panel of names of three persons submitted to the Minister by the Queensland Fire Brigade Boards Association, as a representative of the Boards other than the Metropolitan Fire Brigade Board; ". (2) Saving constitution of existing Council . The State Fire Services Council as duly constituted immediately before the date of coming into operation of this section shall be deemed to continue to be duly constituted with all the powers, duties and functions of such Council conferred or imposed by or under the Principal Act until- (a) the appointment of the two additional members prescribed by the Principal Act as amended by subsection (1) of this section; or (b) the appointment next made after such date of its members following a triennial election held pursuant to " The Local Government Acts, 1936 to 1965 ", whichever appointment is the earlier to be made. 4. Amendment to s. 21 . Section twenty-one of the Principal Act is amended by adding the following subsection:- " (3) Procedure on failure to submit panels. If within one month after being called upon in writing by the Minister to submit to him a panel of names of three persons for the purpose of his appointment therefrom of a member of the Council the Metropolitan Fire Brigade Board or the Queensland Fire Brigade Boards Association fails to submit a panel of names of three persons qualified for such appointment the Minister shall appoint some fit and proper person to the Council as a representative of such Board or, as the case may he, the Boards other than such Board and such an appointment shall he deemed to have been duly made." 5. Amendments to s. 32. Section thirty-two of the Principal Act is amended by- (a) omitting from provision (a) the words " one-seventh " and inserting in their stead the words " one-eighth "; (b) omitting from provision (b) the words " one-seventh " and inserting in their stead the words " one-eighth "; (c) omitting from provision (c) the words " five-sevenths parts " and inserting in their stead the words " the remainder ".

Section thirty-four of the Principal Act is amended by- (a) in provision (a)- (i) omitting the words " one-seventh " where they twice occur and inserting in their stead where so omitted the words " one-eighth "; (ii) omitting the words " two-sevenths " and inserting in their stead the words " one-quarter "; (b) omitting from provision (b) the words " one-seventh " and inserting in their stead the words " one-eighth "; (c) omitting from provision (c) the words " five-sevenths parts and inserting in their stead the words " the remainder ". 7. Amendment to Sch . I Part IV. Part IV of Schedule I to the Principal Act is amended by omitting from sub-rule (2) of rule 3 of the rules set forth therein the word " three " and inserting in its stead the word " four ".
