FIRE BRIGADES ACT 1989—REGULATION

(Increasing maximum charges for dealing with hazardous material incidents)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Fire Brigades Act 1989, has been pleased to make

the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 10 July 1995.

Amendments

2. The Fire Brigades (Charges) Regulation 1989 is amended:

(a) by omitting from clause 4 (Charges for attending fires outside fire districts) the matter “section 40” and by inserting instead the matter “section 40 (2)”;
(b) by omitting from clause 4 the words “that section” and by inserting instead the words “that subsection”;
(c) by inserting after clause 4 the following clause and Table:

Charges for attending hazardous material incidents

4A. For the purposes of section 40 (4A) of the Act, the maximum
charges payable for services rendered by a fire brigade as
described in that subsection are the charges set out in the Table to
this clause.

Commissioner to be

material plus 10 per

One half of the charges specified is payable in respect of each half hour, or remaining part of a half hour, for which the officer or firefighter is in attendance, or the equipment is available for use, at the incident.

EXPLANATORY NOTE

The object of this Regulation is to increase the maximum charges which may be

payable for the services of New South Wales Fire Brigades in dealing with hazardous

material incidents.

This Regulation is made under sections 40 (4A) and 85 (the general regulation-

making power) of the Fire Brigades Act 1989.
