An Act to provide for the Appointment of a Superintendent of Fire

Brigades, and for other purposes therein mentioned.

[Assented to, 19th December, 1867.1

HEREAS it is expedient to repeal the Act No. 6 of 1862, Pream'1*6

mentioned; and by this Act to re-authorize the appointment of n Superintendent of Fire Brigades and to confer upon him the powers hereinafter mentioned, and otherwise to provide for the protection of property against loss or damage by fire-Be it therefore Enacted

by the Governor-in-Chief of the Province of South Australia, with

the advice and consent of the Legislative Council and House of Assembly of the said Province, in this present Parliament assembled,

as follows:

1. The said Act No. 6 of 1862, intituled " An Act to provide for :{fir1

the appointment of a Superintendent of Fire Brigades. and for other purposes therein mentioned," shall be and the same is hereby repealed, save so far as may be necessary to support any appoint- ment lawfully made, or any act, matter, or thing, lawfully done thereunder before the pasing of this Act.

of such Companies, and from time to time remove such Superin- tendent of Fire Brigades and to appoint another person nominated aa aforesaid in his place: Provided that no such appointment shall be made unless it shall be shown to the satisfaction of the Governor that sufficient provision has been made by the said Companies, or some of them, for efficient fire brigades, and for the payment by them of the salary of such Superintendent, as long as he shall remain in office.

3. The hspector of Police, or some other officer or non-commiu- sioned officer in command of the police on duty, shall at any fires which may occur within any city, town, or place, where police shall be stationed, muster a sufficient number of men and proceed at once to such fire, for the maintenance of order and for the preservation of 1ife.and property at or near to such fire.

command of all fire brigades and engines, and all the appurtenances thereof shall also be under his control and management; and the said fire brigades or some of them shall turn out on the firstlalarm of fire, and endeavor by all means in their power to subdue any fire that may occur within the limits of their respective districts; and the Superintendent shall be authorized to charge for the attendance and services of the fire brigades and plant as hereinafter pro- vided.

5. In case any fire shall occur in any house, row, or block of brigades shall attend at such fire, and be employed in extinguishing the same, the Superintendent of Fire Brigades shall be entitled to recover the expedses actually incurred by &e brigade or brigades at such fire, not exceeding those mentioned in the schedule of charges hereunto annexed; and such expenses shall be paid by the insurer or

houses, or buildings or premises shall be insured, and shall be paid

by the owners and occupiers thereof if the same shall be uninsured;

in proportion to the value of the respective properties so protected or

sought to be protected, and such value shall be ascertained by the assessment roll of the city, town, or district, in which the fire shall occur: and such expenses may be recovered by and in the name of the Superintendent aforesaid in the nearest Local Court; provided that

no greater sum than Five Guineas shall be recovered in any case

when a chimney only shall be ou fire.
