Part 1—Preliminary
1—Short title
These regulations may be cited as the Fire and Emergency Services Variation Regulations 2007.
2—Commencement
These regulations come into operation on the day on which they are made.
3—Variation provisions
In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Variation of regulation 32—Interpretation
Regulation 32, definition of spark arrester—delete the definition
Regulation 32—after its present contents (now to be designated as subregulation (1)) insert:
(2)For the purposes of this Division, an engine or vehicle exhaust system complies with this Division if—
(a)all engine exhaust emitted by the engine or vehicle exits through the system; and
(b)the system, or a device or devices forming part of the system, is designed to prevent the escape of burning material from the system; and
(c)the system, or a device or devices forming part of the system, is designed to prevent heated parts of the system from coming into contact with flammable material; and
(d)the system is in good working order.
(3)For the purposes of subregulation (2)(a), engine exhaust emitted by a turbocharged engine, or a vehicle fitted with a turbocharged engine, by means of a device of a kind commonly known as a waste gate will be taken to exit through the exhaust system of the engine or vehicle.
5—Variation of regulation 37—Stationary engines
Regulation 37(3)(c)—delete paragraph (c) and substitute:
(c)the engine is fitted with an exhaust system that complies with this Division.
Regulation 37(4)—delete "any exhaust pipe that projects beyond that material is fitted with a spark arrester in good working order" and substitute:
the engine is fitted with an exhaust system that complies with this Division
6—Variation of regulation 38—Internal combustion engines
Regulation 38(2)(e)—delete paragraph (e) and substitute:
(e)the engine is fitted with an exhaust system that complies with this Division.
Regulation 38(3)(a)(ii)—delete subparagraph (ii) and substitute:
(ii)the engine is fitted with an exhaust system that complies with this Division; or
Regulation 38(3)(b)(ii)—delete subparagraph (ii) and substitute:
(ii)the engine is fitted with an exhaust system that complies with this Division.
7—Variation of regulation 39—Vehicles
Regulation 39(2)—delete "any exhaust pipe is fitted with a spark arrester in good working order" and substitute:
the vehicle is fitted with an exhaust system that complies with this Division
Note—
As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
