Fire and Emergency Services (Superannuation

Fund) Amendment Regulations 2014

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Fire and Emergency Services (Superannuation Fund) Amendment Regulations 2014.

2.            Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3.            Regulations amended

These regulations amend the Fire and Emergency Services (Superannuation Fund) Regulations 1986.
4.	Regulation 3 amended In regulation 3(1) insert in alphabetical order:

whichever is the later;

payment period, in relation to a member who is
entitled to be paid a supplementary disablement
benefit, means the period beginning on the first day of
the month following the relevant month and ending

on —

(a)	the day before the fifth anniversary of that day; or
(b)	the member's 55th birthday,

5.            Regulation 23B amended

(1) After regulation 23B(l)(a) insert:

(ba) the Board has determined that the member is

not to be regarded as being totally and

permanently disabled; and

(bb) between the day the member ceased to be in the

employment of the employer and the day the be regarded as being totally and permanently disabled the member did not engage in any employment; and

(2) In regulation 23B(3)(a) delete "and has at least 20 years

membership".

(3) In regulation 23B(3a):

(a) in paragraph (a) delete "for 60 months starting with the month following the relevant month;" and insert:

during the payment period: or

(b)	in paragraph (b) delete "the anniversary of that day in each of the 4 following years;" and insert:
each anniversary of that day during the payment period: or
(c)	in paragraph (c) delete "month;" and insert:

month; or

(4) In regulation 23B(7) delete "subregulation (3)(c)" and insert:

subregulation (3a)(c)

(5)	In regulation 2313(7a) delete"subregulation (3)(d)" and insert:
subregulation (3a)(d)

6.            Regulation 23BA amended

(1) In regulation 23BA(3):

(a) delete "60th instalment" and insert:

final instalment

(b) in paragraph (a) delete "5 years after the end of the relevant month; or" and insert:

on the last day of the payment period: or

(2) In regulation 23BA(5)(a):

(a) delete "fourth instalment" and insert:

second last instalment

(b) delete "5 years after the end of the relevant month; or" and insert:

on the last day of the payment period; or

7. Schedule 5 amended
In Schedule 5:

(a) delete:

and insert:

(b) in the description of the variable "I" delete "regulation 23B(8); and" and insert:

regulation 23B(8);

(c) after the description of the variable "v" insert:

8.            Schedule 6 amended

In Schedule 6: 
(a) delete:

9.            Schedule 6C amended

In Schedule 6C in the description of the variable "n" delete "60" and insert:

the total number of monthly instalment benefit payments to be paid
during the payment period

10.          Schedule 6D amended

In Schedule 6D in the description of the variable "n" delete "5" and insert:

the total number of annual instalment benefit payments to be paid
during the payment period

11.          Schedule 7 amended

In Schedule 7 in the description of the variable "n" delete "60" and insert:

the total number of monthly instalment benefit payments which the
beneficiary would have received but for death or election under
regulation 23BA(3)(b)

12.          Schedule 8 amended

In Schedule 8 in the description of the variable "n" delete "5" and insert:
