Fire and Emergency Services (Superannuation
Fund) Amendment Regulations 2004

Made by the Governor in Executive Council.
1. Citation
These regulations may be cited as the Fire and Emergency
Services (Superannuation Fund) Amendment Regulations 2004.2. Commencement
These regulations come into operation on 1 July 2004.
3. The regulations amended
The amendments in these regulations are to the Fire and
Emergency Services (Superannuation Fund) Regulations 1986*.[* Reprinted as at 7 September 2001.

Regulations 14A(4), 19(1)(a), 20, 21(1)(b)(i) and 32(2) are amended by deleting "Schedule 1" and inserting instead -
" Schedule 1A ".
5. Regulation 41 amended
Regulation 4 1(7) is amended by inserting after "Schedule 1"—
Schedule 1A ".
6. Schedule I amended
Schedule 1 is amended by deleting the heading and shoulder clause and inserting instead -
Schedule 1 Defined benefit:
death or total and permanent disablement

7. Schedule 1A inserted
After Schedule 1 the following Schedule is inserted -
Schedule 1A - Defined benefit:
partial and permanent disablement or
leaving service
[r. 14A and 19-21]
The amount calculated in accordance with this Schedule is B in the formula -
B= x[(0.215xM1)+(0.18xM2)] 365.25
where - S is the member's final average salary; Ml is the number of days in the member's membership period
before 1 July 2004;
M2 is the number of days in the member's membership period on
and after 1 July 2004.
8. Schedule 4 amended
Schedule 4 is amended as follows:
(a) by deleting the equation and inserting the following
equation instead -

(b) by deleting the definition of "M" and inserting the
following definitions instead

M1 is the number of days in the member's membership
period before 1 July 2004;
M2 is the number of days in the member's membership
period on and after 1 July 2004;
(c) in the definition of "n" by deleting "birthday." and
inserting instead
44
birthday, but not more than the number of days (if any) determined by the Superannuation Board on the advice of the actuary to be necessary to ensure that the employer will not incur an individual
superannuation guarantee shortfall (within the
meaning of the Superannuation Guarantee
(Administration) Act 1992 of the Commonwealth)in respect of the member.
