This application for special leave to appeal requires an extension of time. An extension of time would be futile, because the decision of the New South Wales Court of Appeal concerning the construction of s 474.17 of the Criminal Code (Cth) (Payne JA, Barrett AJA and R A Hulme J) was plainly correct. An appeal to this Court would enjoy no prospect of success. The application for special leave to appeal should be dismissed.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
