An Act to amend certain Acts of the Governor
and Legislative Council of New South Wales

with respect to the appropriation of Fines

and Penalties. [15th June, 1848.]
W H E R E A S cer ta in Acts were passed by the Governor of N e w South W a l e s w i th t h e advice and consent of t he Legis la t ive Counci l

thereof in t h e n i n t h year of H e r Majes ty ' s re ign respectively in t i tu led " An Act for regulating the sale and delivery of Coal in the City of " Sydney and its vicinity " and " An Act to provide for the general

" regulation of Customs in New South Wales" a n d it is expedient a n d
necessa iy to a l ter and a m e n d the same w i t h respect to t h e appro­
pr ia t ion of fines and penal t ies Be i t enacted by t h e Governor of N e w
South Wales wi th t h e advice and consent of t h e Legislat ive Counci l
thereof Tha t the clauses in t h e said reci ted Ac t s respectively respec t ing
t h e appropr ia t ion of fines a n d penal t ies shall lie and a re hereby
repealed.
2. A n d bo i t enacted T h a t from a n d after t h e pass ing of th i s

Ac t all fines forfeitures and penal t ies recovered unde r t h e Acts herein­ before reci ted shall be thencefor th payable in t h e following manne r t h a t is to say one moie ty to H e r Majesty H e r H e i r s a n d Successors for the publ ic uses of t h e Colony and in suppor t of t h e Government thereof and the o ther moiety to the use of t he informer who shall also be ent i t led to his or her costs and charges to be ascer tained and assessed by t h e Jus t ices before w h o m the case is heard .
