Fines, Penalties and Infringement Notices

Enforcement Amendment Regulations

(No. 2) 2015

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Fines, Penalties and Infringement Notices Enforcement Amendment Regulations (No. 2) 2015.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day fixed under the

Road Traffic (Administration) Act 2008 section 2(b).

3.             Regulations amended

These regulations amend the Fines, Penalties and Infringement
Notices Enforcement Regulations 1994.

4.             Regulation 3AA amended

(1) In regulation 3AA(2):

(a) in paragraph (b) delete “Road Traffic (Charges and Fees) Regulations 2006” and insert:

Road Traffic (Vehicles) Regulations 2014

(b) in paragraph (b)(i) delete “regulation 23” and insert:

Part 2 Division 8 Subdivision 1

(c) in paragraph (b)(ii) delete “regulation 25” and insert:

regulation 99

(d) in paragraph (b)(iii) delete “regulation 30” and insert:

regulation 112

(e)	in paragraph (c) after “offender” insert:
under the Road Traffic (Vehicles) Regulations 2014 regulation 44(4)
(f)	in paragraph (c) delete “issue of an unlicensed vehicle
permit for the vehicle under the Road Traffic (Licensing) Regulations 1975 regulation 11, where the permit is

issued” and insert:

grant of a permit under Road Traffic (Vehicles) Act 2012
section 13(1), if the permit is

(2)	In regulation 3AA(3) in the description of the variable “licence cost” paragraph (a) delete “Road Traffic (Charges and Fees)
Regulations 2006” and insert:
Road Traffic (Vehicles) Regulations 2014 Part 2 Division 7

5.             Schedule 1 amended

In Schedule 1 delete the item for the Road Traffic Act 1974 and
insert:
