AN ACT relating to the Appropriation of Fines and Penalties imposed for Offences punishable on Summary Conviction.

E it enacted by the King's Most Excellent Majesty, by and

with the advice and consent of the Legislative Council and

Legislative Assembly of Western Australia, in this present Parlia-

ment assembled, and by the authority of the same, as follows:—

Notwithstanding the provisions or any Act to the contrary,

diction, under any Act passed before or after the passing of this Act, for any offences against or breach of the provisions of such Act, or of any by-law or regulation made under such Act shall, ex- cept as hereinafter provided. be paid to the Colonial Treasurer for the public uses of the State.

Provided that this Act shall not affect the appropriation of

fines and penalties

(a.) Incurred and recovered under any law in force for the time being relating to the sale of fermented or spirituous liquor ; or

Incurred under the provisions of any Act or by-law

relating to local government ; or

Incurred under guy Act administered by a local

authority.

(d.) Fines and penalties recovered under sub-sections (b.) and

(•.) shall be paid to the local authority within whose

district the offences are proved to have been committed.

Interpretation.

3. For the purposes of this Act, Local Authority " means the

council of a municipality within the meaning of the Municipal Corporations Act, 1906, or the board of a road district within the meaning of the Roads Act, 1902, or a local board within the meaning of the Health Act, 1898, or under any Act amending the same.
