Fines Amendment (Definition of

Authorised Justice) Regulation 1998

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fines Act 1996.

Explanatory note

The object of this Regulation is to preserve the definition of “authorised justice” as it existed in a provision of the Justices Act 1902 immediately before the provision was repealed so that it continues to apply for the purposes of another provision in the Act that incorporates the definition by reference.

This Regulation is made under the Fines Act 1996, including clause 1 of Schedule 3 (provisions of a savings and transitional nature), and section 128 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Fines Amendment (Definition of

Authorised Justice) Regulation 1998.

2 Commencement

This Regulation is taken to have commenced on 27 January

1998.

3 Amendment of Fines Regulation 1997

The Fines Regulation 1997 is amended as set out in Schedule l .

The explanatory note does not form part of this Regulation.

(Clause 3)

Clause 27

Insert after clause 26: 

27 Saving of definition of “authorised justice” for the

purposes of section 80AA of the Justices Act 1902

(1) The repeal of section 86A of the Justices Act 1902 by the Act does not affect the meaning of authorised justice in section 80AA of the Justices Act 1902 immediately before that repeal.
( 2 ) I f section 80AA of the Justices Act 1902 is amended to include a definition of authorised justice other than by reference to section 86A of that Act, this clause ceases to have effect.
