Financial Management and Accountability (Amendment of Special Account) Determination 2001/04

I, JOHN JOSEPH FAHEY, Minister for Finance and Administration, make this Determination under subsection 20 (2) of the Financial Management and Accountability Act 1997.

1              Name of Determination

This Determination is the Financial Management and Accountability (Amendment of Special Account) Determination 2001/04.

2              Commencement

This Determination commences in accordance with section 22 of the Financial Management and Accountability Act 1997.

3              Abolition of Special Account

The ‘Other Trust Moneys Account’, established by the Initial Determination to Establish Components of the Reserved Money Fund made on 31 December 1997 and operated by Centrelink is abolished.

4              Establishment of Special Account

(1)   An account is established named ‘Commonwealth Service Delivery Agency Other Trust Moneys Account (operated by Centrelink)’ with the expenditure purpose ‘For the transfer of unidentified or other public monies held on trust by the Commonwealth Service Delivery Agency to the appropriate accounts once the moneys have been identified; and for the transfer and return of moneys to the Official Public Account of moneys that remain unidentified’.

(2)   Amounts of the following kinds may be transferred to the account:

(a)    unidentified or public moneys temporarily held on trust by the Commonwealth Service Delivery Agency; and

(b)    all money paid to the Commonwealth by any person for the expenditure purpose of the account.

5              Transfer of Funds

Any funds in the account abolished by section 3 immediately before the commencement of this Determination are transferred to the account established by section 4.
