Financial Management and Accountability Act 1997
I, TIM YOUNGBERRY, First Assistant Secretary, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, make this Determination under subsection 32(2) of the Financial Management and Accountability Act 1997 (the FMA Act).
This Determination is made due to a decision of the Australian Government to return the Jobs Fund - Infrastructure Employment Projects Program from the Department of Regional Australia, Regional Development and Local Government to the former Department of Infrastructure, Transport, Regional Development and Local Government.

1 Name of Determination
This Determination is the Financial Management and Accountability Act 1997 Determination 2010/39 – Section 32 (Transfer of Functions from DORA to the former DITRDLG).
Note 1: This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is a delegate of the Minister for Finance and Deregulation in accordance with section 62 of the FMA Act. The Secretary has delegated his power in accordance with section 53 of the FMA Act.
Note 2: Acronyms used in this Determination are as follows:
(a)“DORA” – refers to the Department of Regional Australia, Regional Development and Local Government; and
(b)“the former DITRDLG” – refers to the former Department of Infrastructure, Transport, Regional Development and Local Government.
Note 3: On 14 September 2010, ministerial portfolios were restructured and departments were renamed. The former Department of Infrastructure, Transport, Regional Development and Local Government was renamed the Department of Infrastructure and Transport and some of its functions transferred to the Department of Regional Australia, Regional Development and Local Government, a department within the Prime Minister and Cabinet portfolio created on 14 September 2010.
Note 4: On 1 October 2010 a Financial Management and Accountability Act 1997 Determination 2010/17 – Section 32 (Transfer of Functions from the former DITRDLG to DORA) transferred three amounts from the former DITRDLG to DORA:
(a)$144,215,595.79 of Outcome 3 of the administered item from Appropriation Act (No. 1) 2010-2011. Of this amount, $12,926,636 was transferred in excess of the requirement. $1,601,636 was returned to the Department of Infrastructure and Transport by Financial Management and Accountability Act 1997 Determination 2010/22 — Section 32 (Transfer of Functions from the former DITRDLG to DORA). The purpose of this Determination is to return the balance of this excess, being $11,325,000 to the Department of Infrastructure and Transport.
(b)$21,000,000.00 of the total of the Departmental item from Appropriation Act (No. 1) 2010-2011. Of this amount, $454,437.65 was transferred in excess of the requirement. The purpose of this Determination is to return the $454,437.65 to the Department of Infrastructure and Transport.
(c)$209,816,682.30 from Outcome 3 under the heading of “Payments to States, ACT, NT and local government” from Appropriation Act (No. 2) 2010-2011. Of this amount, $54,376,928 was transferred in excess of the requirement. The purpose of this Determination is to return the $54,376,928 to the Department of Infrastructure and Transport.
2 Commencement
This Determination commences on the day on which it is made.
Note: Under subsection 32(8) of the FMA Act, a determination may be expressed to take effect before its making and registration under the Legislative Instruments Act 2003.
3 Amendment of Appropriation Act (No. 1) 2010-2011
Schedule 1 amends Appropriation Act (No. 1) 2010-2011 to:
(a)transfer an amount of $11,325,000.00 of Outcome 1 under “Administered” for DORA to Outcome 3 under “Administered” for the former DITRDLG;
(b)reduce an amount of $454,437.65 of the total of the Departmental item for DORA; and
(c)increase an amount of $347,510.00 of the total of the Departmental item for the former DITRDLG.
Note: The amounts relate to the transfer of infrastructure employment project programs of DORA to the former DITRDLG.
4 Amendment of Appropriation Act (No. 1) 2009-2010
Schedule 2 amends Appropriation Act (No. 1) 2009-2010 to increase an amount of $106,927.65 of the Departmental item for the former DITRDLG.
Note: The amount transferred relates to the transfer of infrastructure employment project programs of DORA to the former DITRDLG.
5 Amendment of Appropriation Act (No. 2) 2010-2011
Schedule 3 amends Appropriation Act (No. 2) 2010-2011 to transfer an amount of $54,376,928.00 from Outcome 1 under the heading “Payments to States, ACT, NT and local government” for DORA to Outcome 3 under the heading of “Payments to States, ACT, NT and local government” of the former DITRDLG.
Note: The amount transferred relates to the transfer of infrastructure employment project programs of DORA to former DITRDLG.
