Part 1Preliminary1Name of regulations

These regulations are the Financial Framework (Supplementary Powers) Regulations 1997.

3Definitions

In these regulations:

Act means the Financial Framework (Supplementary Powers) Act 1997.

Part 2Supplementary powers to make commitments to spend money and be involved in companies etc.16Arrangements and programs (Act s 32B)
  1. (1)

    For the purposes of subsection 32B(2) of the Act:

    1. (a)

      Part 1 of Schedule 1AA specifies:

      1. (i)

        arrangements under which relevant money or other CRF money is, or may become, payable by the Commonwealth; and

      2. (ii)

        classes of arrangements; and

    2. (b)

      Part 2 of Schedule 1AA specifies:

      1. (i)

        grants of financial assistance to a State or Territory; and

      2. (ii)

        classes of grants; and

    3. (c)

      Part 3 of Schedule 1AA specifies:

      1. (i)

        grants of financial assistance to persons other than a State or Territory; and

      2. (ii)

        classes of grants; and

    4. (d)

      Part 4 of Schedule 1AA specifies programs.

    Note: Arrangement is defined in subsection 32B(4) of the Act.

  2. (2)

    The specification of an arrangement, grant or program in Schedule 1AA is not affected by:

    1. (a)

      a change in the name of the Department or authority specified as administering the arrangement, grant or program; or

    2. (b)

      the transfer to another Department or authority of responsibility, in whole or in part, for the administration of the arrangement, grant or program.

  3. (3)

    For the purposes of subsection 32B(2) of the Act:

    1. (a)

      Part 1 of Schedule 1AB specifies:

      1. (i)

        arrangements under which relevant money or other CRF money is, or may become, payable by the Commonwealth; and

      2. (ii)

        classes of arrangements; and

    2. (b)

      Part 2 of Schedule 1AB specifies:

22ABSupplementary powers to form companies etc. (Act s 39B)
  1. (1)

    For the purposes of paragraphs 39B(1)(a) and (2)(a) of the Act, each item of Schedule 1B specifies a company.

  2. (2)

    For the purposes of paragraphs 39B(1)(b) and (2)(b) of the Act, each item of Schedule 1B specifies objects or proposed activities of the company specified in the item.

Part 3Transitional and application provisionsDivision 1Amendments made by the Financial Management and Accountability Amendment (Public Governance) Regulation 201423Definitions

In this Division:

amending regulation means the Financial Management and Accountability Amendment (Public Governance) Regulation 2014.

commencement time means the time when the Financial Management and Accountability Amendment (Public Governance) Regulation 2014 commences.

24Commonwealth procurement and Guidelines

Despite the repeal of regulations 7, 7A, 7B and 16A (which deal with Commonwealth procurement, and guidelines for Commonwealth grants, cleaning services and fraud) of these Regulations by the amending regulation, regulations 7, 7A, 7B and 16A, and any guidelines that are in force for the purposes of those regulations immediately before the commencement time, continue to apply after that time in relation to any process that is begun before that time.

25Disposal of property found on Commonwealth premises

Despite the repeal of regulation 23 (which deals with the disposal of property found on Commonwealth premises) of these Regulations by the amending regulation, regulation 23 continues to apply after the commencement time in relation to property found, or disposals that occur, before that time.

26Transferring leave entitlements

Despite the repeal of Part 11 (which deals with transferring leave entitlements when employees move between Agencies etc.) of these Regulations by the amending regulation, that Part continues to apply after the commencement time in relation to moves that occur before the commencement time.
