1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Social Services Measures No. 4) Regulations 2021.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

   In the appropriate position in Part 4 of Schedule 1AB (table)

Insert:

509	Care and Support Workforce National Campaign	To increase the size of the care and support workforce by funding a communications campaign to increase public awareness of the employment opportunities that are available in the care and support sector, including in aged care. This objective has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) for the provision of, or incidental to the provision of, unemployment benefits or benefits to students (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (c) to give effect to Australia’s obligations under either or both of the following: (i) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; (ii) the International Labour Organization’s Convention concerning Vocational Guidance and Vocational Training in the Development of Human Resources, particularly Articles 1 to 4.
510	Cashless welfare support services	To fund the following to support participants of the Cashless Debit Card program: (a) services that prevent domestic and family violence and support victims of such violence; (b) services that provide assistance to unemployed persons so that they may prepare for, and find, work; (c) services that provide treatment, rehabilitation, case management services and training assessments for people with mental illness; (d) services that support families so as to ensure the safety and wellbeing of children; (e) services that assist children to prepare them for employment; (f) services that assist participants to manage their working age welfare payment; (g) infrastructure which facilitates participants accessing the internet. This objective has the effect it would have if it were limited to being a measure: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) incidental to the provision of maternity allowances, widows’ pensions, child endowment, unemployment, pharmaceutical, sickness or hospital benefits, medical or dental services, benefits to students or family allowances (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (c) to give effect to Australia’s obligations under one or more of the following: (i) the Convention on the Elimination of All Forms of Discrimination against Women, particularly Articles 2, 3, 5 and 16; (ii) the Convention on the Rights of the Child, particularly Articles 4, 6, 18 and 19; (iii) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 6 and 12; (iv) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; (v) the International Labour Organization’s Convention concerning Vocational Guidance and Vocational Training in the Development of Human Resources, particularly Articles 1, 2, 3 and 4.
511	National early childhood program for children with disability or developmental concerns	To provide information, and deliver community‑based supports, for the benefit of young children aged 0 to 8 years with disability or developmental concerns, including by funding measures to: (a) enable parents and carers to access information about their child’s development and early capacity‑building supports; or (b) help prepare children with disability or developmental concerns for school and other learning environments; or (c) develop the skills and confidence of parents and carers to support their child’s learning and development and connect with services; to give effect to Australia’s obligations under either or both of the following: (d) the Convention on the Rights of Persons with Disabilities, particularly Articles 7 and 24; (e) the Convention on the Rights of the Child, particularly Articles 18, 23 and 27. This objective also has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) for the provision of, or incidental to the provision of, sickness benefits (within the meaning of paragraph 51(xxiiiA) of the Constitution).
