1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Jobs and Small Business Measures No. 1) Regulations 2018.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

   In the appropriate position in Part 3 of Schedule 1AB (table)

Insert:

27 Grant to the Brotherhood of St Laurence To fund the Brotherhood of St Laurence to develop and implement, in collaboration with stakeholders, measures to promote the employment of young people nationally. This purpose also has the effect it would have if it were limited to providing funding for measures: (a) to give effect to Australia’s obligations under the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Article 6; (ii) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; or (b) taken in connection with online or electronic communications; or (c) taken in the exercise of the executive power of the Commonwealth.

Part 4 of Schedule 1AB (table item 127)

Repeal the item, substitute:

127 New Enterprise Incentive Scheme To provide persons with small business training, mentoring and assistance to help create a financially viable business and to become self‑employed business owners. This objective also has the effect it would have if it were limited to measures: (a) providing, or that are incidental to the provision of, unemployment benefits (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (b) to give effect to Australia’s obligations under: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 6 and 13(2)(b); or (ii) the International Labour Organization’s Employment Policy Convention, particularly Articles 1 and 2; or (iii) the International Labour Organization’s Human Resources Development Convention, particularly Articles 1, 2, 3 and 4; or (c) in, or in relation to, a Territory.

Part 4 of Schedule 1AB (table item 139)

Repeal the item, substitute:

139 ParentsNext To provide assistance to parents who are not employed, or who are substantially underemployed, to do the following: (a) develop an employment plan that will facilitate their obtaining sustainable employment; (b) take the steps set out in the employment plan. This objective also has the effect it would have if it were limited to measures: (a) providing, or that are incidental to the provision of, family allowances, child endowment, unemployment benefits, benefits to students, hospital and sickness benefits, and medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (b) to give effect to Australia’s obligations under the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2, 6 and 12; (ii) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; (iii) the International Labour Organization’s Convention concerning Vocational Guidance and Vocational Training in the Development of Human Resources, particularly Articles 1 and 2; (iv) the Convention on the Rights of the Child, particularly Articles 18 and 27.

Insert:

268 Transition support services To provide (including in cooperation with employers) persons with support and training services relating to transitioning into new employment, including: (a) advisory services in respect of career options, skills in demand, and skills and training assessments; and (b) resilience, health and wellbeing support; and (c) language, literacy and numeracy skills training; and (d) funding for training; and (e) financial education. This objective also has the effect it would have if it were limited to measures: (a) to provide unemployment benefits (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (b) to give effect to Australia’s obligations under: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 6 and 13(2)(b); or (ii) the International Labour Organization’s Employment Policy Convention, particularly Articles 1 and 2; or (iii) the International Labour Organization’s Human Resources Development Convention, particularly Articles 1, 2, 3 and 4.
