1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Infrastructure, Transport, Regional Development, Communications and the Arts Measures No. 3) Regulations 2023.

2Commencement

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1Amendments

Financial Framework (Supplementary Powers) Regulations 1997

   In the appropriate position in Part 3 of Schedule 1AB (table)

Insert:

72 Grant to Australian Youth Orchestra To fund the Australian Youth Orchestra’s National Music Teacher Mentoring Program, which provides mentoring to generalist teachers to deliver music education to primary school students, as a measure to give effect to Australia’s obligations under the Convention on the Rights of the Child, particularly Articles 4, 13 and 29. This purpose also has the effect it would have if it were limited to measures: (a) for the provision of, or incidental to the provision of, student benefits (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (b) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation.

Insert:

617	Growing Regions Program	To provide funding for capital works for community infrastructure across regional Australia. This objective has the effect it would have if it were limited to measures: (a) in connection with trade and commerce with other countries, or among the States and Territories; or (b) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (c) with respect to Indigenous Australians and particular groups of Indigenous Australians; or (d) to give effect to Australia’s obligations under one or more treaties, including the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 6; (ii) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; or (e) involving the granting of financial assistance to a State or Territory; or (f) undertaken in, or in relation to, a Territory.
618	National Road Safety Action Grants Program	To reduce deaths and injuries from road crashes in Australia by funding activities or projects that relate to non‑infrastructure commitments in the National Road Safety Action Plan 2023‑25. This objective has the effect it would have it if were limited to measures: (a) in connection with trade and commerce with other countries, or among the States and Territories; or (b) with respect to census and statistics; or (c) with respect to Indigenous Australians and particular groups of Indigenous Australians; or (d) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or (e) involving the granting of financial assistance to a State or Territory; or (f) undertaken in, or in relation to, a Territory.
619	Regional Precincts and Partnerships Program	To provide funding to State, Territory and local governments, universities and not‑for‑profit organisations to support the planning and delivery of precincts in regional, rural and remote areas. This objective has the effect it would have if it were limited to measures: (a) in connection with trade and commerce with other countries, or among the States and Territories; or (b) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (c) with respect to Indigenous Australians and particular groups of Indigenous Australians; or (d) to give effect to Australia’s obligations under one or more treaties, including the following: (i) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 6; (ii) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; (iii) the United Nations Framework Convention on Climate Change, particularly Article 4; (iv) the Kyoto Protocol to the United Nations Framework Convention on Climate Change, particularly Article 10; (v) the Paris Agreement, particularly Articles 4 and 7; or (e) that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or (f) involving the granting of financial assistance to a State or Territory; or (g) undertaken in, or in relation to, a Territory.
