1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Health Measures No. 3) Regulations 2020.

2Commencement

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

Insert:

410	Perinatal Mental Health and Wellbeing Program	To fund organisations to develop and provide perinatal mental health support, promotion and training and wellbeing peer support. This objective also has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) for the provision of medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (c) to give effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12.
411	Perinatal Mental Health Check	To establish, maintain and encourage uptake and delivery of a perinatal mental health screening program for new and expecting parents, including by: (a) funding the provision of digital infrastructure, training and support for perinatal mental health screening in public hospitals; and (b) funding initiatives to improve the assessment, management and treatment of perinatal mental health conditions; and (c) disseminating information and support resources in relation to perinatal mental health. This objective also has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) to give effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12.
412	Donor Human Milk Bank Service	To support the ongoing operation and expansion of a coordinated network of donor human milk banks to ensure that premature babies born in Australia have access to human milk, including by providing funding for the following: (a) infrastructure (including upgrading existing infrastructure) and the ongoing operation of facilities to enable the processing and distribution of donor human milk; (b) to establish and maintain consistent production management and processes to ensure that donor human milk is safe and uncontaminated; (c) to establish and undertake research programs concerned with improving outcomes for premature babies and investigating donor human milk processing technologies and product derivatives. This objective also has the effect it would have if it were limited to measures: (a) with respect to census and statistics; or (b) which provide, or are incidental to the provision of, medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (c) to give effect to Australia’s obligations under either or both of the following: (i) the Convention on the Rights of the Child, particularly Articles 4 and 24; (ii) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; or (d) undertaken in, or in relation to, a Territory.
413	Adult Mental Health Centres	To fund a trial of adult mental health centres, including the provision or operation of the following: (a) counselling and other mental health services; (b) advice and referral to specialist mental health services; (c) information and support to family, friends and carers of persons with mental health conditions; (d) outreach services for persons who: (i) cannot attend a mental health centre or other primary mental health care service; or (ii) have been recently hospitalised or are at risk of hospitalisation; (e) digital mental health services. This objective also has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) which provide, or are incidental to the provision of, medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (c) to give effect to Australia’s obligations under either or both of the following: (i) the Convention on the Rights of Persons with Disabilities, particularly Articles 1, 4 and 25; (ii) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12; or (d) undertaken in, or in relation to, a Territory.
