1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Health Measures No. 1) Regulations 2017.

2Commencement

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

   In the appropriate position in Part 4 of Schedule 1AB (table)

Insert:

202	Rural outreach dental services	To fund the provision of dental services in regional, rural and remote areas, to the extent that these measures: (a) provide, or are incidental to the provision of, medical and dental services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (b) give effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights (particularly Articles 2 and 12); or (c) are carried out in a Territory or relate to residents of a Territory.
203	Suicide Prevention Research Fund	To fund an organisation to: (a) provide, in a nationally coordinated manner, grants for research into the prevention of suicide; and (b) develop and maintain an online hub of evidence‑based suicide prevention resources (including developing content for the hub). This objective also has the effect it would have if it were limited to measures: (a) in connection with electronic communications; or (b) to support veterans and defence force members and their families; or (c) to support Indigenous Australians or particular groups of Indigenous Australians; or (d) to give effect to Australia’s obligations under: (i) the International Covenant on Economic, Social and Cultural Rights (particularly Article 12); or (ii) the Convention on the Rights of the Child (particularly Article 24); or (iii) the Convention on the Elimination of All Forms of Discrimination Against Women (particularly Article 12); or (iv) the Convention on the Rights of Persons with Disabilities (particularly Article 25); or (e) in, or in relation to, a Territory; or (f) peculiarly adapted to the government of a nation and that cannot otherwise be carried out for the benefit of the nation.
204	Suicide Prevention Trials	To fund Primary Health Networks to conduct trials of suicide prevention models and practices which may include the provision of treatment for individuals who have attempted suicide. This objective also has the effect it would have if it were limited to measures: (a) in connection with electronic communications; or (b) to support veterans and defence force members and their families; or (c) to provide pharmaceutical, sickness and hospital benefits and medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution) and incidental to the provision of those benefits or services; or (d) to support Indigenous Australians or particular groups of Indigenous Australians; or (e) to give effect to Australia’s obligations under: (i) the International Covenant on Economic, Social and Cultural Rights (particularly Article 12); or (ii) the Convention on the Rights of the Child (particularly Article 24); or (iii) the Convention on the Elimination of All Forms of Discrimination Against Women (particularly Article 12); or (iv) the Convention on the Rights of Persons with Disabilities (particularly Article 25); or (f) in, or in relation to, a Territory; or (g) peculiarly adapted to the government of a nation and that cannot otherwise be carried out for the benefit of the nation.
205	Headspace	To provide funding for youth‑friendly community‑based mental health services for young Australians aged 12 to 25 with, or at risk of developing, mental illness and associated drug and alcohol problems, including by: (a) providing a Centre of Excellence to promote evidence‑based practice; and (b) leading the design and delivery of early identification and intervention strategies; and (c) fostering community awareness of youth mental health and drug and alcohol issues; and (d) implementing a grants program to support local, integrated approaches to enhance and facilitate the coordination of services; and (e) developing and disseminating evidence‑based education, training and resources for general practitioners and other service providers; and (f) establishing and delivering eheadspace, a national telephone and web‑based support service; and (g) maintaining centralised management and support to service sites by the headspace national office, including standardised data collection, clinical expertise and staff training; and (h) implementing a framework for ongoing independent evaluation and data training. This objective also has the effect it would have if it were limited to measures: (a) providing medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution) and incidental to the provision of those services; or (b) giving effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights (particularly Articles 2 and 12); or (c) carried out in, or in relation to, a Territory; or (d) for the collection, analysis, dissemination or use of statistics (within the meaning of paragraph 51(xi) of the Constitution); or (e) in connection with telephonic or electronic communications.
206	Lifeline text service	To fund the development, delivery and evaluation of a trial text message‑based support service for people needing crisis or suicide prevention support. This objective also has the effect it would have if it were limited to measures in connection with telephonic or electronic communications.
207	Digital technologies for mental health	To fund: (a) the development of resources and support tools relating to mental health for delivery online; and (b) the development of smart applications and websites for the delivery online of resources and support tools relating to mental health services; and (c) the delivery online of mental health services including by means of smart applications, websites and third party messenger services; and (d) the development and trial of information technology solutions to better deliver online mental health services; and (e) the evaluation of the efficacy of: (i) the resources and the support tools referred to in paragraphs (a) and (b); and (ii) the smart applications and websites referred to in paragraphs (b) and (c); and (iii) the online delivery of mental health services referred to in paragraph (d). This objective also has the effect it would have if it were limited to measures in connection with electronic communications.
208	Digital Mental Health Gateway	To provide funding: (a) to use digital technology (including online communications and telephone) to provide evidence‑based information and advice to the community on mental health and digital mental health service options; and (b) to develop and implement a certification framework for digital mental health services. This objective also has the effect it would have if it were limited to measures in connection with telephonic or electronic communications.
