1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Health and Aged Care Measures No. 2) Regulations 2022.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1Amendments

Financial Framework (Supplementary Powers) Regulations 1997

   In the appropriate position in Part 3 of Schedule 1AB (table)

Insert:

61	Grant to The Shepherd Centre ‑ for deaf children	To provide funding to The Shepherd Centre ‑ for deaf children for the purposes of: (a) establishing a facility to support children with hearing loss and their families in each of the following regions: (i) the Macarthur Region of South Western Sydney; (ii) the Launceston region of Tasmania; (iii) the Hobart region of Tasmania; and (b) expanding the HearHub digital health platform to provide clinical and other support for children with hearing loss; to give effect to Australia’s obligations under one or more of the following: (c) the Convention on the Rights of Persons with Disabilities, particularly Articles 4 and 25; (d) the Convention on the Rights of the Child, particularly Articles 4, 23 and 24; (e) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12. This purpose also has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) for the provision of, or incidental to the provision of, medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution).
62	Grant to World Wellness Group Limited	To provide funding to the World Wellness Group Limited for upgrades to the existing infrastructure and facilities at its multicultural health clinic in Brisbane to support improved access to health services (including general practice, mental health and allied health services), and community education and resources, for people of culturally and linguistically diverse backgrounds, to give effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12. This purpose also has the effect it would have if it were limited to measures for the provision of, or incidental to the provision of, medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution).

Insert:

571 National Nurse and Midwife Health Service To fund services (including counselling and other support services, and referral services) for nurses and midwives, and nursing and midwifery students, experiencing health issues. This objective has the effect it would have if it were limited to measures: (a) for the provision of, or incidental to the provision of, medical services (within the meaning of paragraph 51(xxiiiA) of the Constitution); or (b) to give effect to Australia’s obligations under one or more of the following: (i) the Convention on the Elimination of All Forms of Discrimination against Women, particularly Articles 2, 5 and 16; (ii) the International Covenant on Civil and Political Rights, particularly Articles 2, 7 and 17; (iii) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 12.
