1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Education, Skills and Employment Measures No. 2) Regulations 2022.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Financial Framework (Supplementary Powers) Act 1997.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

   Part 4 of Schedule 1AB (cell at table item 34, column headed “Objective(s)”)

Repeal the cell, substitute:

To support the Workforce Australia program by:

(a) providing benefits to unemployed persons by giving them the skills and attributes to meet the needs of prospective employers (including in circumstances where training in, or acquisition of, such skills and attributes is a condition of their receipt of payments under the Social Security Act 1991); and

(b) providing technical and vocational guidance and training programs to enable persons to realise the right to work, giving effect to Australia’s obligations under the International Labour Organization’s Convention concerning Vocational Guidance and Vocational Training in the Development of Human Resources, particularly Articles 1 to 4; and

(c) promoting full, productive and freely chosen employment, giving effect to Australia’s obligations under the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; and

(d) providing a free public employment service, giving effect to Australia’s obligations under the International Labour Organization’s Convention concerning the Organisation of the Employment Service, particularly Articles 1 and 2.

   In the appropriate position in Part 4 of Schedule 1AB (table)

Insert:

545	Competitive fund for micro‑credentials (pilot program)	To develop micro‑credentials for international delivery by tertiary education providers. This objective has the effect it would have if it were limited to measures: (a) with respect to trade and commerce with other countries; or (b) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution).
546	Scaling up Success in Remote Schools	To provide funding to improve educational outcomes of Aboriginal and Torres Strait Islander students in regional and remote areas. This objective also has the effect it would have if it were limited to measures to give effect to Australia’s obligations under either or both of the following: (a) the Convention on the Rights of the Child, particularly Articles 4, 28 and 29; (b) the International Covenant on Economic, Social and Cultural Rights, particularly Articles 2 and 13.
547	Workforce Australia	To help job seekers find and keep a job by: (a) providing employment and related assessments and services which assist job seekers to find and keep a job with suitable employers; and (b) providing activities, including in not‑for‑profit and government organisations, to help prepare job seekers for the work environment; and (c) engaging a panel of Workforce Specialists to identify and deliver projects that provide job seekers with opportunities in areas of workforce demand. This objective has the effect it would have if it were limited to measures: (a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) for the provision of, or incidental to the provision of, allowances, benefits, endowments or services of the kind described in paragraph 51(xxiiiA) of the Constitution; or (c) to give effect to Australia’s obligations under one or more of the following: (i) the International Labour Organization’s Convention concerning Employment Policy, particularly Articles 1 and 2; (ii) the International Labour Organization’s Convention concerning the Organisation of the Employment Service, particularly Articles 1 and 2; (iii) the International Labour Organization’s Convention concerning Vocational Guidance and Vocational Training in the Development of Human Resources, particularly Articles 1 to 4.
