1Name

This instrument is the Financial Framework (Supplementary Powers) Amendment (Education and Training Measures No. 6) Regulations 2017.

2Commencement

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

Insert:

10 Grants for school education reform To provide grants of financial assistance to a State or Territory to enable the State or Territory to undertake school education reform or implement national policy measures relating to school education.

Insert:

24	Grants to the Australian Institute for Teaching and School Leadership Limited	To fund the Australian Institute for Teaching and School Leadership Limited to provide national leadership for the Commonwealth, State and Territory governments in promoting excellence in the profession of teaching and school leadership, including by: (a) working collaboratively with government and non‑government sector employers and authorities, professional associations, education unions and other relevant bodies throughout Australia; and (b) developing and implementing national approaches to: (i) professional standards for teachers and school leaders; and (ii) initial teacher education, school leadership, and teaching; and (iii) principal preparation and certification; and (iv) teacher registration; and (v) measuring teacher effectiveness; and (c) conducting research and developing the evidence base for national education reforms. This purpose also has the effect it would have if it were limited to measures: (a) peculiarly adapted to the government of a nation that cannot otherwise be carried on for the benefit of the nation; or (b) to give effect to Australia’s obligations under: (i) the International Covenant on Economic, Social and Cultural Rights (particularly Articles 2 and 13); or (ii) the Convention on the Rights of the Child (particularly Articles 4, 28 and 29); or (c) undertaken in the exercise of the executive power of the Commonwealth.
25	Education Services Australia Limited	To provide funding to Education Services Australia Limited in conjunction with the States and Territories to: (a) implement interoperability services for school education; and (b) implement the Commonwealth government’s information hub for students, parents and teachers on safety and wellbeing (the Student Wellbeing Hub); and (c) develop and deliver education resources and professional development material for teachers; and (d) provide assistance to, and implement the projects and initiatives of, the Council of Australian Governments Education Council. These objectives also have the effect they would have if they were limited to education measures: (a) relating to postal, telegraphic, telephonic or other like services (within the meaning of paragraph 51(v) of the Constitution); or (b) to meet Australia’s obligations under: (i) the Convention on the Rights of the Child (particularly Articles 4, 28 and 29); or (ii) the International Covenant on Economic, Social and Cultural Rights (particularly Articles 2 and 13); or (c) that are peculiarly adapted to the government of the nation and which cannot otherwise be carried on for the benefit of the nation; or (d) undertaken in the exercise of the executive power of the Commonwealth.

Insert:

255	Quality assurance of data relating to students with disabilities	To ensure the quality and consistency of data provided by approved authorities about students with disabilities for the purposes of the Australian Education Act 2013 by funding: (a) activities that relate to quality assurance in relation to such data, including contributions to a national quality assurance program; and (b) the publication of educational materials for schools. These objectives also have the effect they would have if they were limited to activities: (a) in connection with electronic communications; or (b) involving the collection, analysis, dissemination or use of statistics; or (c) to give effect to Australia’s obligations under the Convention on the Rights of Persons with Disabilities (particularly Article 24(2)); or (d) done in exercise of the executive power of the Commonwealth; or (e) funded by way of grants of financial assistance to States and Territories.
256	Trends in International Mathematics and Science Study and Progress in International Reading Literacy Study	To fund Australia’s involvement in the following international assessments conducted by the International Association for the Evaluation of Educational Achievement: (a) Trends in International Mathematics and Science Study; (b) Progress in International Reading Literacy Study. This objective also has the effect it would have if it were limited to providing funding for activities relating to external affairs.
