Schedule 1Amendments

Insert:

Regional Agricultural Show Development Grants Program

To provide grants for the construction, upgrade, maintenance or purchase of:

(a) agricultural showground infrastructure in regional areas; or

(b) other infrastructure and related assets that will enhance agricultural shows, or the capacity of show societies, in regional areas.

This objective also has the effect it would have if it were limited to providing grants:

(a) in connection with trade and commerce with other countries, or among the States and Territories (within the meaning of paragraph 51(i) of the Constitution); or

(b) in connection with assisting Australia to give effect to its obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Article 15; or

(c) to provide for measures that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(d) as financial assistance to a State or Territory; or

(e) in, or in relation to, a Territory.

Agriculture Stewardship Package

To promote the adoption of sustainable agriculture practices across Australia and in particular to develop and implement the following:

(a) a Sustainable Agriculture Policy directed at sustainable agricultural practices and biodiversity outcomes;

(b) an Agricultural Stewardship Program to support sustainable agriculture practices, including by funding projects to deliver on‑farm outcomes to enhance conservation and protect biodiversity;

(c) a Sustainable Agriculture Extension Program to increase farmers’ awareness of the benefits of implementing particular practices on their farms, including by providing grants to organisations to disseminate information about sustainable farming practices.

This objective also has the effect it would have if it were limited to providing grants:

(a) to give effect to Australia’s obligations under either or both of the following:

(i) the Convention on Biological Diversity, particularly Article 6;

(ii) the United Nations Convention to Combat Desertification in those Countries Experiencing Serious Drought and/or Desertification, Particularly in Africa, particularly Articles 5 and 10; or

(b) to provide for measures that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(c) in the exercise of the executive power of the Commonwealth; or

(d) in, or in relation to, a Territory.

Educating Kids about Agriculture

To provide grants for activities directed at increasing children’s understanding of:

(a) where and how their food and fibre are produced; and

(b) the role and importance of agriculture to Australia’s way of life, regional communities and the economy.

This objective also has the effect it would have if it were limited to providing funding for measures:

(a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or

(b) to give effect to Australia’s obligations under the Convention on the Rights of the Child, particularly Articles 4 and 28.

National Farm Safety Education Fund

To provide funding to promote and support activities relating to safety in the agriculture, fisheries and forestry sectors, including:

(a) developing a strategy with key targets for fund investments; and

(b) developing safety resources to educate farm, fishing and forestry businesses on best practice; and

(c) developing initiatives to improve safety and safety culture; and

(d) building partnerships between industry and regulators in these sectors.

This objective also has the effect it would have if it were limited to providing funding for measures:

(a) with respect to postal, telegraphic, telephonic, and other like services (within the meaning of paragraph 51(v) of the Constitution); or

(b) undertaken in the exercise of the executive power of the Commonwealth.

Grant to Dairy Australia Limited

To provide funding to Dairy Australia Limited to assist dairy farmers, including to support the development and operation of a margin comparison calculator.

This objective also has the effect it would have if it were limited to providing assistance:

(a) for activities relating to trade and commerce with other countries, or among the States and Territories (within the meaning of paragraph 51(i) of the Constitution); or

(b) through the delivery of information and services online; or

(c) to give effect to Australia’s obligations under the International Covenant on Economic, Social and Cultural Rights, particularly Article 11; or

(d) for measures that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(e) in, or in relation to, a Territory.

Grant to Australian Dairy Farmers’ Limited

To provide funding to Australian Dairy Farmers’ Limited to assist dairy farmers by supporting the development and operation of the following for the dairy industry:

(a) new payment technologies;

(b) trading and marketing platforms.

This objective also has the effect it would have if it were limited to providing assistance through the delivery of information and services online.

Package Assisting Small Exporters

To provide support for small exporters to engage in overseas trade and commerce, including supporting small exporters to:

(a) overcome barriers to their participation in overseas trade and commerce; and

(b) identify and make use of opportunities to participate in overseas trade and commerce;

by funding projects aimed at improving market access for small exporters.

Starting Farm Cooperatives

To provide support to assist farmers to establish farm cooperatives and other collaborative business models, including through the following:

(a) financial support to farmers to establish new cooperatives;

(b) promotion of educational materials and resources regarding farm cooperative business models;

(c) financial assistance to farmers to fund fees for training courses relevant to farm cooperative business models;

(d) an advisory hotline in relation to farm cooperatives business models;

(e) information sessions, workshops and other events relating to farm cooperative business models;

(f) an accreditation framework for educational providers for recognition of farmers’ prior learning relating to farm cooperative business models.

This objective also has the effect it would have if it were limited to providing funding or support:

(a) relating to, or in connection with, trade and commerce with other countries, or among the States and Territories (within the meaning of paragraph 51(i) of the Constitution); or

(b) for measures with respect to postal, telegraphic, telephonic and other like services (within the meaning of paragraph 51(v) of the Constitution); or

(c) for measures for the provision of, or incidental to the provision of, benefits to students (within the meaning of paragraph 51(xxiiiA) on the Constitution).
