1Name

This is the Financial Framework (Supplementary Powers) Amendment (2014 Measures No. 2) Regulation 2014.

2Commencement

This instrument commences on the day after it is registered.

3Authority

This instrument is made under the Financial Framework (Supplementary Powers) Act 1997.

4Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Financial Framework (Supplementary Powers) Regulations 1997

1  Part 2 of Schedule 1AB (at the end of the table)

Add:

3 Grants for drought recovery assistance To establish and fund schemes for making loans to eligible farm businesses.
4 Stronger Biosecurity and Quarantine programme—grants to States and Territories to conduct biosecurity response and preparedness activities

To provide grants of financial assistance to a State or Territory to respond to biosecurity threats including by doing the following:

(a) employing personnel and equipping them to carry out biosecurity functions;

(b) adopting measures to prepare for biosecurity threats;

(c) building capacity to respond to biosecurity threats.

Add:

64 Industry Growth Centres Initiative

To support, and to establish, Industry Growth Centres to facilitate nationally significant research, collaboration, sharing of knowledge, development and deployment of technology, and projects for the benefit of the nation.

This objective also has the effect it would have if it were limited to providing funding and support:

(a) for the promotion or development of interstate or overseas trade and commerce; or

(b) by engaging in measures that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation.

65 Stronger Biosecurity and Quarantine programme—grants to external parties to conduct biosecurity response and preparedness activities

To provide funding to respond to biosecurity threats, including by doing the following:

(a) employing personnel and equipping them to carry out biosecurity functions;

(b) adopting measures to prepare for biosecurity threats;

(c) building capacity to respond to biosecurity threats.

This objective also has the effect it would have if it were limited to providing funding or support:

(a) in connection with quarantine; or

(b) that is peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(c) in the exercise of the executive power of the Commonwealth.

66 Improved Access to Agricultural and Veterinary Chemicals Programme

To support and encourage uses of agricultural and veterinary chemicals consistent with the National Registration Scheme for Agricultural and Veterinary Chemicals (NRS).

This objective also has the effect it would have if it were limited to:

(a) supporting and encouraging uses of agricultural and veterinary chemicals consistent with the Commonwealth registration scheme for agricultural and veterinary chemicals, being a scheme based on laws made for the Australian Capital Territory; or

(b) implementing or giving effect to the agreements referred to in section 9A of the Agricultural and Veterinary Chemicals (Administration) Act 1992.

67 National Assessment Reform To deliver the National Assessment Program online, including the National Assessment Program—Literacy and Numeracy (NAPLAN) test and other assessments of sample populations.
68 Australian Small Business Advisory Services programme

To support small business advisers in providing advisory services.

This objective also has the effect it would have if it were limited to:

(a) providing regulated assistance to small business advisers that are trading, financial or foreign corporations to which paragraph 51(xx) of the Constitution applies where the assistance relates to the existing activities of the corporation; or

(b) providing assistance to small business advisers in relation to a Territory.

69 Community Assistance Support—Transitional Support

1. To manage unlawful non‑citizens and holders of bridging visas in the community to an immigration outcome through early intervention and provision of needs‑based support and assistance.

2. To support holders of substantive visas to transition into the community through the provision of needs‑based support and assistance.

70 Tasmanian Jobs and Growth Package

To provide grants for projects that support economic growth and jobs in Tasmania.

This objective also has the effect it would have if it were limited to providing grants:

(a) as financial assistance to Tasmania; or

(b) to or in relation to Indigenous Australians and particular groups of Indigenous Australians; or

(c) in connection with trade and commerce with other countries, or among the States and Territories; or

(d) in connection with assisting Australia to meet its obligations under international agreements; or

(e) to provide medical services, unemployment, pharmaceutical, sickness and hospital benefits, benefits to students, and measures incidental to the provision of those matters; or

(f) in connection with electronic communications; or

(g) to provide assistance to trading, financial and foreign corporations to which paragraph 51(xx) of the Constitution applies where the assistance relates to the existing activities of the corporations; or

(h) to provide for measures that are peculiarly adapted to the government of a nation and cannot otherwise be carried on for the benefit of the nation; or

(i) in the exercise of the executive power of the Commonwealth.
