B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :-- 1. This Act may be cited as "The Financial Short title Arrangements and Development Aid Acts Amendment Act and t t' of 1947," and shall be read as one with *" The Financial cons ruc lOn. Arrangements and Development Aid Acts, 1942 to 1945," herein referred to as the Principal Act. The Principal Act and this Act may collectively be Collective cited as " The Financial Arrangements and Development title. Aid Acts, 1942 to 1947." * 6 G. 6 No. 26 and amending Acts.

Section nine of the Principal Act is repealed and and news. 9. the following section is inserted in lieu thereof, namely :— Officers. " [9.] (I.) The provisions of this Act shall have operation and effect, and are hereby declared always to have had operation and effect, so as not to prejudice or limit the power of the Governor in Council to appoint, pursuant to his powers in that behalf, persons to the following offices, when and so often as vacancies have occurred or shall occur therein, that is to say :— (i.) The Commissioner of Taxes; (ii.) The Assistant Commissioner of Taxes; (iii.) Deputy of the Commissioner or Assistant Commissioner of Taxes. (2.) Any officer holding any office specified in subsection one of this section when such officer was temporarily transferred to the Public Service of the Commonwealth under the *Income Tax (War-time Arrangements) Act, 1942, of the Commonwealth shall, notwithstanding such temporary transfer and notwithstanding that he was later appointed to or employed in the Commonwealth Service under Division 9B of the *Commonwealth Public Service Act, 1922-1946, continue, and is hereby declared always to have continued, to hold such office under and for the purposes of " The Income Tax Assessment Acts, 1936 to 1942," until his tenure of such office shall have been or shall be terminated by death, resignation, or promotion or transfer to some other office, or by the Governor in Council (the Governor in Council being hereby authorised, and being hereby declared always to have been authorised, to terminate at any time after his appointment or employment in the Commonwealth Service under the said Division 9B the tenure of such office by such officer). (3.) The officer holding office both as the Commis, sioner of Taxes and the commissioner of Stamp Dudes when such officer was temporarily transferred to the Public Service of the Commonwealth under the ''Income Tax (War-time Arrangements) Act, 1942, of the Commonwealth shall, notwithstanding such temporary transfer, be deemed to have continued to hold both such offices and to have been the Commissioner of Taxes and in addition the Commissioner of Stamp Duties until he died. * No. 21 of 1942 of the Commonwealth. t No. 21 of 1922 of the Commonwealth and amending Acts. 1 E. 8 No. 32 and amending Acts.
1947. COMMONWEALTH AND STATES. Financial Arrangements, Etc., Act. Moreover the person who, whilst so temporarily transferred to the Public Service of the Commonwealth, was, pursuant to the provisions of section nine of this Act repealed by *" The Financial Arrangements and Development Aid Acts Amendment Act of 1947," appointed by the Governor in Council, as from the seventh day of April, one thousand nine hundred and forty-five, to act as Commissioner of Taxes for the purposes of t" The Income Tax Assessment Acts, 1936 to 1942," during the continuance in operation of the Income Tax (War-time Arrangements) Act, 1942, of the Commonwealth shall (notwithstanding that such person may have become appointed to or employed in the Commonwealth service under Division 9B of the $Commonwealth Public Service Act, 1922-1946) be deemed, on and after his appointment by the Governor in Council as aforesaid, to have been— (i.) The Commissioner of Taxes; and (ii.) In addition the Commissioner of Stamp Duties, and such person— (iii.) Shall continue to be the Commissioner of Taxes until he ceases to be the Deputy Commissioner of Taxation in Queensland under the § Income Tax Assessment Acts, 1936-1947, of the Commonwealth unless his appointment as Commissioner of Taxes is sooner terminated by the Governor in Council; and (iv.) In addition shall continue to be the Commis- sioner of Stamp Duties until he ceases to be the Commissioner of Taxes or until the Governor in Council shall appoint another person to be the Commissioner of Stamp Duties (whichever event shall first happen). (4.) Every person who, at any time before the passing of *" The Financial Arrangements and Development Aid Acts Amendment Act of 1947," was or was deemed to be the Commissioner of, Taxes is hereby declared always to have been during his tenure of such office also the Commissioner of Land Tax and, until other appointment, the Commissioner of Taxes for the time being shall also be the Commissioner of Land Tax. * This Act. 1 E. 8 No. 32 and amending Acts. t No. 21 of 1922 of the Commonwealth and amending Acts. § No. 27 of 1936 and amending Act. 47

At all times during which arrangements made between the Governor-General of the Commonwealth and the Governor in Council for the collection by the Commonwealth on behalf of this State of income tax are in force any appointment to any office mentioned in subsection one of this section or any termination of any such appointment made by the Governor in Counoil shall be so made in compliance with the provisions in t.hat behalf contained in such arrangements."
