PROVISIONAL REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1911.

Financial and Allowance Regulations (Provisional) for the Naval Forces of the Commonwealth.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby certify that, on account of urgency, the following Revised Regulations under the Naval Defence Act 1910-1911 should come into immediate operation, and further should be taken to have come into operation on and from the 1st day of January, 1912, and make the Regulations to come into operation accordingly as Provisional Regulations.

FINANCIAL AND ALLOWANCE REGULATIONS (PROVISIONAL) FOR THE NAVAL FORCES OF THE COMMONWEALTH.

All Financial and Allowance Regulations for the Naval Forces of the Commonwealth heretofore made, whether provisional or otherwise, are hereby repealed.

The black lines in the margin serve to indicate new provisions or amendments of previously existing Regulations.

 

PART I.

DEFINITIONS.

Definitions.

1. In these Regulations unless the contrary intention appears:—

“Naval Board” means the Board of Administration for the Naval Forces.

“Naval Secretary” means the Officer appointed to be the Secretary to the Naval Board of Administration.

“Commanding Officer” means the Officer in actual command of one of H.M.A. Ships or Naval Establishments.

“District Naval Officer” means the Officer appointed to command a District.

“Naval Accountant” means the Officer appointed to be Naval Accountant in the office of the Naval Administration.

“Accountant Officer” means the Officer in charge of the pay, victualling, and clothing accounts of a ship, District or Naval Establishment.

“Authorizing Officer” means the Officer to be appointed to be Authorizing Officer for any District or Naval Establishment.

“Paying Officer” means the Officer appointed to be Paying Officer for any District, Naval Establishment, or Ship.

“Executive Officer” means an Officer of the Executive Branch of the Forces.

“Division” means the Naval Reserve, or Volunteer Force established at any Port.

PART II.—GENERAL INSTRUCTIONS.

Responsibility of Commanding Officers.

2. Naval Officers in Command shall be responsible for enforcing due economy on all Officers and others charged with any expenditure of public money, or with the care, use, or expenditure of stores.

3. It is the duty of every member of the Naval Forces to assist in carrying out these Regulations.

Expenditure that may be authorized by District Naval Officers.

4. Each District Naval Officer is authorized

(a) To approve of all requisitions for stores which are allowed by establishment.

Ordinary services.

(b) To approve of expenditure not exceeding £25 in any one case under Contingencies, provided he has satisfied himself that funds are available; that it is not a new vote or item; that it does not involve any alteration in existing rules or practice; that in the case of purchase of stores, such stores are allowed by establishment; that there is nothing irregular in the character of the expenditure; and that it is not an allowance or payment to any member of the Forces (except such as is governed by Regulation and does not require Ministerial approval).

Casual labour.

(c) To approve of the employment of casual labour (non-clerical); but no person is to be employed under this authority for any longer time than an aggregate period of six weeks in any financial year, without the approval of the Naval Board.

Compensation for injuries.

(d) To approve—in accordance with Regulations—of payments for Compensation for Injuries, provided the award does not exceed payment of compensation for thirty working days, and the medical expenses do not exceed £3 3s.

Striking off stores.

(e) To approve, in accordance with any regulations on the subject, of striking off charge of stores damaged or deficient, provided that the value does not exceed £5. The value of the stores struck off must be shown in the monthly schedule of expenditure incurred by District Naval Officers.

Increments.

(f) To approve of increments to Warrant Officers, Petty Officers and men, where such are provided in the Appropriation Act, and prescribed by the Regulations.

Expenditure limited.

4a. (1) The expenditure to be authorized by District Naval Officers under Regulation 4, clauses (b), (c), (d), and (e) must not exceed in the aggregate the following amounts per month in the respective States, without the approval of the Naval Board.

Monthly schedule of expenditure.

5. A monthly schedule of expenditure incurred by each District Naval Officer, under the authority in paragraph 4, clauses (b) to (e) inclusive, and not provided for by Regulations, shall (after being signed by the District Naval Officer) be forwarded to the Naval Secretary not later than the 7th of each month, in the following form:—

Payments not to be varied.

6. District Naval Officers shall not vary any payments provided for under Regulations.

Votes—re-arrangement of.

7. When it is necessary to make re-arrangements or transfers in connexion with any Votes, application shall be made, giving full reasons for the same, to the Naval Secretary.

Certificate as to funds to be furnished.

8. When a District Naval Officer submits any proposal involving expenditure, such proposal shall be accompanied by a statement from the Authorizing Officer, showing—

(а) The Division, Subdivision, and item of the Estimates to which the expenditure should be charged.

(b) That funds are available.

The District Naval Officer shall, in addition, state that, with his knowledge of the requirements for the remaining period of the financial year, the proposed expenditure will not involve the necessity of applying for additional funds on any Vote concerned.

Financial instructions—Accountant officers to see.

9. All financial instructions, approvals, or other decisions regarding expenditure, communicated to District Naval Officers, shall be forwarded without delay to the Accountant Officer.

Financial advice.

10. District Naval Officers shall consult with and obtain the advice of the Accountant Officer upon all financial matters.

Audit queries.

11. All audit queries shall be dealt with through the Accountant Officer, who shall obtain the necessary information and report for the satisfaction of the Treasury and Audit Departments.

Regulations not to apply to cadets.

12. Regulations herein contained do not apply to Senior or Junior Cadets.

PART III.

ACCOUNTANT OFFICERS.—DUTIES OF.

The duties of an Accountant Officer shall be as under—

Duties of Accountant Officers.

13. He shall be responsible for the disbursement of public moneys in accordance with the Regulations, and the carrying out of any instruction or authority issued by the Naval Board.

Arrears of work.

14. He shall be responsible that no arrears occur in the work of his office, and that the books are posted up daily, so that they may at all times be ready for examination.

Financial adviser.

15. He shall act as financial adviser to the Officer in Command upon all questions involving expenditure.

Accounts-responsibility as to.

16. He shall be responsible that all accounts are kept strictly in accordance with the Treasury Regulations or other approval.

Not to exceed authority for expenditure.

17. He shall be responsible that the amount authorized for expenditure under any Division or Subdivision of the Estimates, any Loan Appropriation or Trust Fund Credit, is not exceeded without due authority.

Claims inadmissible.

18. He shall, in the event of receiving any claim which appears to him not authorized by Regulations or instructions, or in regard to which there is doubt as to the admissibility of any charge, point out the same in writing to the Officer in Command. Should the Officer in Command consider that, on the contrary, such claim is covered by Regulation or authority, and that the charges are admissible, an immediate report as to the circumstances of the case shall be made by him to the Naval Secretary, and the account shall not be paid without the approval of the Naval Board.

Officers due for retirement—notification of.

19. He shall be responsible that the Officer in Command is informed, in writing, six months before the event, of the name of any member of the Permanent Forces attaining the age prescribed for compulsory retirement, to enable the Officer in Command to take such steps as he may deem necessary in the matter. In no circumstances is a member to be granted pay for any, period after the date on which he was, in the ordinary course, due for retirement, unless authority for the extension of his services has first been obtained.

Public Funds. How to be dealt with.

20. He shall not apply Public Moneys to any purpose not authorized by the Regulations, nor shall be advance (except as hereinafter provided), lend, or exchange any sums for which he is accountable, nor shall be exchange private cheques out of public funds. In the case of members of the Forces travelling on duty, where extended absence is probable, and cash payments exceeding a total sum of £5 have to be made, he may make an advance up to75 per cent. of the maximum allowance that can be claimed.

Advances not to be made without authority.

21. He shall not advance any moneys to a member of another District, on account of travelling or other expenses, unless authority has first been obtained for so doing from the authorizing officer of the District to which the expenditure is to be charged. In the cases of members of the Naval Administration, the authority of the Naval Accountant must be obtained before any such advances are made.

Liable for errors.

22. He shall be liable for the amount of disallowances arising from errors or overissues made by him in disregard of Regulations or in the absence of proper authority.

Recovery of vouchers.

23. Should difficulty be experienced in recovering vouchers, supporting receipts, statements, &c., or money due from officers or others, he shall at once represent the circumstances in writing to the District Naval Officer, who shall, if necessary, refer the matter to the Naval Secretary.

Audit queries.

24. He shall submit to the Officer in Command all queries from the Audit Department, together with the correspondence, if any, involved. In the case of a reply being deemed to be unsatisfactory by the Auditor General, the matter is to be referred, by the Officer in Command, to the Naval Secretary.

Audit Act and Regulations.

25. He shall see that a copy of the Audit Act and the Treasury, Regulations is supplied to every officer receiving or disbursing Public Moneys, and shall obtain receipts for such supply.

Responsible for supplies of stores, &c.

26. He is charged with the duty of obtaining all requisite supplies of provisions, victualling stores, and clothing for ships or establishments.

Instructions as to Payments.

Instructions as to Payments, Salaries—general.

27. (a) An amount provided on the Appropriation Act as salary for one appointment shall not be utilized for the payment of the salaries or portions thereof of two persons for the same period.

Officers’ salaries.

(b) No officer shall be paid the salary of any position to which he has not been appointed by Order in Council.

Allowances—Payment of.

(c) In no case, unless governed by Regulation, shall an allowance be paid to any member of the Forces, unless such allowance be authorized by the Naval Board.

Overtime.

(d) Overtime shall not be paid for unless the same has received the approval of the Naval Board.

Salaries to be paid from Pay Vote only.

(e) Salaries must not be paid from any Vote other than a Pay Vote. Temporary assistance, casual labour, and special services are chargeable to items under Contingency Votes, where provision exists.

Temporary employment.

(f) In no case shall any person be temporarily employed without the approval of the Naval Board, except as provided in para. 4 (c).

Advertising—claims for.

(g) Claims on account of advertising shall, wherever practicable, be submitted to the Government Printer or Advertising Board of the State concerned, for checking, before payment is made.

Transfer of Members of the Forces.

Transfer of Members.

28. (a) When the transfer of a member of the Permanent Naval Forces is made, a transfer list, Form A. S. 45, shall be passed between the Officers in Command of the Districts or ships concerned.

Debiting Cost of Transfers.

(b) The cost of transfer shall be paid by the Accountant Officer of the District, Naval Establishment or Ship to which the transfer is made.

Cheques.—Provision for Signing of.

Cheques.

29. (a) All cheques shall be signed by the Paying Officer, or such officer as may be dealing with the advances or credit against which the cheques are drawn, and countersigned by the Authorizing Officer, or such other officer as may, in accordance with the Treasury Regulations, be appointed for the purpose.

Specimen Signatures.

(b) The name of the countersigning officer, with a specimen of his signature, shall be forwarded by the District Naval Officer or officer in charge to the manager of the bank in which the account is kept. The Treasury will advise the bank as to the appointment of the Paying Officer. See also Section 18 of the Audit Act.

Payments to the Department.

Payments to Departments.

30. All payments to the Department in any District are to be made to the Accountant Officer; and bank drafts, cheques, post-office orders, or postal notes should be made payable to the Accountant Officer or order. Postage stamps in excess of 5d. are not to be used as portions of remittance. The official receipt given and accepted shall only be that issued by the Receiver of Public Moneys.

Trust Funds.

Trust Fund Accounts.

31. The following Trust Funds are approved:—

I. Uniform, Clothing, and Necessaries (Naval) Account.

Trust Fund—Uniform, Clothing, and Necessaries Account.

This Trust Fund is to be utilized for the following purposes:—

(a) Permanent Forces.—Purchase of any article of uniform or necessaries required on board ship, and which are issued on payment.

(b) Naval Reserves and Senior Cadets—Purchase of uniform material (serge, duck, flannel, &c.).

The proceeds of sale of any article purchased from the Trust Fund shall be credited to the Trust Fund.

II. Deferred Pay (Naval) Account.

The purpose of this Trust Fund is defined as follows:—

Payment of Deferred Pay and interest thereon to members of the Permanent Naval Forces (sea-going), in accordance with Regulations.

PAYMENT AND CERTIFICATION OF CLAIMS.

Payments to be made by the 30th June.

33. In order to prevent arrears, Officers shall be responsible that the following steps are taken:—

Payments to be made by 30th June.

(a) Supplies, &c., required to the end of June should be ordered in April or early in May, so that the accounts may be paid in May or early in June; and no orders except such as are absolutely necessary should be given after the middle of May.

Repairs and Works.

(b) The requisitions for repairs and similar works should be sent in as early as possible, and the works should, wherever practicable, be completed early in May.

Outstanding Accounts.

(c) Where accounts outstanding are likely to be of considerable amount, the persons interested should be requested to furnish the accounts promptly. A memorandum to that effect to be written across the orders when given.

Government Printer’s Accounts.

(d) Accounts for amounts due to the Government Printer, Railways, &c., should be specially asked for.

Monthly or Quarterly Accounts.

(e) In the case of monthly or quarterly payments, where the amount due on the 30th June can be ascertained, claimants should be asked to render their claims early in June, so that they may be paid before the 30th. Where the amount due cannot be ascertained before the end of June, the claimants should be asked to render accounts up to the middle of June only, the balance to be included in the next account.

Rents.

(f) Accounts for services up to end of June, such as rents and similar matters, should be paid about the middle of June.

Pay and Allowances.

(g) With regard to the pay and allowances of the Forces, such arrangements should be made as will enable all payments due for the financial year to be made prior to the 30th June.

Officers signing as “Person incurring the Expense” to be personally liable.

(h) Officers signing claims as “Person incurring the expense” will be held personally responsible that the claims certified by them are correct in every particular, and care in this respect will insure prompt payment. All claims must quote the Regulation or other authority under which preferred.

RATES OR TAXES.

Rates or Taxes.

34. In all cases where premises are rented or leased for departmental purposes no provision is to be included in the agreement or lease by which the Commonwealth Government is required to pay any taxes or water rates.

Water Rates.

35. Unless special approval to the contrary be obtained, where water is supplied, meters must be provided, so that payment may only be made for the quantity actually consumed. Accounts in connexion with such supplies should show that the charges are for services rendered, i.e., water supplied, claims for “water rate” not being admissible.

FIDELITY GUARANTEES OF OFFICERS AND OTHERS.

36. The Minister will determine what offices held by Officers, Warrant and Petty Officers, and others shall be guaranteed, and shall

fix the amount of such guarantee, which shall be in accordance with the following table:—

Whomto be guaranteed.

37. Every Officer, Warrant and Petty Officer, holding a permanent position in the Naval Forces, which is a guaranteed office under these Regulations, shall contribute to the Guarantee Fund established by, and in accordance with, Treasury Regulations.

Executive Officers.

38. In cases where an executive officer may be called upon to perform the duties of a guaranteed office which are apart from his regular duties, the Minister may sanction the payment of the premium out of the Vote for Incidentals.

Reserve Forces.

39. Every Officer, Warrant and Petty Officer, holding a position in the Reserve Forces which is a guaranteed office under these relations, shall contribute to the Guarantee Fund established by, and in accordance with Treasury Regulations.

Premiums—source from which payable.

40.The premiums payable under the preceding paragraph shall be a charge against the votes of the Department, and such premiums shall be paid to the District Naval Paymaster. The District Naval Paymaster will be held responsible for the collection of such premiums, and that the moneys so collected are paid to the Trust Fund to the credit of the “Guarantee Fund Account.’

Definition of Officer.”

41. Where the term “officer” is used in the Treasury Regulations referred to in these Regulations, it shall be held to include “Officer, Warrant and Petty Officer, or other person in the Naval Forces.”

PART IV.—PAY OF PERMANENT FORCES.

Pay and Allowances for Officers (Sea-going).

Rates of Pay—Officers (Sea-going).

42 (1.)The following rates of “active pay,” “deferred pay” and allowances shall apply to Officers appointed for sea-going service to the Commonwealth Permanent Naval Forces on or after 1st July, 1911. Officers serving in the Commonwealth Permanent Naval Forces on 30th June, 1911 (except those employed in the Central Administration or in shore appointments) may continue to draw the .rates of pay under Regulations existing at 30th June, 1911, or may, if they prefer, accept the new rates of pay prescribed under this Regulation from 1st July, 1911. (The rates of pay under Regulations existing at 30th June, 1911, are shown in the Appendix at the end of these Regulations).

Age for retirement.

Officers who accept the new rates of pay prescribed in this Regulation shall be compulsorily retired at the ages set forth below:—

43 (1.). The following rates of “active pay,” “deferred pay,” and allowances shall apply to Petty Officers, men, and boys appointed to the Commonwealth Permanent Naval Forces for sea-going service on or after 1st July, 1911. Petty Officers and men serving in the Commonwealth Permanent Naval Forces on 30th June, 1911, may continue to draw the rates of pay under Regulations existing at 30th June, 1911, or may, if they prefer, accept the new rates of pay prescribed under this Regulation from 1st July, 1911. (The rates of pay under Regulations existing at 30th June, 1911, are shown in the Appendix at the end of these Regulations.)

This money shall not be paid to the individual man or boy, except as hereinafter provided, but shall be used in payment of uniform clothing issued to each individual, the cost of which shall be charged against the gratuity. Men promoted to warrant rank shall on promotion be paid in cash any balance standing to their credit in the clothing account.

The kit to be maintained by each man or boy shall be that laid down in the Uniform Regulations. Any clothing required by a man or boy during the first twelve months of his service, in addition to that paid for as above, shall be provided at his own expense.

After completion of fifteen months’ service, a further sum of 6d. per diem for the quarter shall be credited to each man or boy and utilized as above; after another three months’ service, a further sum of 6d. per diem for the quarter and so on, quarterly, the money being used in payment of uniform clothing issued to the individual.

(1.) These amounts do not include personal baggage carried free by railway or steamer. No excess will be paid for.

(2.) Lighterage, Fremantle to Perth, is included in cost of removal to or from Perth.

(3.) The “married” rate will be paid in lieu of the “single” rate to members who are accompanied by their wives, or widowers with children.

(4.) The rates for children are to be added to the “married” rate, but are only admissible for children over two years and under 18 years of age at date of removal.

(5.) When a member of the Naval Forces is compelled to move his station, and to be followed later by his family, the allowance may be increased by the amount allowed for one child up to the sum of £4.

(6.) The rates for removal to and from Thursday Island shall be as follow:—From Brisbane or Sydney as in VI.; from Melbourne, as in VII.; from Adelaide or Hobart, as in VIII.; from Perth, twice that allowed in IV.

(7.) The rate for removal within a metropolitan area shall be one-fourth that in column I; and for removal from or to a country locality within a State, one-half that in column I., exclusive of necessary railway freight, which will be paid by Departmental Voucher in the usual manner. Removal by sea within State shall be as in column I.

(8.) The above commuted allowance includes all packing, cartage, and shipping charges, but not railway freight. In the case of movement by railway only, the commuted allowance will be half that in column I., and rail-freight will be covered by usual voucher. When there are alternative routes, e.g., by rail only, or by sea only, or by sea and rail combined, the cheaper route shall be adopted.

(c) The amounts authorized in (b) will be claimed as a commuted allowance to cover all expenditure in connexion with the removal from one station to another, except railway freight, for which a voucher shall be given in the usual manner. Provided, however, that such commuted allowance shall only be paid in cases when the member is in possession of such household furniture as is ordinarily required for his family. In other cases the commuted allowance shall be such less sum as is approved by the Naval Board.

(d) No responsibility will be incurred by the Department in connexion with removals, and members may receive the full allowance, notwithstanding that they dispose of all or part of their effects before removal, and supply themselves with other articles at the new station.

(e) In very exceptional circumstances where it can be satisfactorily proved that the amount as set out in sub-paragraph (6) above is not sufficient to cover the actual cost of removal of necessary household furniture and effects, the District Naval Officer may recommend for the approval of the Naval Board the payment of an additional amount to wards such actual cost.

(5) Accommodation, Class of.

(6) Claims.

Claims.

(а) The travelling claims of members of the Naval Forces shall be signed or countersigned by the District Naval Officer or Commanding Officer, or by some officer deputed by him for the purpose.

(b) Claims for travelling expenses (including any expenses incurred for conveyance of baggage), and for travelling allowance, shall be prepared in full detail, and in order of occurrence, on the usual voucher form, to be submitted for payment not later than one month after the completion of the journey.

(7) General.

General.

(a) Claims for increased rate of travelling or other allowances consequent on promotion to higher rank shall not be admitted for any period prior to date of gazettal or notification of the promotion.

(b) Officers and others holding temporary or acting rank shall draw the allowances of such rank.

(c) Every care must be taken that the expenditure under the head of travelling allowance is kept down to the lowest possible limit; and Officers in Command are held responsible that the least possible expenditure is incurred by those under their command in the performance of their duties.

(d) No officer shall travel on duty without first obtaining the written instructions of his Commanding Officer, and such Commanding Officer, before issuing such instructions, shall satisfy himself that the travelling is necessary, and shall state the nature of the duty on the written authority. This authority is to be attached to the claim for payment of expenses.

(e) All persons, except members of the Naval Reserve or Senior Cadets, on first taking up appointments within the Commonwealth, must join at their own cost, and no travelling or other expense shall be allowed for themselves, wives, or families.

(f) It is not intended that members of the Naval Reserve shall be granted travelling allowance under these Regulations, except where otherwise provided or in special cases where they are directed to proceed upon some special duty outside their ordinary duties at inspections, parades, drills, or annual training, or unless travelling is involved on account of no resident Officer being available for duty in any District or Sub-district.

(g) Officers and men of the Administrative and Instructional Staff when on duty afloat in connexion with the training of the Naval Reserve, shall draw rations or allowance in lieu at 1s. 2d. per diem, but shall not receive any other allowance.

(h) An officer detailed to temporarily carry out the duties of an appointment other than his own, without receiving any additional salary, which involves absence from his head-quarters for more than seven days, shall draw, after the first period of seven days, a reduced allowance at the rate of £2 10s. per week, such allowance to be in lieu of the scale prescribed for his rank; but in no case shall such allowance be continued for a longer period than two months without the approval of the Naval Board.

(i) Warrant and Petty Officers detailed to carry out duties under similar circumstances, as in (h) shall draw, after the first period of seven days, a reduced allowance at the rate of £1 10s. per week. Such allowance shall not be continued for a longer period than two months without the approval of the Naval Board.

(j) Where an Officer, whilst carrying out duties other than his own, receives additional salary equal to or greater than this reduced allowance, he shall not be entitled to any allowance, but where the salary does not amount to the reduced allowance, he may be paid the difference.

(k) Recruits joining the Permanent Naval Forces in one place to join a ship or Depôt in another place, shall draw travelling allowance, and be provided with accommodation by rail or steamer as prescribed in Regulation 77 (5) (a).

(l) Gratuities to railway porters, stewards, &c., are inadmissible, but porterage outside a railway station will be allowed for journeys with baggage of a bulky nature, or of over 28 lbs. in weight, when cab hire is not charged.

(m) Payment for excess luggage will not be allowed.

(n) In all cases where Naval transport is available, it must be used. Officers and others shall not travel by steamer when railway is available, except with the approval of the Naval Board.

(o) Any case not coming within the above should be submitted to the Naval Board for a special ruling.

Instruction or Duty Abroad.

Instruction or duty abroad.

78. Officers of the Permanent Forces sent abroad for instruction or duty shall be provided with 1st class passages. The passage money may, if so desired, be paid to the Officer direct, to enable him to make his own arrangements, but he must produce in support shipping Companies’ vouchers for the full amount of the passage money.

79. (a) Officers while travelling on board passenger steamer from and to the Commonwealth shall be paid one-fourth of the usual daily rate of travelling allowance prescribed in Regulation No, 77 (1) (a).

(b) While residing in the United Kingdom, and not provided with quarters in a Naval establishment or in one of H.M. ships, lodging allowance according to rank shall be drawn, and also an additional allowance of 7s. 6d. per diem to Officers, and 5s. per diem to Warrant Officers.

(c) On embarkation or disembarkation in Australia, carriage of necessary luggage to and from steamer may be allowed.

DISTRICT ALLOWANCES.

District allowance.

80. District Allowances on the same scale as paid to members of the Commonwealth Public Service, and subject to the conditions prescribed in Public Service Regulations 168 and 169, shall be paid to all members of the Permanent Naval Forces in receipt of consolidated rates of pay, while residing in any district or locality for which a District Allowance has been approved under Public Service Regulations 168 and 169.

80 a. District allowance is payable:—

When payable.

1. Where a member is absent from his district on recreation leave or accumulated recreation leave, whether or not his family remains in the district.

2. Where a member is absent from his district on sick leave with pay and his family remains in the district, provided that where sick leave is granted on reduced pay a corresponding reduction shall be made in the allowance.

3. Where a member is absent on furlough and his family remains in the district, provided that where furlough is granted on half-pay a corresponding reduction shall be made in the allowance.

When not payable.

80 b. District allowance is not payable:—

1. Where a member is absent on sick leave without pay.

2. Where a member is absent on leave without pay.

3. Where stoppage of pay is effected on account of absence without leave or as a result of suspension for misconduct.

Upon transfer.

80 c. Officers transferred:—

1. Where a member is transferred from a non-allowance locality to a district allowance locality the allowance shall not take effect until the member commences duty in the new position.

2. Where a member is transferred from one district-allowance locality to another the allowance payable in the locality to which he is being transferred shall apply from the date the member finally leaves his old district; provided that where a member is granted accumulated leave between the time of leaving the old district and that of commencing duty in the new one and the period of such leave is spent in a non-allowance locality, the Naval Board may direct the withdrawal of allowance for any portion of the period exceeding three weeks.

3. Where a member is transferred from a district-allowance locality to a non-allowance locality the allowance shall cease from the date the member finally leaves his district.

 

PART IX.—ALLOWANCES TO WITNESSES AT COURTS-MARTIAL OR COURTS OF INQUIRY.

Allowances to witnesses.

81. Where required to attend by the President of a court-martial or a court of inquiry under the Naval Defence Act, witnesses may receive remuneration for such attendance at the following rates:—

PART X.—MEDICAL ATTENDANCE—PERMANENT NAVAL FORCES.

Medical Attendance Permanent Forces.

82. (a) Members of the Permanent Naval Forces, including the Administrative and Instructional Staff, shall be entitled to medical attendance in accordance with these Regulations.

(b) Medical attendance includes such supply of medicines as may be ordered by the Medical Officer of the Naval Forces, or an authorized Medical Officer.

83. Officers or men on continuous detached duty—such as the Instructors at North Queensland Ports—will be attended by a Resident Surgeon in local practice at a rate of charge to be approved by the Naval Board, preference being given to Surgeons in the Naval Reserve (M).

84. On the recommendation of the Medical Officer, patients, whether officers or men, provided they reside within a radius of 2 miles from Naval Staff Office, may be treated at their own homes by the Medical Officer of the Forces.

85. Patients residing more than 2 miles from the Naval Staff Office, may, at their own request, and with the approval of the Medical Officer, be treated at their homes, but in such cases the patient will—

(a) provide medical attendance at his own cost;

(b) furnish a medical certificate covering the period of absence, and re-endorsed by the Medical Officer to the Naval Department,

86. District Naval Officers will issue orders to insure—

(a) That any member of Permanent Forces absent through illness is visited by the Medical Officer and reported upon without delay.

(b) That any member of the Permanent Forces unable through illness to return to duty shall report the same to the Commanding Officer on or before the expiration of his leave.

87. Members of the Forces reported as unfit for service will be examined and reported upon by a Medical Board, and on its report dealt with as the Naval Board may decide.

88. Officers or men recommended for Hospital treatment will be made the subject of a special report to the District Naval Officer, whose approval must be obtained.

 

PART XI.—POSTAGE AND TELEGRAMS.

89 (a) The correct amount of postage shall, in all cases, be determined before letters and packets are despatched, and no unnecessary papers are to be sent through the post. The cost of such postage shall be defrayed by means of postage stamps marked “O.S.,” which shall be obtained on purchase from the Deputy Postmaster-General.

(b) Except in very special cases, large files of papers shall not be transmitted through the post. Book or packet post must, as far as possible, be utilized for returns, &c., so as to insure the cheapest rate.

(c) In transmitting correspondence through the post, care should be taken that any documents sent separately as “Commercial papers” or “Packet post” are posted at the same time.

Telegrams.

Telegrams.

90. Telegraphic communications must be limited to messages of urgency on the public service, and recourse shall only be had to telegraphic communication in cases where the delay involved in the transmission of a letter by post would be prejudicial to the public service. Cablegrams shall not be sent to places outside the Commonwealth without authority from the Naval Board.

91. To be admitted as charges against the public, the sums expended must be vouched by copies of the telegrams sent, save in the case of telegrams sent personally by members of the Naval Board or District Naval Officers; and all such copies of telegrams shall be forwarded to the Authorizing Officer when claiming reimbursement for stamps expended. It shall be the duty of the Paymaster to bring under the notice of the District Naval Officer any telegrams which do not appear to be in strict compliance with the Regulations.

(a) The repetition of a message must be obtained as a “paid service message” through the delivering office, and not by means of a fresh message exchanged between sender and receiver.

(b) In the event, however, of any messages being improperly sent as on the public service, or of any messages not being of sufficient urgency or importance, the Officers or others sending them will be called upon to defray the cost.

(c) “O.S.” stamps are not to be used on telegraphic messages relating to leave of absence or private business sent by Officers of the Naval Forces and its departments for the personal convenience of the senders or receivers. The cost of such messages shall not be admissible as a charge against the public.

(d) In the preparation of telegrams all unnecessary wording must be avoided.

92. (a) Accounts shall be kept as per form below, in which the addresses of all letters and telegrams chargeable to the public shall be entered. These accounts shall be examined and audited periodically by the officer responsible for the expenditure, whose signature shall be affixed as a voucher for correctness.

93. Any member absent from duty on the ground of illness must notify his Commanding Officer, and furnish a medical certificate accounting for his absence.

94. District Naval Officers may grant leave of absence, on full pay, on the ground of illness in cases in which such leave does not exceed one month in any one calendar year, provided the conditions and periods laid down in succeeding Regulations are not exceeded.

95. In cases of continued sickness or ill health, the Naval Board may, on production of satisfactory evidence, grant extended leave, not exceeding three months, in accordance with the following schedule:—

96. In exceptional cases the Minister may take any special circumstances into consideration, and may vary the scale of leave, provided that in no case shall the leave granted exceed three months on full pay.

In exceptional cases, special circumstances may be taken into consideration, e.g., where a member in discharge of his duty sustains injuries of such a nature as to incapacitate him for all duty, this scale may be varied; provided that in no case shall full pay be allowed for a period exceeding nine months in addition to leave granted by the Naval Board on full pay.

98 a. No reduction shall be made in deferred pay in respect of sick leave granted on reduced pay.

99. Leave of absence on account of injuries sustained when in the discharge of duty shall be dealt with as prescribed in these Regulations, but such leave shall not be counted as a portion of the leave which may, under these Regulations, be granted to an Officer, Petty Officer, or man, on account of illness.

100. If any member is absent from duty on account of illness, and such absence has extended beyond three months, he shall not be permitted to return to duty unless and until it is certified that he is medically fit to resume work.

101. When extended leave is granted other than on full pay, the rate paid for Sundays and holidays shall be the same as that allowed for the period of leave.

102. No “active” or “deferred” pay shall be granted for leave of absence on account of sickness or ill-health caused by the misconduct of the member.

PART XIII.—SALE OF STORES, ETC.

Sale of Stores, &c.

103. (a) Government stores, except as hereinafter provided, must not he lent, exchanged, or sold without Ministerial approval. To obtain approval for sale a memorandum with a schedule of the articles proposed to be sold, must be forwarded for the consideration of the Minister. Treasury Form 41 must not be used for this purpose.

(b) When a sale has been effected the Accountant Officer must forward a report of the same on Treasury Form 41 direct to the Naval Secretary, for transmission to the Auditor-General.

(c) Obsolete or unserviceable stores, arms, and equipment may be lent, on payment, with the approval of the District Naval Officer.

104. The above procedure shall not apply to the sale of small arm ammunition, rifles, spare parts, oil, flannelette, or materials in connexion with the use of cleaning of small arms, the issues of which are governed by regulation. All that is necessary in these cases is to forward a statement of such sales on Form 41, direct to the Naval Secretary for transmission to the Auditor-General.

 

PART XIV.—ANNUAL PRIZES FOR SHOOTING.

105. Prizes, as provided in King’s Regulations (articles 1160 and 1440) shall be allowed, subject to the conditions prescribed therein.

 

PART XV.—MISCELLANEOUS EXPENDITURE.

Miscellaneous Expenditure.

106. An expenditure not exceeding £10 can be authorized by District Naval Officers on funerals of members of the Permanent Forces.

PART II.—PAY OF PERMANENT FORCES.

Pay of Permanent Forces.

43. All persons appointed to the Permanent Forces will draw pay and allowances from the date on which they commence duty only, and not from any earlier date.

44. In every case where a salary provided for under these Regulations has an annual increment attached to it, such increment will be payable when the member has been in receipt of his then rate of salary for a period of twelve months, unless otherwise provided under Regulation. The right to receive such increment in any year shall depend on the good and diligent conduct of the person to whose salary it is attached, the approval of the Minister, except as provided; in paragraph 4 (f), and on provision being made by Parliament. If in the opinion of the Commandant any Petty Officer or man is not entitled to receive an increment, he may issue an order directing that it shall not be paid.

45. In the case of Officers no increment shall be stopped from their salary or pay save on the authority of the Minister.

46. Officers and others in excess of the authorized number of any rank may be carried on the strength, provided that there are vacancies in higher ranks, and that the total Establishment is not exceeded.

47. Daily rates of pay include payment for Sunday (seven days in the week).

Pay of Petty Officers, Seamen, and others.

The following rates of pay shall apply in the cases of future enlistments, re-engagements, or promotions. The rates of pay previously existing in the several States will continue to be paid to those at present serving, until promoted or re-engaged. Any person promoted will, if in receipt of a higher rate of pay than the minimum of the rank to which promoted, continue to draw such higher rate until, by natural increments in the new rank, he becomes entitled to an increase of pay.

Should any person be receiving a higher rate of pay than that of the rank to which promoted, he will continue, on promotion, to receive such higher rate.

The Special Duty Pay for Instructors will be paid only to those qualified and employed as Instructors, and will be additional to the allowance for Seaman Gunner and Torpedo-man.

The allowance for Seaman Gunner and Torpedo-man, and for Leading Signalman will be paid only to qualified P.O’s., L.S., and A.B.

No one is to draw the allowance both for Leading Signalman and Seaman Gunner and Torpedo-man.

Signalman’s allowance will be paid to A.B. only, but not if other ratings are held.

50 a. GOOD CONDUCT PAY.

Good Conduct Pay may be granted to Leading Seamen, Able Seamen, and Stokers who, on 1st July, 1909, or thereafter, shall have served continuously with good conduct as follows:—
