REGULATIONS UNDER THE DEFENCE ACTS 1903-1904.

I, THE GOVERNOR-GENERAL, in and over the Commonwealth of, Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Acts 1903−1904, to come into operation on the First day of March, 1906.

FINANCIAL AND ALLOWANCE REGULATIONS FOR THE NAVAL FORCES OF THE COMMONWEALTH.

All Financial and Allowance Regulations for the Naval Forces of the Commonwealth heretofore made, whether provisional or otherwise, are hereby repealed.

The black lines in the margin serve to indicate new provisions or amendment of previously existing Regulations.

PART I.

SECTION I.—DEFINITIONS.

1. In the following Regulations:—

“Board” means the Board of Administration for the Naval Forces.
“Director” means the Director of the Naval Forces.
“Secretary” means the Secretary, Department of Defence.
“Finance Member” means the Finance Member of the Board of Administration for the Naval Forces.
“Commandant” means the Officer appointed to command any State Division of the Naval Forces.
“Chief Accountant” means the officer appointed to be Chief Accountant in the office of the Chief Administration.
“Paymaster” means the Officer appointed to be Paymaster or Accountant Officer of any State Division of the Naval Forces.

“Authorizing Officer” means the Officer appointed to be Authorizing Officer for any State Division of the Naval Forces.
“Paying Officer” means the Officer appointed to be Paying Officer for any State Division of the Naval Forces.
“Executive Officer” means an Officer of the Executive Branch of the Forces.
“Division” means the Naval Militia, or Volunteer Force established at any Port.

SECTION II.—INSTRUCTIONS TO COMMANDANTS.

Responsibility of Commandants.

2. Commandants are held responsible for the economical expenditure of all moneys provided in the annual Estimates for their respective commands; and they are further responsible that no liability is incured against Votes in excess of the provision made. It is advisable, therefore, in this connexion that Commandants should, from time to time, personally inspect claims, especially claims for travelling expenses.

3. Every credit will be given to Commandants and other officers concerned for economies effected under the different Votes, and for economical administration consistent with efficiency.

Expenditure that may be authorized by Commandants.

4. Each Commandant is authorized—

(a) To approve of all requisitions for supplies within the Votes on the Estimates, which are governed by regulations.
(b) To approve of any other expenditure (not exceeding £50 in any one case) under the Divisions or Subdivisions of any Votes for Contingencies, General Services, Maintenance of existing Arms and Equipment, provided he has satisfied himself that funds are available; that it is not a new Vote or item or involving any alteration of existing rules or practice; that there-is nothing irregular in the character of the expenditure; and that it is not an allowance or payment to any member of the Forces (except such as is governed by Regulation and does not require Ministerial approval).
(c) To approve of the employment of casual labour (non-clerical) where provision exists on the Estimates for temporary assistance; but no person is to be employed under this authority for any longer time than an aggregate period of six weeks in any financial year.
(d) To approve, under the Regulations governing Compensation for Injuries, of all awards of compensation under paragraph 69, where the award does not exceed payment of compensation for one month, and the medical expenses do not exceed £3 3s.
(e) To approve, after due inquiry, and in accordance with any regulations on the subject, of striking off charge of stores damaged or deficient, provided that the value does not exceed £5.
(f) To approve of increments to Petty Officers and men, where such are prescribed by the Regulations, and provision for which is made by Parliament.

(g) The expenditure under paragraphs (b), (c), (d), and (e) is not to exceed £60 per month without further Ministerial authority.

5. A monthly schedule of expenditure incurred by each Commandant, under the authority in paragraph 4, clauses (b) to (e) inclusive, and not provided for by the Regulations, shall (after being signed by the Commandant) be forwarded for the information of the Finance member not later than the 7th of each month, in the following form:—

6. Commandants are not to vary any payments provided for under Regulations.

7. Proposed expenditure under Votes for Heavy Gun and Small Arm Ammunition; for Warlike Stores; and Estimates of expenditure within the current year’s Estimates for Annual Trainings will be submitted by the Commandant to the Board.

8. When it is necessary to make re-arrangements or transfers in connexion with any Votes, application is to be made through the Secretary.

9. When submitting proposals involving expenditure, Commandants shall—

(a) State if any expense will be involved by approval; and, if so, how much.
(b) State whether such expense is provided for; and, if so, the Division, Subdivision, and item in the Appropriation Act.
(c) Furnish a certificate from the Paymaster that money is available on the vote indicated.

When a recommendation is made that is not provided for in the Appropriation Act, it should invariably be the subject of a separate communication.

10. The Commandant shall, in addition, state that, with his knowledge of the requirements for the remaining period of the financial year, the proposed expenditure shall not involve the necessity for applying for additional funds on any Vote concerned.

11. When grants are provided for in the Estimates, authority to pay them is to be obtained by the Authorizing Officer on the recommendation of the Commandant.

12. Unless by special Ministerial sanction, all payments authorized by these Regulations shall be subject to the necessary provision being made by Parliament.

SECTION III.—PAYMASTERS.—DUTIES AND GENERAL INSTRUCTIONS.

Duties of Paymasters.

The duties of a Paymaster will be as under:—

13. He will be responsible for the disbursement of the public moneys in accordance with the Regulations, and with any instruction or authority issued by the Board.

14. He will be held responsible that no arrear occurs in the work of his office, and that the books are posted up daily, so that they may at all times be ready for examination.

15. He will act as financial adviser to the Commandant upon all questions involving expenditure.

16. He will keep the Commandant informed of all expenditure on Votes, with the view of assisting him to prevent any Vote being exceeded.

17. He will be responsible that all accounts in the Pay Office are kept strictly in accordance with the “Treasury Regulations.”

18. All accounts other than those dealt with under Regulations by other officers shall pass through the office of the Paymaster, who will be responsible that the amount of the appropriation for any Division or Subdivision of the Estimates, or any Loan Appropriation, or Trust Fund Credit, is not exceeded without due authority.

19. He will, in the event of, receiving any claim which appears to him not authorized by Regulations or instructions, or in regard to which there is doubt as to the admissibility of any charge, point out the same in writing to the Commandant. Should the Commandant consider that, on the contrary, such claim is covered by Regulations or authority, and that the charges are admissible, an immediate report as to the circumstances of the case will be made by the Commandant to the Board; and the account shall not be paid without the approval of the Board.

20. He will be responsible that the Commandant is informed, in writing, six months before the event, of the name of any member of the Permanent Forces attaining the age prescribed for compulsory retirement, to enable the Commandant to take such steps as he may deem necessary in the matter. Under no circumstances is amember to be granted pay for any period after the date on which he was, in the ordinary course, due for retirement, unless authority for the extension of his services has first been obtained.

21. He will not apply Public Moneys to any purpose not authorized by the Regulations of the Service, nor will be advance (except as hereinafter provided), lend, or exchange any sums for which he is accountable, nor will be exchange private cheques out of public funds. In the case of members of the Forces travelling on duty, where extended absence is probable, and cash fares, &c., exceeding a total sum of £5, may require to be paid, an advance up to 75 per cent. of the maximum allowance that can be claimed may be made.

22. He will not advance any moneys to amember of another State Division of the Naval Forces, on account of travelling or other expenses, unless authority has first been obtained for so doing from the authorizing officer of the State Division to which the expenditure is to be charged. In the cases of members of the Central Administration, the authority of the Finance Member must be obtained before any such advances are made.

23. He will be liable for the amount of disallowances arising from errors or overissues made by him in disregard of Regulations or in the absence of proper authority.

24. Should difficulty be experienced in recovering money due from officers or others, he will at once represent the circumstances in writing to the Commandant, who will, if necessary, refer the matter to the Board.

25. He will submit to the Commandant all queries of the Auditor-General, or other officer appointed by him, together with the correspondence, if any, involved. In the case of a reply being deemed to be unsatisfactory by the Auditor-General, or his officer, the matter is to be referred, through the Commandant, to the Board.

26. Paymasters will see that a copy of the Audit Act and the Treasury Regulations are supplied to every officer receiving or disbursing Public Moneys, and they will obtain receipts for such supply.

27. Instructions as to Payments.

Instructions as to Payments.

An amount provided on the Appropriation Act as salary for one appointment shall not be utilized for the payment of the salaries or portions thereof of two persons for the same period.

No officer is to be paid the salary of any position to which he has not been appointed by Order in Council.

In no cases, except those governed by Regulations, are any allowances to be paid to any members of the Forces, unless such allowances have been authorized by Order in Council, or by the Board.

Overtime money is not to be paid unless the same has received the approval of the Board.

Salary or wages must not be paid from any Vote for “Contingencies,” or from any Vote other than that of a Salary Vote or a Vote for “General Services,” except with the special approval of the Minister.

In no case should any person be temporarily employed without the approval of the Board, except as provided in para. 4 (c).

Any payment made on account of travelling or other expenses to a member of another State Division of the Naval Forces must be at once communicated to the Paymaster of the State Division to which such member belongs.

In the case of any work being carried out in any State by artificers who are ordinarily employed in another State, the cost of material and labour will be charged to the State for which the work is performed. This will also apply to their travelling expenses.

Claims on account of advertising will, wherever practicable, be submitted to the Government Printer or Advertising Board of the State concerned, for checking, before payment is made.

28.—Transfer of Members of the Forces.

Transfer of Members.

In every case where an officer, warrant or petty officer, or man of any branch of the Naval Forces in one State is transferred to another State, the Paymaster of the State to which the officer, warrant or petty officer, or man is transferred, is to be immediately

advised by the Paymaster of the State from which the transfer takes place of the following particulars:—

Rate of pay.
Details of all allowances; and whether in quarters.
Date to which payment has been drawn.
Date of attestation.
Date of re-engagement.
Date of birth.

Should a Paymaster fail to receive these particulars on the transfer of any officer, warrant or petty officer, or man, it will be his duty to at once communicate with the Paymaster of the State concerned, with a view to obtaining them.

Debiting Cost of Transfers.

Whenever any members of the Forces are transferred from one State to another, the cost of such transfers shall be debited to the States to which they are transferred.

Cheques.—Provision for Signing of.

Cheques.

29. All cheques will be signed by the Paying Officer, or such officer as may be dealing with the advances or credit against which the cheques are drawn, and countersigned by the Authorizing Officer, or such other officer as may, in accordance with the Treasury Regulations, be appointed for the purpose.

30. The names of the countersigning officers, with their specimen signatures, will be forwarded by the Authorizing Officer to the managers of the banks in which the accounts are kept, who will be advised by the Treasury as to the appointment of Paying Officers. See also Section 18 of the Audit Act.

Payments to the Department.

Payments to Departments.

31. All payments to the Department in any State are to be made to the Paymaster; and bank drafts, cheques, post-office orders, or postal notes are to be made payable to the Paymaster, or order.

32. The official receipt given and accepted shall only be that issued by the Receiver of Public Moneys.

SECTION IV.—GENERAL.

34.—Payments to be made by the 30th June.

General Instruction

It is very necessary that the amount of arrears on the 30th June shall be as small as possible, and, with a view of attaining that end, officers are responsible that the following steps be taken:—

(a) Supplies, &c., required to the end of June should be ordered in April or early in May, so that the accounts might be paid in May or early in June; and no orders except such as are absolutely necessary should be given after the middle of May.
(b) The requisitions for repairs and similar works should be sent in as early as possible, and the works should, wherever practicable, be completed early in May.

(c) Where accounts outstanding are likely to be of considerable amount, the persons interested should be requested to furnish the accounts promptly. A memorandum to that effect could be written across the orders when given.
(d) Accounts for amounts due to the Government Printer, Railways, &c., should be specially asked for.
(e) In the case of monthly or quarterly payments, where the amount due on the 30th June can be ascertained, claimants should be asked to render their claims early in June, so that they may be paid before the 30th. Where the amount due cannot be ascertained before the end of June, the claimants should be asked to render accounts up to the middle of June only, the balance to be included in the next account.
(f) Accounts for services, such as rents and similar matters, should be paid about the middle of June, up to the end of that month.
(g) With regard to the pay and allowances of the Forces, such arrangements should be made as will enable all payments due for the financial year to be made prior to the 30th June.

Rates or Taxes.

35. In all cases where premises are rented or leased for departmental purposes no provision is to be included in the agreement or lease by which the Commonwealth Government is required to pay any taxes or water rates.

Unless special approval to the contrary be obtained, where water is supplied, meters must be provided, so that payment may only be made for the quantity actually consumed. Accounts in connexion with such supplies should show that the charges are for services rendered, i.e., water supplied, claims for “water rates” not being admissible.

36. The Minister will determine what offices held by Officers, Warrant and Petty Officers, and others shall be guaranteed, and shall fix the amount of such guarantee which, for the Militia and Volunteer Forces, shall be in accordance with the following table:—

37. Every Officer, Warrant and Petty Officer, holding a permanent position in the Naval Forces, which is aguaranteed office under these Regulations, shall contribute to the Guarantee Fund established by, and in accordance with, clause 70 of the Public Service Regulations, paragraphs a, b, c, h, i, j, k, l, q, s, t, and u.

38. In cases where an executive officer may be called upon to perform the duties of a guaranteed office which are apart from his regular duties, the Minister may sanction the payment of the premium out of the Vote for Incidentals.

39. Every Officer, Warrant and Petty Officer, holding a position in the Militia or Volunteer Forces which is a guaranteed office under these Regulations, shall contribute to the Guarantee Fund established by, and in accordance with, clause 70 of the Public Service Regulations, paragraphs a, b, c, h, i (except as provided in paragraph 42 of these Regulations), j, s, t, and u.

40. The premiums payable under paragraph 39 of these Regulations shall be a charge against the vote for Incidentals of the Division in respect of which the guaranteed offices are held, and such premiums shall be paid to the Paymasters of the respective States. The Paymaster will be held responsible for the collection of such premiums, and that the moneys so collected are paid to the Trust Fund to the credit of the Guarantee Fund Account.

41. Where the term “officer” is used in the Public Service Regulation referred to in these Regulations, it shall be held to include “Officer, Warrant and Petty Officer, or other person in the Naval Forces.”

42. The term of the guarantees under these Regulations shall date from 1st July, 1903. In the case of those under paragraph 37, the first annual premiums shall be deducted from the salaries of the persons holding the guaranteed offices for the month of July, and in the case of those under paragraph 39, the annual premiums shall be paid not later than the 15th August.

PART II.—PAY OF PERMANENT FORCES.

Pay of Permanent Forces.

43. All persons appointed to the Permanent Forces will draw pay and allowances from the date on which they commence duty only, and not from any earlier date.

44. In every case where a salary provided for under these Regulations has an annual increment attached to it, such increment will be payable when the member has been in receipt of his then rate of salary for a period of twelve months, unless otherwise provided under Regulation. The right to receive such increment in any year shall depend on the good and diligent conduct of the person to whose salary it is attached, the approval of the Minister, except as provided in paragraph 4 (f), and on provision being made by Parliament. If, in the opinion of the Commandant, any Petty Officer or man is not entitled to receive an increment, he may issue an order directing that it shall not be paid.

45. In the case of Officers no increment shall be stopped from their salary or pay save on the authority of the Minister.

46. Officers and others in excess of the authorized number of any rank may be carried on the strength, provided that there are vacancies in higher ranks, and that the total Establishment is not exceeded.

47. Daily rates of pay include payment for Sunday (seven days in the week).

Pay of Petty officers, seamen and others.

The following rates of pay shall apply in the cases of future enlistments, re-engagements, or promotions. The rates of pay previously existing in the several States will continue to be paid to those at present serving, until promoted or re-engaged. Any person promoted will, if in receipt of a higher rate of pay than the minimum of the rank to which promoted, continue to draw such higher rate until, by natural increments in the new rank, he becomes entitled to an increase of pay.

Should any person be receiving a higher rate of pay than that of the rank to which promoted, he will continue, on promotion, to receive such higher rate.

49A. Rations.

Rations.

In addition to their pay, rations will be drawn for officers, petty officers, seamen, and others in accordance with authorized scale when on duty on board ship or in Naval Depot; but in cases in which, from the exigencies of the service, rations in kind are not issued, these members of the Permanent Force may be paid compensation in lieu of same at such a rate not exceeding the annual contract rate for rations as the Minister may decide.

Rations will not be drawn after twenty-four hours’ absence of any member of the Force from duty except that, if a member be absent on leave or during sickness, compensation in lieu of the same at the authorized rate may be paid.

Commandants will issue orders to ensure the supply of rations at standard quality. Commanding Officers may order a survey on all rations complained of as being below standard quality, and the rations returned or destroyed shall be reissued, according to the report of the surveyors.

The Special Duty Pay for Instructors will be paid only to those qualified and employed as Instructors.

The allowance for Seaman Gunner and Torpedo-man, and for Leading Signalman will be paid only to qualified P.Os., L.S., and A.B.

No one is to draw the allowance both for Leading Signalman and Seaman Gunner and Torpedo-man.

Signalman’s allowance will be paid to A.B. only, but not if other ratings are held.

PART III.—PAY OF THE NAVAL MILITIA.

Half days will be paid for at one half, and night drills at one quarter, of above rates.

52. The twenty-one days’ training per annum may be performed as follows:—

Class A.—Twenty-one days’ training, eighteen of which must be in periods of not less than six days’ continuous, training afloat.

Class B.—Six days’ continuous training afloat, with seven full or fourteen half days afloat, and 32 night drills; or, when ships are available, nine days’ training afloat consisting of one period of four days’ continuous training afloat (under steam for stokers), and two periods each of two and a half days’ continuous training afloat (under steam for stokers), with twelve half-days afloat and twenty-four night drills.

At the discretion of the Commandant, additional training under steam may be carried out in lieu of half days or night drills.

53. Continuous training afloat will be paid for at the completion of each period under Class A, and of the six days’ period under Class B.

Members of the Militia Forces who elect to perform their training in Class B will be paid quarterly for their drills other than the six days’ continuous training, and to enable the full pay for each quarter to be earned, not less than the following drills must be performed:—

Drills omitted in any one quarter may be performed and paid for in any succeeding quarter.

Day drills may be performed in lieu of night drills, but in no case can night drills be performed in lieu of day drills.

Where no provision exists for members of the Forces carrying out the training afloat, the 21 days’ drill will be performed in such whole day, half day, and night drills or parades as may be authorized by the Board.

Pay will be issued to Commanding Officers and Staff on the certificate of the Commandant that they have performed the necessary duties during the period for which it is claimed.

54. All members of the Militia will be required, in addition to the above drills and training, to attend one Review or General Inspection in the year when ordered on a public holiday.

Any member failing to comply with this Regulation will be liable to a fine of twenty shillings, unless he is able to satisfy the Commandant that he was prevented by sickness or other reasonable cause, or on account of his occupation, from attending such Review or General Inspection.

55. Retainer.—The retainer will be paid in accordance with the following conditions:—

Class A.—The full retainer will be paid on completion of the 21 days’ training, or a proportion of the retainer may be paid on completion of any one of the periods of continuous training.
Class B.—Half the annual retainer will be paid
(a) on completion of the six days’ continuous training, or
(b) at the end of the quarter in which the four days’ training is performed, provided the number of half-day and night drills as laid down in Regulation 53 have been attended.

The balance of the retainer will be paid in three equal instalments at the end of each of the other three quarters, provided the number of half-days and night drills as laid down in Regulation 53 have been attended.

In the case of a less number of drills being performed than the minimum required in any quarter, payment of the retainer for such quarter will be held over, but the same may be paid at the end of any succeeding quarter, within the financial year provided that the number of drills so deficient has since been made up.

56. (a) In the event of the death of a member of the Militia, the balance of any retainer or pay which may be due to him will be paid to his legal representative or such member of his family as the Minister may direct.

(b) In the case of any member of the Militia being discharged he may, if such discharge be not due to misconduct or to an offence under the Defence Acts and Regulations committed by him, be paid for the drills he has performed, and also be granted the proportion of the retainer represented by the number of such drills.

57. The minimum duration of drills will be—

58. Midshipmen at present serving will, pending retirement or absorption, receive pay and retainer as under:—

Pay at the rate of 5s. 6d. per diem.
Annual retainer, £3 14s. 6d.

59. A Paymaster will be allowed to the Naval Militia where no other provision exists for a Paymaster, and he may receive a special rate of pay approved by the Minister, in accordance with the provision on the Estimates.

60. The Officer in Command of the Naval Militia at Sydney, whilst performing the duties of Officer in Command of the State Division of the Naval Forces, may receive a special rate of pay, approved by the Minister, in accordance with the provision on the Estimates.

61. All members of the Naval Militia whilst undergoing continuous training, or afloat for a whole day’s drill, will receive rations according to the scale laid down for the Permanent Force.

62. Attendance at a Guard of Honour will count as a half day, and will be paid for over and above the 21 days laid down in Regulation 51. Should officers and men, however, parade for aGuard of Honour or a salute before noon, they may count a whole day if they perform two hours’ regular drill on that day.

63. Attendance at funerals or church musters will not be allowed to count for pay and retainer.

64. Commandants may order classes to be formed for additional instruction of the Naval Militia provided the amount voted for this purpose on the Estimates be not exceeded.

65. To members who complete the musketry course, two half days will be counted for pay and retainer.

66. Pay of Medical Officers.—Medical Officers of the Naval Militia will receive pay as follows:—

(a) For examination of recruits, 2s. 6d. a head.
(b) For other duties—

Surgeons,	£ 2 for whole day.
,,	£ 1 for half-day.
,,	Boards, £ 1.
,,	Medical surveys, £ 1.

The maximum amount of pay, however, derivable from the various sources shall not exceed in one year the total amount of pay for executive officer of corresponding rank.

PART IV.—COMPENSATION FOR INJURIES RECEIVED OR DISEASE CONTRACTED ON DUTY—PERMANENT FORCES.

Compensation for injuries received or disease contracted on duty—Permanent Forces.

67. Compensation may be recommended by a Board appointed to inquire into the case of any member of the Permanent Forces who is retired or discharged on account of wounds or injuries received, or disease contracted on duty, if the wound, injury, or disease was not due to the member’s default. The compensation shall be according to the following scale:—

(a) The maximum amount.
(b) Three-quarters of the maximum amount.
(c) One-half of the maximum amount.
(d) One-quarter of the maximum amount.

The maximum amount shall be a sum equivalent to three years’ pay, including any allowances for quarters or rations at the rate the member received or was allowed immediately prior to his retirement or discharge. The maximum amount shall only be awarded in case of total disability to earn a livelihood. In case of partial disability, the compensation shall be less than the maximum amount, and shall be fixed in accordance with the scale, and so that the amount awarded shall be proportionate to the degree of disability of the member.

68. Compensation may be recommended by a Board appointed to inquire into the case, to the widow and family of any member of the Permanent Forces who is killed when on duty, or dies of any disease contracted on duty, if the death or disease was not due to the member’s default. The amount of compensation awarded shall not exceed three years’ pay, including allowances for quarters or rations at the rate the member received or was allowed immediately prior to his death. No claim for compensation shall be considered unless it is made within twelve months after the death of the member.

PART V.—COMPENSATION FOR INJURIES RECEIVED OR DISEASE CONTRACTED ON DUTY—MILITIA AND VOLUNTEER FORCES.

Compensation for injuries received or disease contracted on duty—Militia and Volunteer Forces.

69. Sums not exceeding 10s. per diem to an Officer, and 5s. per diem to a Warrant Officer, Petty Officer or Man of the Militia, or the Volunteer Naval Forces, may be recommended for payment, for a period not exceeding six months, out of any moneys which

may be voted by Parliament for that purpose, to compensate for loss of salary or wages such Officers, Warrant Officers, Petty Officers or Men who may be injured in the performance of their duty, and temporarily incapacitated from resuming their calling or trade in consequence of such injury. Full particulars as to any injury must be communicated to the Commandant within forty-eight (48) hours after its occurrence, otherwise claims will not be considered; and the Commandant shall thereupon direct a Medical Officer to report on the case. Wherever possible, a Court of Inquiry shall be assembled to inquire into the circumstances of each case, and submit its recommendation to the Commandant. The compensation shall be limited to the period during which the member shall be shown to have been wholly unable to follow his occupation, and shall not be issuable for the day of the accident, or for any period during which he shall have been paid.

Compensation will not be allowed to a member in respect of any injury sustained by him whilst proceeding to the place of assembly, or whilst returning home after the dismissal of the Division from duty.

70. If in the opinion of the Medical Officer attending the individual, the injury is of a permanent nature, a report will be forwarded to the Commandant, who will convene a Medical Board to inquire into the case, which may recommend an amount of compensation, if any, in accordance with the following scale.

Compensation for permanent disability to earn a livelihood may be recommended at the rate of 7s. per day.

Permanent disability will be classified as follows:—

One-quarter disablement.
One-half disablement.
Three-quarters disablement.
Total disablement.

The maximum grant for total disability will not exceed three years’ compensation at the rate of 7s. per day.

71. Application for the issue of the compensation, except as provided in para. 4 (d), shall be forwarded for the consideration of the Naval Board, and must be supported by the following documents:—

(a) The proceedings of the Court of Inquiry or Medical Board, if any, which reported on the case, or, if no Court of Inquiry or Medical Board was assembled, a statement setting forth in detail the circumstances under which the injury was sustained.
(b) A certificate showing the period during which the member was unable to follow his calling or trade. When, however, the injury is of so severe a nature as to incapacitate the member from following his employment for a period exceeding two months, a medical certificate showing the state of the case must be forwarded to the Commandant at intervals of one month.
(c) A certificate from the employer of the member showing the member’s average weekly earnings, and that his pay has been stopped during the period for which compensation is claimed.
(d) A report from the Medical Officer who attended the individual or examined him.
(e) A statement of all medical expenses that are recommended to be defrayed by the Government.

72. It shall be the duty of the Principal Medical Officer of the State Division concerned to report upon each case submitted as above.

Compensation to widows and children.

73. Compensation may be recommended by a Board appointed to inquire into the case, to the widow and children of any member of the Militia or Volunteer Forces who is killed when on duty, or dies of any injury received or disease contracted on duty, if the death, injury, or disease was not due to the member’s default.

The compensation shall, unless there are special circumstances which, in the opinion of the Naval Board, justify payment of the compensation in one sum, be in the form of an allowance of £5 a month for a widow, and of 10s. each per month for all children until they attain the age of fifteen years; provided, however, that such allowances shall cease three years after the death of the member, or in the event of the widow marrying again.

In instances where these Regulations do not meet the circumstances of individual cases, they may be specially considered and dealt with by the Governor-General.

No claim for compensation shall be considered unless made within twelve months after the death of the member.

PART VI.—ALLOWANCES.

74. Claims for increased rate of travelling or other allowances consequent on promotion to higher rank will not be admitted prior to the date of gazettal or notification of the promotion.

SECTION I.—TRAVELLING ALLOWANCES.

75. The following are the rates of Travelling Allowances to be drawn by members of the Naval Forces when travelling on duty:—

(a) The above rates of Travelling Allowance are exclusive of any cost of conveyance by land or water; and in computing the period the time will be counted from the time of departure by train, coach, or steamer to the time of return by same.

(b) When members travel by steamer or other vessel in which the fare paid includes subsistence, one quarter of the ordinary rates to which such officers would be otherwise entitled shall be allowed.

(c) Members travelling beyond the limits of the State in which they are ordinarily employed shall receive an increase of one-fifth on the scale rates. Provided that this Regulation shall not apply to those employed at stations on or near the border of the State, or to members proceeding outside the Commonwealth.

(d) Where it is proved to the satisfaction of the Minister that the travelling expenses a member would be entitled to draw under these regulations do not as a rule cover his actual expenses, the Minister may authorize a payment in addition to that set forth in the foregoing Schedule of Allowances.

(e) The Minister may reduce the rates of Travelling Allowances under the scale, when circumstances appear to justify such a course.

(f) When a journey is commenced and completed on the same day, and the member proceeds to a place not less than 15 miles from his station he will be allowed necessary expenses for meals only, which must not exceed the following rates:—

In cases where the places visited are less than 15 miles distant, no allowance for meals will be granted unless under exceptional circumstances (a statement of which should accompany the claim), and on the approval of the Commandant.

A morning meal will only be granted if leaving before 7 a.m., and an evening meal if returning after 7 p.m.

(g) Warrant Officers, Petty Officers, and men, where practicable, will be provided with rations and quarters in lieu of the Travelling Allowances, and any mess charges will be allowed them.

2. Cab Hire.

Cab Hire.

(a) Cab hire is allowed to Officers when necessarily travelling with baggage, but not for the conveyance of changes of uniform or plain clothes when proceeding and returning the same day, unless in very exceptional cases, which shall be specially submitted.

(b) Carriage and cab hire will not be allowed when railway or other ordinary public conveyance is available. Claims for carriage and cab hire must be supported by a statement showing the necessity for using carriages or cabs, also the places from and to, and distance travelled.

(c) Cab hire will not be admissible for distances of less than two (2) miles, unless baggage of a bulky nature or of over 28 lbs. weight is necessarily taken, or unless such conveyance is required for necessary saving of time apart from all circumstances under the Officer’s own control. A full explanation of the circumstances must accompany each claim, and the distance travelled, together with the places from and to, must in every case be shown.

(d) Cab hire may be allowed to Warrant or Petty Officers when travelling with baggage, if no cheaper mode of conveyance is available.

(e) When cab hire is claimed for more than 5s., receipt for such payment must accompany claim. Claims for cab hire at rates in excess of the legal fares are not admissible.

(f) When an Officer, Warrant Officer, or Petty Officer proceeds on duty by rail, cab hire from his quarters or house to railway station will not he allowed for any distance the charge for which exceeds 5s.

(g) When two or more Officers, or two or more Warrant or Petty Officers, proceed from one quarter on the same duty, a separate cab will not be allowed for each, unless it be shown that it was impracticable for the Officers, Warrant Officers, and Petty Officers, to perform their journey together.

(h) Claims for cab or carriage hire will not be admissible in connexion with attendance at levees or reviews, or other ceremonials, or the paying of official calls, or on any occasion of a similar nature.

3. Transfers and Removals.

Transfers and removals.

(a) When Officers, Warrant Officers, Petty Officers, or men are transferred from one station to another, the actual cost of conveyance of such Officers, Warrant Officers, Petty Officers, or men, as well as that of their wives and children, will be paid by the Department, except where the transfers are made by way of punishment or at their own request. The cost of conveyance when defrayed by the Department, will not include the cost of meals en route, except when travelling by steamer, in which case the provision of meals is included in the passage money.

(b) Claims may also be submitted for payment of the actual cost of removal of furniture in accordance with the following scale

Scale.

The maximum amounts for removal of furniture shall be as under:—

(d) Vouchers must be produced for all payments.

(e) A member of the Forces shall not be entitled to any compensation from the Government for losses or damage arising from removal.

(f) Where exceptional circumstances can be shown to exist, a reasonable amount in excess of the maximum under these Regulations may be authorized by the Minister.

(g) Before removal is undertaken the member concerned shall, where practicable, obtain offers from at least two carriers, and submit to the Commandant, who shall authorize the acceptance of the more suitable, provided that the maximum amount under these Regulations is not exceeded.

(h) In all cases where Naval transport is available it must be used.

4. Accommodation, Class of.

(a) The following table shows the classes of accommodation by rail and sea:—

5. Claims.

Claims.

(a) The travelling claims of members of the Naval Forces shall be signed or countersigned by the Commandant of the State Division of the Naval Forces concerned or by some officer deputed by him for the purpose.

(b) Claims for travelling expenses (including any expenses incurred for conveyance of baggage), and for travelling allowance shall be prepared in full detail, and in order of occurrence, on the usual voucher form, to be submitted for payment not later than one month after the completion of the journey; but in the case of the last month of the financial year, claims must be rendered to the Paymaster not later than the 20th of that month.

6. General.

General

(a) Every care must be taken that the expenditure under the head of travelling allowance is kept down to the lowest possible limit; and Commandants are held responsible that the least possible expenditure is entailed by those under their command in the performance of their duties.

(b) No Officer shall proceed on any duty without first informing his Commanding Officer, and such Commanding Officer, before granting permission, shall satisfy himself that the travelling is necessary. If, through the exigency of the service, the permission of the Commanding Officer could not be obtained, such should be at once reported in writing or verbally, if the Officer travelling returns within twenty-four (24) hours.

(c) All persons, on first taking up appointments within the Commonwealth, must join at their own cost. No travelling or other expense will be allowed for themselves, wives, or families. A special agreement may, however, be made by authority of the Minister, if the person joining comes from outside the Commonwealth, or in cases of persons proceeding from one State to another.

(d) It is not intended that Members of the Militia, or the Volunteer Forces, shall be granted travelling allowance under these Regulations, except in special cases where the travelling is necessary for the duties of their command, or where they are directed to proceed upon some special duty, outside their attendance at ordinary parades, drills, or annual trainings, or unless travelling is involved on account of no resident Officer being available for duty with any division.

(e) An Officer detailed to temporarily carry out the duties of an appointment (other than his own), without receiving any additional, salary, which involves absence from his head-quarters for more than seven days, shall draw, after the first period of seven days, a reduced allowance at the rate of £2 10s. per week, such allowance to be in lieu of the scale prescribed for his rank; but in no case shall such allowance be continued for a longer period than two months.

Warrant and Petty Officers detailed to cary out duties under similar circumstances shall draw, after the first period of seven days, a reduced allowance at the rate of £1 10s. per week. Such allowance shall not be continued for a longer period than two months.

Where an Officer, whilst carrying out duties other than his own, receives additional salary equal to or greater than this reduced allowance, he shall not be entitled to any allowance, but where the salary does not amount to the reduced allowance, he may be paid the difference.

(f) Gratuities to railway porters, ships’ stewards, &c., are inadmissible, but porterage outside a railway station will be allowed for journeys with baggage of a bulky nature, or of over 28 lbs. in weight, when cab hire is not charged. Booking or cloak-room fees are only allowed when cab-hire otherwise admissible is thereby saved.

(g) Excess luggage will not be paid for by the Department.

(h) Any case not coming within the above should be submitted for a special ruling.

SECTION II.—ALLOWANCES TO WITNESSES AT COURTS-MARTIAL OR COURTS OF INQUIRY.

Allowances to witnesses.

76. Where required to attend by the President of a court-martial or a court of inquiry under the Defence Acts, witnesses may receive remuneration for such attendance at the following rates:—

SECTION III.—SUNDRY ALLOWANCES—PERMANENT FORCES.

Sundry allowances.

77. An allowance shall be granted to cover wear and tear of clothing during service in Torpedo boats (or launches) when such period of service exceeds 24 hours’ absence from ship or base at the following rates, viz.:—

78. Coaling duck will be issued annually to all ratings below Warrant Officer actually employed coaling, cleaning, scraping double bottom, or painting in dock, at the rate of seven yards per man, double-width.

PART VII.—MISCELLANEOUS EXPENDITURE.

Miscellaneous Expenditure.

79. An expenditure not exceeding £10 can be authorized by Commandants on funerals of members of the Permanent Forces.

80. Tea money, at the following rates, may, on the approval of the Commandant, be paid to Clerks (not rationed) who are required to attend after ordinary hours and who work for at least two hours after the usual office hours:—

PART VIII.—POSTAGE AND TELEGRAMS.

81.—Postage.

Postage.

The amount of postage will, in all cases, be ascertained before letters and packets are despatched, and no unnecessary papers are to be sent through the post. The cost of such postage in the case of letters and packets sent by book or parcel post will be defrayed by means of postage stamps marked “O.S.,” which Paymasters will obtain by requisition on the State Deputy Postmaster-General, and issue, in such quantities as the Commandant may determine, to heads of Departments and Officers Commanding Divisions, not provided with capitation, clothing, or effective allowances.

Officers Commanding Militia or Volunteer Divisions receiving funds for capitation, clothing, or effective allowances will purchase stamps for their commands locally, the cost thereof to be debited to such funds.

Except in very special cases, large files of papers are not to be transmitted through the post. Book or packet post must, as far as possible, be utilized for returns, &c., so as to insure the cheapest rate.

In transmitting correspondence through the post, care should be taken that any documents sent separately as “Commercial papers” or “Packet post” are posted at the same time.

82.—Telegrams.

Telegrams.

Telegraphic communications will be limited to messages on the public service of urgent necessity, and recourse will be had to telegraphic communication in cases only where the delay involved in the transmission of a letter by post would be prejudicial to the public service. Cablegrams are not to be sent to places outside the Commonwealth without authority from the Board.

A telegraphic message sent on the public service will have attached to the form on which it is made out the necessary stamps of the proper value in the same manner as if the message were a private one. The sums so expended, to be admitted as a charge

against the public, must be vouched by copies of the telegram sent, and all such copies of telegrams will be forwarded to the Authorizing Officer when claiming reimbursement for stamps expended. It will be the duty of the Paymaster to bring under the notice of the Commandant any telegrams which do not appear to be in strict compliance with the Regulations.

(a) The repetition of a message must be obtained as a “paid service message” through the delivering office, and not by means of a fresh message exchanged between sender and receiver.
(b) In the event, however, of any messages being improperly sent as on the public service, or of any messages not being of sufficient urgency or importance, the Officers or others sending them will be called upon to defray the cost.
(c) “O.S.” stamps are not to be used on telegraphic messages relating to leave of absence or private business sent by Officers of the Naval Forces and its departments for the personal convenience of the senders or receivers. The cost of such messages will not be admissible as a charge against the public.

83.—Accounts.

Accounts.

Accounts will be kept as per form below, in which the addresses of all letters and telegrams chargeable to the public will be entered. These accounts will be examined daily by the officers responsible for the expenditure, whose signatures will be affixed as a voucher for its correctness, and will be subject to audit.

PART IX.—LEAVE OF ABSENCE ON GROUND OF ILLNESS.—PERMANENT FORCES.

Leave of absence on ground of illness.

84. Any member absent from duty on the ground of illness must notify the Commanding Officer, and on return to duty produce a medical certificate accounting for absence.

85. The Board, in cases of sickness or ill health beyond twenty-one days, may, when recommended by the Commandant, and on production of satisfactory evidence, grant extended leave, not exceeding three months, in accordance with the following schedule:—

In exceptional cases the Board may take any special circumstances into consideration, and may vary the scale of payments; provided that in no case shall the leave granted exceed three months on full pay.

86. Where in cases of illness any member who has received leave of absence for three months is not so far recovered as to be able to resume his duties, further extensions of leave may be granted, with the approval of the Governor-General, in accordance with the following schedule; provided that on each extension of leave the applicant shall be subjected to medical examination:—

In exceptional cases, special circumstances may be taken into consideration, e.g. where a member in discharge of his duty sustains injuries of such a nature as to incapacitate him for all duty this scale may be varied; provided that in no case shall full pay be allowed for a period exceeding nine months in addition to leave granted by the Board on full pay.

87. If any member is absent from duty on account of illness, and such absence has extended beyond three months, he shall not be permitted to return to duty unless and until it is certified that he is medically fit to resume work.

88. When extended leave is granted other than on full pay, the rate paid for Sundays and holidays shall be the same as that allowed for the period of leave.

89. No leave on account of illness shall be granted with pay if the sickness or ill-health has been caused by the misconduct of the member.

PART X.—SALE OF STORES, ETC.

Sale of Stores, &c.

90. Government stores, except as hereinafter provided, must not be lent, exchanged, or sold without Ministerial approval. To obtain approval for sale a memorandum with a schedule of the articles proposed to be sold, will be forwarded through the Commandant for the approval, of the Minister.

Form 41 should not be used for this purpose.

When a sale has been effected the Paymaster will forward a report of the same on Form 41 direct to the Secretary, for transmission to the Auditor-General.

Obsolete or unserviceable stores, arms, and equipment may be lent, on payment, with the approval of the Commandant.

91. The above procedure will not apply to the sale of small arm ammunition, rifles, spare parts, oil, flannelette, or materials in connexion with the use or cleaning of small arms, the issues of which are governed by regulation. All that is necessary in these cases is to forward a statement of such sales on Form 41, direct to the Secretary for transmission to the Auditor-General.

PART XI.—MEDICAL ATTENDANCE—PERMANENT NAVAL FORCES.

Medical Attendance Permanent Forces.

92. Members of the Permanent Naval Forces will be entitled to medical attendance in accordance with these Regulations.

Medical attendance will include such supply of medicines as may be ordered by the Medical Officer of the Naval Forces, or an authorized Medical Officer.

Officers or men on continuous detached duty—such as the Instructors at North Queensland Ports—will be attended by a Resident Surgeon in local practice at a rate of charge to be approved by the Board, preference being given to Surgeons in the Naval Militia.

93. Members of the Naval Militia or Volunteers injured on duty will be entitled to medical atendance as prescribed in Part V. Financial and Allowance Regulations.

94. On the recommendation of the Medical Officer, patients, whether officers or men, provided they reside within a radius of two miles from Naval Staff Office, may be treated at their own homes by the Medical Officer of the Force.

Patients residing more than two miles from the Naval Staff Office may, at their own request, and with the approval of the Medical officer, be treated at their homes, but in such cases the patient will—

(a) provide medical attendance at his own cost;
(b) furnish a medical certificate covering the period of absence, and re-indorsed by the Medical Officer to the Naval Department.

95. The Commandants will issue orders to insure—

(a.) That any member of the Permanent Force absent through illness is visited by the Medical Officer and reported upon without delay.
(b) That any member of the Permanent Force unable through illness to return to duty shall report the same to the Commanding Officer on or before the expiration of his leave.

96. Members of the Force reported as unfit for service will be examined and reported upon by a Medical Board, and on its report dealt with as the Board may decide.

97. Officers or men recommended for Hospital treatment will be made the subject of a special report to the Commandant, whose approval must be obtained; and all expenses incurred in Hospital will be charged to the Vote for Incidentals.

PART XII.—PRIZES FOR GOOD SHOOTING.

Heavy, Q.F. and Machine Gun.

Prizes for good shooting.

98. (a) In Heavy, Q.F. and Machine Gun shooting, the best shot in each ship’s company or division shall receive 7s. 6d.

In prize firing, the prize gun’s crew shall receive 7s. 6d. per man. First-class shots shall receive 5s. prizes, according to their order of merit, so far as the balance of funds will allow. The highest prize possible under the above will be £ 1.

Musketry.

(b) The prizes shall be as follows:—

The two highest scores in each ship’s company or division ................................................................	10s. each.

No prize will be paid unless the man is a marksman.
