PROVISIONAL REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910‑11.

I, THE GOVERNOR‑GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby certify that, on account of urgency, the following Regulations under the Naval Defence Act 1910‑11 should come into immediate operation, and further, should be taken to have come into operation on the 1st day of October, 1912, and make the Regulations to come into operation accordingly as Provisional Regulations.

Cancel Regulation 43 (III.) and substitute the following :—

Clothing Gratuity and Allowance towards Cost of Uniform.

43. (III.) Each man and boy on first joining the Permanent Naval Forces shall be credited with a clothing gratuity of £9 2s. 6d. in kind.

After completion of first twelve months' service, an allowance towards cost of uniform at the rate of 6d. per day in kind shall be credited in arrear on the last day of the quarter to each rating.

Clothing gratuity or allowance towards cost of uniform shall not be paid to the individual man or boy, except as hereafter provided, but shall be used in payment of uniform clothing issued to each individual, the cost of which shall be charged against the gratuity or allowance.

The kit to be maintained by each man or boy shall be that laid down in the Uniform Regulations. Any clothing required by a man or boy in addition to that paid for as above shall be provided at his own expense.

In the case of a rating discharged to shore or to the Administrative and Instructional Staff within one year of first entry, the value of clothing issued under the gratuity in excess of an amount of 6d. per day for the actual period of his service shall be deducted from deferred pay due to him. If the deferred pay due is insufficient to cover this charge, the balance of the amount shall remain as a charge against the gratuity.

On promotion to warrant rank, a rating shall be paid in cash any balance standing to his credit in the clothing account.

Regulation 43 (v.).

Add at end of Regulation :—

Charge of Mess Traps

Allowances in accordance with the following scale, under such conditions as may be prescribed by the Naval Board, will be paid for the care of the Mesa Traps supplied to Flag Officers and Commanding Officers of Ships, and to Ward Room, Gun Room, and Warrant Officers' Messes.

Regulation 44 (d).

Add after the word " pay " :—

" Provided, however, in the case of men, that Deferred Pay for each completed term of engagement or re‑engagement shall not be subject to forfeiture."

 

Add new Regulation 44 (f) :—

" (f) Men entered or re‑engaged on and after 1st January, 1913, shall not be entitled on discharge to draw Deferred Pay until the expiration of the period of time for which they engaged or re‑engaged to serve. Provided that Deferred Pay credited for any engagement commenced prior to 1st January, 1913, shall be payable on the termination of such engagement, or, where discharge takes place prior to the termination of such engagement, on the discharge of the rating concerned."

Cancel Regulation 46 (h).

Add new Regulation 67a :—

Naval Reserve Chaplains.

67a. Allowances as under for Religious Ministrations to Seamen will be paid to persons appointed as Naval Reserve Chaplains :—

(1) In the case of occasional ministrations, e.g.,at ports which are not regularly visited by a ship or squadron, at the rate of 6d. per head per service of those actually attending the services.

(2) At ports where ships are more or less permanently stationed, and the duties performed include visitation of the crews and the sick in hospital in addition to the conduct of Divine Service, at the rate of 26s. per head per annum based on the average number, taken quarterly, of Officers and Men of the particular denomination present at the port on each Sunday morning during the period the ministrations are given. The numbers shall be communicated by the Senior Officer to the Chaplain on his requisition.

Where it is necessary for the Chaplain to hold a special separate service exclusively for the benefit of seamen, an allowance of £1 for each such service may be paid in addition to the Capitation Allowance.

Payment of these allowances will be subject to such conditions as may be prescribed by the Naval Board.
