PROVISIONAL REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910–11.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby certify that, on account of urgency, the following Regulations under the Naval Defence Act 1910–11, should come into immediate operation, and further, should be taken to have come into operation on the 1st day of July, 1912, and make the Regulations to come into operation accordingly as Provisional Regulations.

43. (III.) A. In lieu of Clothing Gratuity or allowance towards cost of uniform being credited to a rating, as prescribed in these Regulations, the Naval Board may approve in special cases of an allowance towards cost of uniform at the rate of 6d. per day being paid in cash.

Cancel Regulation 45 (a) and substitute the following:—

Victualling.

45. (a) The system of messing shall be the “General Messing System,” and the Accountant Officer shall be responsible that the average value of rations issued to Officers, Petty Officers, and men of the General Mess, does not eventually exceed 1s. 2d. per head per diem. He shall also be responsible that accounts in connexion with victualling are kept in the prescribed form. Debits or credits shall be carried forward monthly on Form A.S. 72 Z. Officers and Petty Officers may be allowed, if they so prefer, to draw the ration allowance in cash and arrange for their own victuals from the Accountant Officer under a Repayment System. The total value of provisions so issued will be deducted on Form A.S. 73 from the total amount due to each mess monthly. The caterer of each mess will draw and sign for the amount remaining due to Officers and Petty Officers’ messes drawing provisions on repayment. Ration allowance in cash shall be paid to Officers and men when on leave, the amounts so paid being shown and signed for in the Mess Book (Form A.S. 81). The Accountant Officer shall make the necessary arrangements to provide suitable meals, and shall submit weekly a bill of fare for the approval of the Commanding Officer. The Accountant Officer shall purchase all necessary provisions other than those which are obtainable from a Victualling Yard or Depot.

Cancel Regulation 49a and substitute the following:—

Deserters.

49a. A person who deserts from the Royal Australian Navy shall forfeit all active pay, allowances, and deferred pay, due to him to the date of his desertion, and shall forfeit all past service for the purposes of furlough, of Good Conduct Badges and Long Service and Good Conduct Medal.

The Naval Board may in the case of recovered deserters in special circumstances approve of the restoration of any portion of the pay, allowances, deferred pay, or service forfeited by the act of desertion.

The Captain is to cause the clothes and effects of a deserter to be delivered into the charge of the Accountant Officer together with an inventory signed by two or more persons.

After the expiration of three months from the date of desertion the Captain shall authorize the clothes and effects of a deserter to be sold on board by auction.

The proceeds of such sale are to be credited by the Accountant Officer to Revenue.

Rewards for arrest of deserters shall be paid as follows:—

Up to a limit of £1 for a straggler.

Up to a limit of £3 for a deserter or presumed deserter.

The amount of the reward, within above limits, shall be at the discretion of the Officer issuing the warrant, and shall, together with any expenses incidental to arrest, be charged by the Accountant Officer against the pay of the deserter or straggler earned subsequently to arrest.

Add new Regulation 50 (c):‑‑‑‑

PAY AND ALLOWANCES OF NAVAL CHAPLAINS.

50 (c) The following rates of pay and allowances shall apply on and from the 1st July, 1912, to Chaplains appointed to H.M.A. ships or Naval Establishments:—

Chaplains shall be provided with accommodation in H.M.A. ships, and with quarters or allowance in lieu thereof at the rate of £68 8s. 9d. per annum when attached to Naval establishments. They shall also be entitled to medical attendance.

Add new Regulation 50 (d):—

PAY OF NAVAL SCHOOLMASTERS.

50 (d). The following rates of pay, inclusive of all allowances except travelling, shall apply on and from 1st July, 1912, to Schoolmasters appointed to H.M.A. Ships or Naval Establishments:—

Schoolmaster (relative rank of Warrant Officer)—£240 to £270 per annum.

Assistant Schoolmaster (relative rating of Chief Petty Officer)—£180 to £230 per annum.

Annual increments of £10 per annum subject to such conditions as may be prescribed by the Naval Board.

On first appointment, Uniform Allowance as follows shall be paid, towards cost of such uniform as may be prescribed:—

Schoolmasters, £25;

Assistant Schoolmasters, £7.

Each claim must be supported by vouchers, and be approved by the Officer Commanding.

When Government quarters are occupied a deduction of one-tenth shall be made from pay, unless otherwise approved by the Naval Board.

Cancel Regulation 51 (a) and substitute the following:‑‑

PAY OF LABOURERS, WATCHMEN, ETC., EMPLOYED IN CONNEXION WITH THE ADMINISTRATIVE AND INSTRUCTIONAL STAFF OR IN NAVAL ESTABLISHMENTS.

51 (I) (a). The following rates of pay, inclusive of all allowances except travelling, shall apply on and from 1st July, 1912:—

51 (II). Naval Draughtsmen shall be divided into three classes. The rates of pay shall be as follows:—

(b) The Act and Regulations governing the classification, pay, increments, and allowances of the Professional Division of the Commonwealth Public Service shall apply generally to Draughtsmen. The granting of increments shall be subject to the recommendation of the Naval Board and the approval of the Minister.

(c) Notwithstanding the preceding Regulation, the Minister may, when it appears expedient or desirable in the interests of the Department, appoint an officer at any salary within the limits of Classes B and C.

Regulation 62:‑‑‑‑

Add at end of Regulation—

In special circumstances the Naval Board may approve of an allowance in lieu of rations at the same rate as provided for the Permanent Naval Forces (Sea Going) being paid in cash.

Any such cash payment shall not be considered as part of pay or retainer.

Add, new Regulation 66a—

66a. Prizes for rifle shooting, as laid down in Articles 1,160 and 1,440 of King’s Regulations, shall be allowed, subject to the conditions prescribed therein.

Regulation 77 (a):—

Except as otherwise provided in these Regulations, civilian officers, not holding a rank or relative rank, shall receive travelling allowance at the rate prescribed for the rank of Officers of the Administrative and Instructional Staff of equivalent salary.

Persons holding positions set out in Regulation 51 (I) (a) shall receive travelling allowance as prescribed for seamen.

Regulation 77 (7) (e):—

Notwithstanding this Regulation, the Minister may approve payment of travelling or other expense on first appointment.
