REGULATIONS UNDER THE DEFENCE ACT 1903-1918.

I, SIR WILLIAM HILL IRVINE, Deputy of the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following regulations under the Defence Act 1903-1918, to come into operation forthwith.

FINANCIAL AND ALLOWANCE REGULATIONS FOR THE AUSTRALIAN MILITARY FORCES AND SENIOR CADETS.

1921.

Amendments.

Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921, are amended as follows:—

(a) Regulation 37, sub-para. (b), which reads:—

“(b) The rates of pay per annum for officers of the Australian Army Survey Corps shall, irrespective of rank, be—

Minimum—£325,

Maximum—£450,

with yearly increments of £25, provided that the fourth increment shall not be admissible unless and until the officer has qualified as a licensed surveyor.”

is cancelled.

(b) Regulation 39—

Under the heading (a) “Warrant Officers (i), Class 1, Category ‘A’” delete the word “Draughtsman.”

Under the heading (a) “Warrant Officers (ii), Class I, Category ‘B’” delete the word “Topographer.”

(c) After regulation 42, add new regulations 42a and 42b:—

42a. (1) The rate of pay for members of the Australian Army Survey Corps specified hereunder shall be:—

Promotion to the rank of Sergeant may be effected after one year’s satisfactory service as Corporal.

(ii) This regulation shall have effect from the 1st day of July, 1921, and in order to ascertain the rate of pay which a member of the Australian Army Survey Corps shall be eligible to receive on that date the following conditions shall apply:—

(iii) Subject to satisfactory report as to professional efficiency the rate of pay which a member shall receive as from the 1st July, 1921, shall be that rate which he would receive on that date had these Regulations been in operation at the date of appointment or promotion to the rank held by him on the 30th day of June, 1921, provided that a member who would thereby become eligible for promotion shall not advance beyond the minimum rate of pay prescribed for the rank next higher to the rank held by him on the 30th June, 1921, until he has served for twelve months from the 1st July, 1921, on such minimum rate, and shall proceed thereafter by the prescribed increments.

(iv) A member who, prior to the 1st July, 1921, was in receipt of a rate of pay and allowances combined, higher than the rate of pay which he would be eligible to receive under the previous sub-paragraphs of this regulation, may be paid at such higher rate until such time as his rate of pay under sub-paragraph (i) of this regulation is greater, provided that high cost of living allowances paid under regulation 40 shall be subject to any reduction which may from time to time be made therein.

(v) The high cost of living allowance authorized to be paid by regulation 40 in addition to the rates of pay prescribed in regulation 39 shall not be payable to members of the Australian Army Survey Corps in receipt of pay in accordance with the rates prescribed in sub-paragraph (i) of this regulation.

Draughtsmen—Royal Australian Engineers.

42b. (i) Draughtsmen in the Royal Australian Engineers shall be paid in accordance with the rates prescribed hereunder:—

(ii) This regulation shall have effect from the first day of July, 1921, and in order to ascertain the rate of pay which a Draughtsman, R.A.E., shall be eligible to receive on that date the following conditions shall apply.

(iii) Subject to satisfactory report as to professional efficiency the rate of pay which a member shall receive as from the 1st July, 1921, shall be that rate which he would receive on that date had these Regulations been in operation at the date of appointment or promotion to the rank held by him on the 30th day of June, 1921, provided that a member who would thereby become eligible for promotion shall not advance beyond the minimum rate of pay prescribed for the rank next higher to the rank held by him on the 30th June, 1921, until he has served for twelve months from the 1st July, 1921, on such minimum rate and shall proceed thereafter by the usual increments.

(iv) A member, who, prior to the 1st July, 1921, was in receipt of a rate of pay and allowances combined higher than the rate of pay which he would be eligible to receive under the previous sub-paragraphs of this regulation may be paid at such higher rate until such time as his rate of pay under sub-paragraph (i) of this regulation is greater, provided that high cost of living allowances paid under regulation 40 shall be subject to any reduction which may from time to time be made therein.

(v) The high cost of living allowance authorized to be paid by regulation 40 in addition to the rates of pay prescribed in regulation 39 shall not be payable to draughtsmen R.A.E., in receipt of pay in accordance with the rates prescribed in sub-paragraph (i) of this regulation.

The above amendments to take effect from 1st July, 1921.

(d) Regulation 40, sub-para. (iii).—Delete that portion which reads as follows:—

“The high cost of living allowance shall not be payable to a member unless he has either attained the rank of Sergeant or has served three years in the Permanent Forces as prescribed in Australian Military Regulation 396.”

and substitute in lieu thereof, the following:—

“Members of the Permanent Forces holding rank of Warrant Officer, Class I., or lower, on the 29th November, 1920, may be paid, the high cost of living allowance in accordance with the conditions of this regulation; but any member who enlists or marries subsequent to the 29th November, 1920, shall not be eligible to receive the allowance until he has either attained the rank of Sergeant or has served three years in the Permanent Forces, as prescribed in Australian Military Regulation 396.”

(e) Regulation 41 is repealed, and the (allowing substituted in lieu thereof, with effect from the 1st July, 1921:—

“The rates of pay for Armament Artificers and Assistant Armament Artificers shall be as determined from time to time by the Minister on the recommendation of the Military Board.”

(f)Regulation 150 is repealed.

(g) Regulation 203 (m) is amended by deleting the following:—

“This shall only apply to removals from one District to another or from Thursday Island to Brisbane.”
