REGULATIONS UNDER THE DEFENCE ACT 1903-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act1903-1918, to come into operation forthwith.

Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921.

Amendments.

Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets are amended as follows, to take effect from 1st May, 1921:—

Regulation 1.—After the definition of “Finance Member” add:—

“Commander of a Formation” means an officer appointed to be—

(a)Officer Commanding a Cavalry or Infantry Division.

(b) Officer Commanding the field troops of the Military Forces in any Military District.

(c) An Officer Commanding any command which does not form part of a Division or Brigade, who is appointed by the Military Board to be an authority under A.M. regulation 5c.

(d) In the case of the Royal Military College, the Commandant thereof.

The definition of Commandant in regulation 1, is cancelled.

Regulation 4.—Amend the heading “Responsibility of Commandants” to read “Responsibilities of Commanders of Formations”.

Regulation 4.—In lieu of the word “Commandants” insert “Commanders of Formations”

Regulation 5.—Cancel the words “The Commandant”.

Regulation 6 is cancelled and the following substituted therefor:—

6. Except where otherwise provided in these Regulations Commanders of Formations are authorized to approve of increments to Warrant Officers, non-commissioned officers and men of the Permanent Forces under their command, where such increments are prescribed by the regulations and provided in the Appropriation Act.

Regulation 7 is cancelled.

 

Regulation 10 is cancelled, and the following substituted therefor:—

10. All powers vested under these Regulations in Commanders of Formations or District Finance Officers may also be exercised, where necessary, by the Military Board.

Under the heading Part III., “Duties of District Finance Officers” add new regulation:—

15. Each District Finance Officer is authorized:—

(a) To approve of all requisitions for supplies within the votes on the Estimates which are governed by regulations.

(b)To approve of expenditure under the divisions or subdivisions of any Votes for contingencies, general services, maintenance of existing arms and equipment and Expeditionary Forces, provided that he has satisfied himself that funds are available; that the requirements of the remaining period of the financial year will not involve the necessity for applying for additional funds on any Vote concerned; that there is nothing irregular in the character of the expenditure; and that it is not an allowance or payment to any member of the Forces, except such as is governed by regulations and does not require Ministerial approval. No new Vote or Item shall be operated upon or expenditure incurred in connexion therewith without approval from Head-Quarters, until such Vote or Item has been passed by Parliament.

(c) To approve of the employment of casual labour and temporary clerical assistance, provided that funds are available; but no person shall be employed under this regulation for a longer period than six months in any financial year without the approval of the Military Board.

(d)To approve—in accordance with regulation 166 —of compensation for injuries received, or disease contracted, on duty.

(e) To approve—in accordance with regulation 184 —of compensation for injury to, or loss of, a horse.

(f) To approve in accordance with Australian Military Regulations—of the striking off charge of stores damaged or deficient, provided that the original value of such stores did not exceed £20.

(g)To approve of payment of claims for overtime and Sunday pay, provided that such are in order, and correct in every particular.

Regulation 16.—In lieu of the words “The Commandant” insert “The Commander of the Formation concerned”.

In lieu of the words “by the Military Commandant” insert “and the Commander of the Formation concerned”.

In lieu of the words “the District Commandant” insert “the Commander of the Formation concerned”.

In lieu of the words “Commandant’s remarks” insert “remarks of the Commander of the Formation concerned”.

Regulation 20.—In lieu of the word “Commandant” insert “Commander of the Formation concerned”.

Regulation 25.—In lieu of “Commandant” insert “Commander of the Formation concerned”.

Regulation 37 (a).—In lieu of “Commandant” insert “Commander of Formation concerned”.

Regulation 41 (ii).—In lieu of the word “Commandant” insert “Commander of the Formation”.

Regulation 70 (b).—In lieu of “Head-Quarters” insert “District Base Head-Quarters”.

Regulation 72 (b).—For the words “District Commandants” insert “Commander of the Formation concerned”.

Regulation 73 (a).—For the words “District Commandant’s approval” insert “approval of the Commander of the Formation concerned”.

Regulation 74.—For the words “the command of District Commandants” insert “Commanders of Formations”. Delete the words “or Commanding Officers, as the case may be”.

Regulation 79 (c.)—For the words “District Head-Quarters” insert “District Base Head-Quarters”.

Regulation 81.—For the words “District Head-Quarters” insert “District Base Head-Quarters”.

For the words “District Principal Medical Officer” wherever they occur insert “the representative in the District of the Director-General of Medical Services”.

Regulation 81 (e).—For the words “Commandants may authorize District Principal Medical Officers to arrange” insert “the representative in the District of the Director-General of Medical Services may arrange”.

Regulation 82.—Delete the words “without the special sanction of the District Commandant”.

Regulation 86.—For the words “District Commandant” insert “the representative in the District of the Director-General of Medical Services”.

Regulation 90.—For the word “Commandant” insert “Commander of the Formation”.

Regulation 96.—For the words “Principal Medical Officer in charge of troops” insert “The representative in the District of the Director-General of Medical Services”.

Regulation 98.—For the word “Commandants” insert “District Finance Officers”.

Regulation 115.—Delete the words “by the District Commandant”.

Regulation 120.—In lieu of the words “District Commandants” insert “Commanders of Formation”

In lieu of the words “District Commandant” appearing at the end of the regulation insert “Commander of the Formation”. Delete the words “pending the decision of the District Commandant”.

Regulation 121.—In lieu of the word “Commandant” insert “Commander of the Formation”.

Regulation 126 (d).—For the word “Commandant” insert “Commander of the Formation concerned”.

Regulation 138.—In lieu of the word “Commandant” wherever occurring insert “Commander of the Formation”.

Regulation 187 is cancelled.

Regulation 138 (c).—Cancel the words “Principal Medical Officer (or” and remove bracket appearing after the words “Permanent Troops”.

(d)Cancel the words “on the recommendation of the Principal Medical Officer and the approval of the District Commandant”.

Regulation 140 (2).—Delete the words “the District Commandant, or other”.

Regulation 141.—Sub-para. 1. Insert “District Finance Officer” in lieu of “Commandant” appearing twice in this sub-paragraph.

Sub-para. 2. Insert “District Finance Officer” in lieu of “Commandant”.

Regulation 148.—Sub-paragraph (d) is cancelled.

Regulation 167.—In lieu of “Commandant of the District”, “Commandant” or “District Commandant” insert “Commander of the Formation.”

Regulation 168.—Cancel the regulation and substitute the following in lieu:—“The proceedings of the Court shall be transmitted by the Commander of the Formation with his recommendation to the District Finance Officer”.

Regulation 173 (a).—In lieu of “Commandant” insert “Commander of the Formation”.

Regulation 176.—In lieu of the words “Principal Medical Officer of a Military District” insert “representative in the District of the Director-General of Medical Services”.

Regulation 178.—In lieu of “regulation 6 (d)” insert “regulation 15 (d)”.

Regulation 179. In lieu of the words “Principal Medical Officer” insert “representative in the District of the Director-General of Medical Services”.

Regulation 184.—Sub-paragraph (e) is cancelled and the following substituted therefor:—

“(e)Before approval is given for any compensation for loss of a horse, the District Finance Officer shall insure that the documents are in order”.

Regulation 205 (b) is cancelled, and the following substituted therefor:—

“Non-commissioned officers of the Permanent Forces may travel 1st class, by rail, for distances over 50 miles on the narrow gauge lines of Queensland, South Australia, and Western Australia”.

Regulation 205 (c)—In lieu of “District Commandant” insert “District Base Commandant”.

Regulation 205 (d).—In lieu of the words “upon medical recommendation” insert “upon the recommendation of the representative in the District of the Director-General of Medical Services”.

Regulation 309 (c) is cancelled, and the following substituted therefor:—

“(c) It shall be the duty of the District Finance Officer to see that all telegrams are in strict compliance with these Regulations and to bring under the notice of the Commanders of Formations concerned any irregularity in the despatch of telegrams”.

Regulation 311 (c).—In lieu of “Commandant” insert “District Base Commandant”.

Regulation 313.—In lieu of “Commandants” insert “Commanders of Formations”.
