REGULATIONS UNDER THE DEFENCE ACT 1903-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1918 to come into operation forthwith.

Amendments.

Financial and Allowance Regulations for the Australian Military Forces and Senior Cadets, 1921, are amended as follows, to take effect from 1st May, 1921:—

Regulation 100 is cancelled and the following substituted therefor:—

Rates of Pay for Militia Forces.

100. The rates of pay for officers of the Militia Forces appointed as Commanders and Staff Officers of Formations shall be:—

(b) Regulation 101.

Delete the heading “Rates of Pay for Militia Forces (excluding Australian Army Pay Corps)” and insert the following words in lieu:—

“The rates of pay for personnel of the Militia Forces other than those holding the appointments mentioned in Regulation 100 shall be as under:—

In the schedule of rates of pay delete the words “Colonel or Brigadier” and insert the word “Colonel” in lieu.

Delete the words “Quartermaster, at the rate of substantive rank” and insert in lieu the words:—

“Assistant Adjutant, Quartermaster, or Assistant Quartermaster, at rate of substantive or equivalent substantive rank”.

Delete the words “Warrant Officer” appearing after “Quartermaster-Sergeant” and insert in lieu:—

(Warrant Officer, Class I)”.

(c) Regulation 111.

After the words “except as provided in Regulation 114” insert the words “and Regulation 122(b)

(d) Regulation 121.

At the beginning of the regulation insert the words “except as provided in Regulation 122 (b)”.

(c) Regulation 122 is cancelled and the following substituted therefor:—

122 (a) The pay of Militia Staffs shall be issued subject to:—

(i) In the case of Divisional or Brigade Commanders and Divisional Artillery Commanders

Production of a certificate by them that they have performed military duty to the equivalent in hours of the number of days for which pay is claimed supported by a diary maintained for the purpose.

(ii) In the case of Staff Officers of Divisions or of Cavalry or Infantry Brigades, or Officers of the Intelligence Section of the General Staff

(a)The maintenance of a diary setting forth the hours of employment, the place, and the nature of the duty.

(b)A certificate from their immediate Commander as to attendance at Camp.

(c)A certificate from their immediate Commander that they have efficiently performed the duties allotted to them and are entitled to pay for the periods named.

(d)Approval of the Commander of the Formation concerned.

(iii) In the case of Commanding Officers and Staffs of Regiments and Battalions, and Field Artillery Brigades, and Warrant and Non-Commissioned Officers of Cavalry or Infantry Brigade, or Field Artillery Brigade Staffs

(a) A certificate from their Commanding Officers that their duties have been efficiently performed and that they are entitled to pay for the period claimed;

(b) Approval of the Commander of the Formation concerned.

(b) Pay of the personnel referred to in (i) and (ii) above shall not be subject to the conditions laid down in regulations 111 and 121. Payment to such personnel shall be made half-yearly in arrear in the months of December and June, payment for odd days being made in the June payment.

(c) In the case of' members of Militia Staffs who are on leave of absence for more than one month, a proportionate part of the annual rate of pay shall be deducted for the period of absence to be computed at one-twelfth of the annual rate for each month of absence, provided that, for personnel referred to in paragraph (iii) above, the pay allocated for the period of continuous training shall first be deducted.

(d)Officers of the Army Medical Corps attached to Regiments and Forts shall be paid under the same conditions as personnel referred to in (iii) above.

(e) For the purposes of this regulation, a period of six (6) hours shall count as one day with the exception that for attendance at Camps of Continuous Training, pay shall be calculated for the actual number of days in Camp.
