Financial Agreement Act 1994

An Act to approve an agreement entered into between the Commonwealth, the States and the Territories and for related purposes

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Financial Agreement Act 1994 . 2CommencementThis Act commences on a day to be proclaimed. 3InterpretationIn this Act, unless the contrary intention appears, Agreement means the Agreement, a copy of which is set out in Schedule 1 . 4Approval of AgreementThe Agreement is approved. 5Implementation of Agreement (1)  The Treasurer is authorized, empowered and required to do all things necessary or expedient to implement the Agreement . (2)  The laws of the State are – (a) modified so far as may be necessary to give full effect to the Agreement ; and (b) to be construed subject to any such modification. (3)  In this section, law of the State means any Act of the Parliament of the State and any subordinate legislation made under any such Act. 6Administration of ActUntil provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990 – (a) the administration of this Act is assigned to the Treasurer; and (b) the Department responsible to the Treasurer in relation to the administration of this Act is the Department of Treasury and Finance.
