Finance Regulations Amendment (Workers Compensation) Regulations 2024

Made by the Governor in Executive Council.

Part 1 – Preliminary1.Citation

These regulations are the Finance Regulations Amendment (Workers Compensation) Regulations 2024.

2.Commencement

These regulations come into operation as follows —

• (a)

  Part 1 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on 1 July 2024.

Part 2 – Duties Regulations 2008 amended3.Regulations amended

This Part amends the Duties Regulations 2008.

4.Regulation 5A amended

In regulation 5A(1) delete “Workers’ Compensation and Injury Management Act 1981 section 160(1)(b)” and insert:

Workers Compensation and Injury Management Act 2023 section 202(2) that insures an employer for a liability referred to in paragraph (b) of the definition of workers compensation policy in section 202(1) of that Act

Part 3 – Procurement (Debarment of Suppliers) Regulations 2021 amended5.Regulations amended

This Part amends the Procurement (Debarment of Suppliers) Regulations 2021.

6.Schedule 2 amended

In Schedule 2 in the Table delete item 7 and insert:

7. Non‑compliance with workers compensation legislation Workers Compensation and Injury Management Act 2023 — conduct that contravenes section 204 or 223

Part 4 – Taxation Administration Regulations 2003 amended7.Regulations amended

This Part amends the Taxation Administration Regulations 2003.

8.Regulation 13J amended

• (1)

  In regulation 13J(1) delete the definition of WorkCover WA.

• (2)

  In regulation 13J(1) insert:

   

WorkCover WA means the body established under the Workers Compensation and Injury Management Act 2023 section 445(1).

• (3)

  In regulation 13J(2) delete “Workers’ Compensation and Injury Management Act 1981.” and insert:

   

Workers Compensation and Injury Management Act 2023.
