Finance Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Audit Act 1901.

Commencement

1. These Regulations shall come into operation on 1 July 1984.

Interpretation

2. Regulation 4 of the Finance Regulations is amended by omitting paragraphs (a), (b) and (c) of the definition of “head of expenditure” in sub-regulation (1) and substituting the following paragraphs:

“(a) a division in the Schedule to an annual Appropriation Act that has no sub-divisions or items;

(b) a sub-division of a division in the Schedule to an annual Appropriation Act that—

(i) has no items; and

(ii) is not a sub-division that is, in accordance with a direction under section 29 of the Act, to be taken to be divided into notional items;

(c) an item of a division, or of a sub-division of a division, in the Schedule to an annual Appropriation Act;

(ca) one of the notional items into which a sub-division of a division in the Schedule to an annual Appropriation Act is, in accordance with a direction under section 29 of the Act, to be taken to be divided;”.

Application of Regulations

3. Regulation 5aof the Finance Regulations is amended by adding “or under a direction given by the Minister or the Secretary pursuant to sub-regulation 35 (1) of those Regulations” at the end of sub-regulation (2).

Prescribed Authorities

4. Regulation 6a of the Finance Regulations is amended

(a) by inserting

“Australian Federal Police”

after—

“Australian Electoral Office”;

and

(b) by inserting —

“Prices Surveillance Authority”

after—

“Office of National Assessments”.

Conditions subject to which obligations may be incurred

5. Regulation 44a of the Finance Regulations is amended by omitting from sub-paragraph (1) (c) (i) “in an Appropriation Act for” and substituting “under which moneys may lawfully be expended during”.

Requisition for supplies to be supported by certificate

6. Regulation 47 of the Finance Regulations is amended by omitting from sub-paragraph (3) (a) (i) “in an Appropriation Act for” and substituting “under which moneys may lawfully be expended during”.
