Finance Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Audit Act 1901.

1.   Commencement

1.1   Regulation 3 commences on 1 July 1996.

[NOTE: The remainder of these Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48]

2.   Amendment

2.1   The Finance Regulations are amended as set out in these Regulations.

3.   Regulation 6A (Prescribed authorities)

3.1   Subregulation 6A (1):

Omit the subregulation, substitute:

Prescribed authorities

 “6A.(1)Each of the following bodies is declared to be a prescribed authority for the purposes of the Act:

  • (a)

    Administrative Appeals Tribunal;

  • (b)

    Australian Bureau of Statistics;

  • (c)

    Australian Centre for International Agricultural Research;

  • (d)

    Australian Competition and Consumer Commission;

  • (e)

    Australian Customs Service;

  • (f)

    Australian Electoral Commission;

  • (g)

    Australian Federal Police;

  • (h)

    Australian Industrial Registry;

  • (i)

    Australian Transaction Reports and Analysis Centre (‘AUSTRAC’);

  • (j)

    Corporate Affairs Commission of the Australian Capital Territory;

  • (k)

    Family Court of Australia;

  • (l)

    Federal Court of Australia;

  • (m)

    Human Rights and Equal Opportunity Commission;

  • (n)

    Industry Commission;

  • (o)

    National Capital Planning Authority;

  • (p)

    National Competition Council;

  • (q)

    National Crime Authority;

  • (r)

    National Native Title Tribunal;

  • (s)

    Office of National Assessments;

  • (t)

    Office of Parliamentary Counsel;

  • (u)

    Office of the Director of Public Prosecutions;

  • (v)

    Spectrum Management Agency.”.

4.   Regulation 74 (Advances)

4.1   Paragraph 74 (1) (i):

Omit “and”.

4.2   After paragraph 74 (1) (i), insert:

  • “(ia)

    an advance to a legal service provider to enable the legal service provider to make payments on behalf of the Commonwealth in connection with any legal matter in which the Commonwealth is involved;”.

4.3   Subregulation 74 (2):

Omit “paragraph (j)”, substitute “paragraph (ia) or (j)”.

4.4   Subregulation 74 (4):

Omit “paragraph (j)”, substitute “paragraph (ia) or (j)”.

4.5   Add at the end:

 “(5) In paragraph (1) (ia):

‘legal service provider’ means:

  • (a)

    an officer of the Attorney General’s Department; or

  • (b)

    a legal practitioner other than an officer of the Attorney General’s Department;

‘legal matter’ includes any:

  • (a)

    proceedings before a court, board, commission or tribunal; and

  • (b)

    claim for damages or compensation; and

  • (c)

    conveyance or property settlement; and

  • (d)

    claim for legal costs, fees or expenses; and

  • (e)

    other law related services.”.

5.   Regulation 74A (Purposes to which subsection 36 (2) of the Act applies)

5.1   Add at the end:

  • “(d)

    the settlement of amounts due in connection with a legal matter of a kind referred to in paragraph 74 (1) (ia).”.

6.   Regulation 78 (Adjustment of advances)

6.1   Subregulation 78 (1):

Omit “or (j)”, substitute “, (ia) or (j)”.
