Finance Brokers Control (General) Amendment

Regulations 2008

Made by the Governor in Executive Council.

1.            Citation

These regulations are the Finance Brokers Control (General)

27 May 2008 GOVERNMENT GAZETTE, WA 2039

2.            Commencement

These regulations come into operation as follows:

(a)	regulations 1 and 2—on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations - on the day after that day.

3.            The regulations amended

The amendments in these regulations are to the Finance Brokers
Control (General) Regulations 2005.

4.            Regulation 6 amended

Regulation 6(3)is amended by deleting paragraph (g) and inserting the following paragraph instead -

"

(g) a summary of the current policy of professional

indemnity insurance that covers the applicant,
in the form approved by the Commissioner.

5.            Regulation 7 amended

Regulation 7(3)(h) is amended by deleting subparagraph (iv) and inserting the following subparagraph instead -

"

(iv) for each partner of the firm - a

summary of the current policy of
professional indemnity insurance that
covers the partner, in the form approved
by the Commissioner.

6.            Regulation 8 amended

Regulation 8(3)(f) is amended by deleting subparagraph (iv) and

inserting the following subparagraph instead -

(iv) a summary of the current policy of

professional indemnity insurance that covers the body corporate, in the form approved by the Commissioner.

7. Regulation 17 amended
Regulation 17(2) is amended as follows:

(a) by deleting "Subject to subregulation (3), the" and

inserting instead -
" The ";

(b) in the Table to the subregulation, item 2, by deleting "or

a Diploma of Lending" and inserting instead -

, a Diploma of Lending or a Diploma of Financial
Services (Lending),

8.            Regulation 18 amended

Regulation 18(2) is amended by deleting "Subject to subregulation (3), the" and inserting instead —

" The ".

9.             Schedule 3 amended

Schedule 3 Form 1 is amended by deleting "complaint" and inserting instead -

prosecution notice ".
