Final Determination

under the

Biodiversity Conservation Act 2016

The Scientific Committee established under the Biodiversity Conservation Act 2016 has made a final determination to list the following species and ecological communities as endangered or critically endangered and, as a consequence, omit certain references to those species or ecological communities and, accordingly, that Act is amended as follows:

(a)	Division 2 of Part 1 of Schedule 1 is amended as follows:
(i) Insert in the matter relating to Dilleniaceae, as currently provisionally listed:

Hibbertia fumana Sieber ex Toelken

(ii)      Insert in the matter relating to Lamiaceae:

Prostanthera gilesii Althofer ex B.J.Conn & T.C.Wilson

(iii)      Insert in the matter relating to Proteaceae:

* Grevillea rivularis L.A.S.Johnson & McGill.

(iv)      Insert in the matter relating to Rutaceae:

Leionema lamprophyllum subsp. fractum S.A.J.Bell.
Zieria odorifera subsp. copelandii Duretto & P.I.Forst.

(v)      Insert in appropriate order:

Thymelaeaceae

Pimelea cremnophila L.M.Copel. & I.Telford

(b) Division 1 of Part 2 of Schedule 1 is amended by inserting the following in the matter relating to Myobatrachidae, as currently provisionally listed:

Uperoleia mahonyi Clulow, Anstis, Keogh & Catullo,	Mahony’s Toadlet

(c)	Division 3 of Part 2 of Schedule 1 is amended by omitting the following from the matter relating to Proteaceae:
* Grevillea rivularis L. Johnson & McGillivray
(d)	Division 4 of Part 2 of Schedule 1 is amended by omitting the following from the matter relating to Rutaceae:

Leionema lamprophyllum (F. Muell.) Paul G. Wilson	Leionema lamprophyllum
subsp. obovatum F.M. Anderson	subsp. obovatum population in the Hunter Catchment

(e)	Part 1 of Schedule 2 is amended by inserting the following in appropriate order:
* Eastern Suburbs Banksia Scrub in the Sydney Basin Bioregion (as described in the notice of, and reasons for, the Final Determination of the Scientific Committee to list the ecological community)
(f)	Part 2 of Schedule 2 is amended by omitting the following:
* Eastern Suburbs Banksia Scrub in the Sydney Basin Bioregion (as described in the determination of the Scientific Committee under Division 5 of Part 2)

This final determination commences on the day on which it is published on the NSW legislation
website.
