FILM AND COMPUTER GAME CLASSIFICATION ACT

1984—REGULATION

(Film and Computer Game Classification Regulation 1995)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Film and Computer Game Classification Act

1984, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Film and Computer Game Classification Regulation 1995.

Commencement

2. This Regulation commences on 27 March 1995.

Definition

3. In this Regulation:

“the Act’’ means the Film and Computer Game Classification Act

1984.

Fee for classification or review of classification of film: secs. 7, 12

4. (1) For the purposes of section 7 (2) (b) (iii) of the Act, the

prescribed fee to accompany an application for classification of a film is
$35.00.

(2) For the purposes of section 12 (3) of the Act, the prescribed fee to accompany an application for the review of the censor’s decision with respect to the classification of a film is $50.00.

5. For the purpose of imposing any condition on an approval under

section 10 (1) or 14 (1) (b) of the Act, the censor or appeal censor, as the

case may be, may specify any symbols or words, or both, to be displayed

in connection with the use of an advertisement relating to a film:

(a)

by reference to any of the symbols or words specified in clause 6; or

(b)

by reference to a code of symbols set out in a document adopted by the censor.

Prescribed markings: sec. 27

6. (1) For the purposes of section 27 of the Act, the prescribed

markings for a film are the markings set out in subclauses (2)–(6).

(2) The prescribed markings for a “G” film are as follows:

(3) The prescribed markings for a “PG” film are as follows:

PARENTAL GUIDANCE RECOMMENDED

(4) The prescribed markings for an “M” film are as follows:

FOR MATURE AUDIENCES

(5) The prescribed markings for an “MA” film are as follows:

RESTRICTIONS APPLY TO PERSONS UNDER 15 YEARS

(6) The prescribed markings for an “R” film are as follows:

RESTRICTED EXHIBITION—NOT AVAILABLE TO PERSONS

UNDER 18 YEARS

(7) A marking prescribed by this clause:

(a)

if consisting of a symbol, must be of such a size that the letter incorporated in the symbol is at least 5 mm in height; or

(b)

if consisting of letters or figures, must consist of letters or figures at least 2 mm in height,

and must be of a colour that contrasts with the colour of its background to

such a degree that the marking is clearly legible.

7. (1) A notice displayed under section 28 of the Act must contain the following symbols and words:

(3) The symbols and words prescribed by this clause must be printed or written in letters and figures at least 15 mm in height and of a colour that contrasts with the colour of their background to such a degree that the notice is clearly legible.

Repeal

8. (1) The Film and Computer Game Classification Regulation 1985 is repealed.

(2) Any act, matter or thing that, immediately before the repeal of the Film and Computer Game Classification Regulation 1985, had effect under that Regulation is taken to have effect under this Regulation.

EXPLANATORY NOTE

The object of this Regulation is to repeal and remake, without any changes in substance, the provisions of the Film and Computer Game Classification Regulation 1985 under the Film and Computer Game Classification Act 1984. The new Regulation deals with the following matters:

(a) the fees payable in connection with applications under the Act (clause 4);

(b)

the words and symbols that may be used in connection with the advertising of a classified film (clause 5);

(c) the markings appropriate for the various classifications of film (clause 6);

(d)

the words and symbols that are to appear on notices to be displayed at premises from which films and computer games are sold (clause 7);

(e) other matters of a formal nature (clauses 1, 2, 3 and 8).

This Regulation is made under the Film and Computer Game Classification Act 1984, including section 48 (the general regulation making power) and sections 7, 10, 12,

14, 27, 28 and 34J.

This Regulation comprises or relates to matters of a machinery nature.

This Regulation is made in connection with the staged repeal of subordinate

legislation under the Subordinate Legislation Act 1989.
