McHUGH J:   Could the matter be called outside the Court three times, please.  No appearance?

COURT CRIER:   No appearance, your Honour.

McHUGH J:   That is as expected because the parties indicated that they were prepared for the Court to deal with the matter on the papers.

In our view special leave to appeal should be refused in this case with costs.  The applicant seeks special leave to appeal from a decision of the Victorian Court of Appeal by which it dismissed an appeal by the applicant against a decision of the Administrative Appeals Tribunal.  The Administrative Appeals Tribunal had refused an application by the applicant for the joinder of another person as a party to the proceedings.  The application to this Court raises no point which requires or calls for the grant of special leave to appeal and we have no doubt that the decision of the Court of Appeal in any event was correct.  The application is dismissed with costs.

The Court will now adjourn until 2.15.
