Field of Mars Resumption Repeal Act 1897 (NSW)

Act No. 9, 1897.

An Act to apply the provisions of the Crown Lands Acts to certain land described in the Schedule to the Field of Mars Common Resumpt ion Act of 1874; to declare that certain of the said land shall be Crown l ands ; and to repeal the said Act. [28th July, 1897.]

B t h e advice and consent of t he Legis la t ive Counci l and Legis la t ive

Assembly of N e w South Wales in P a r l i a m e n t assembled, and b y t h e

au tho r i t y of t he same, as follows :—

1. A n v land described in t he Schedule to t h e Field of Mar s

Common R e s u m p t i o n Act of 1874 which has before t h e day w h e n th i s A c t t akes effect been dedicated or reserved shall be deemed to have been a n d to be land dedicated or temporar i ly reserved (as t h e case m a y be) unde r t he Crown L a n d s A c t of 1 8 8 4 ; and t h e provisions

of t he Crown L a n d s Acts shal l app ly to t h e said land a n d	to a n y
dedicat ion or reservat ion m a d e as aforesaid.

2. The land described in t h e said Schedule , wi th t he except ion of l and dedicated as aforesaid, or g ran ted or lawfully contracted to be g ran ted in fee s imple, shall be Crown lands wi th in the m e a n i n g of t h e Crown Lands Ac t s :

P rov ided tha t , on t he revocat ion of any such dedicat ion as aforesaid, t h e l and shal l become Crown lands wi th in t he m e a n i n g of

t h e Crown L a n d s Ac t s :

P rov ided also t h a t any of the said land which , hav ing before t he said day been lawfully con t rac ted to be granted , has before t h e said day rever ted to or become revested, or may after t he said day rever t to or become revested in t he Crown unde r the condit ions of t he con t rac t of sale or otherwise shal l be Crown lands wi th in t he mean ing of t h e

3. The Field of M a r s Common R e s u m p t i o n A c t of 1874 is

he reby	r epea l ed :
Provided t h a t t h e said repeal shall n o t —

(a)	affect the previous operation of the enactment so repealed, or a n y t h i n g duly done, suffered, or commenced to be done u n d e r
t h e e n a c t m e n t so repealed ; or

(6) affect any r ight , privilege, obligation, or l iabil i ty acquired,

accrued, or incur red unde r t h e e n a c t m e n t so repealed ; or

(c) affect any investigation, legal proceeding, or remedy in respect of any such right, privilege, obligation, or liability as afore- said.

And any such investigation, legal proceeding, or remedy may be instituted, continued, or enforced as if this Act had not passed.

4. This Act shall take effect on and after the first day of June, one thousand eight hundred and ninety-seven, and may be cited as the "Field of Mars Resumption Repeal Act, 1897."
