Fertilizers Amendment Regulations 2001

Made by the Lieutenant-Governor and deputy of the Governor in
Executive Council.

1.            Citation

These regulations may be cited as the Fertilizers Amendment
Regulations 2001.

2.            The regulations amended

The amendments in these regulations are to the Fertilizers
Regulations 1978*.

3. Regulation 2 amended
Regulation 2 is amended as follows:
(a)

fertilizer", by deleting "0.008%" and inserting

in paragraph (a) of the definition of "prescribed " 0.001%

"prescribed trace element fertilizer" has the meaning given in regulation 2A;
(b) in the definition of "prescribed phosphatic fertilizer" -
(1) by deleting "phosphorus" in the first place where

it occurs and inserting instead -

at least 2% phosphorus by weight "; and

(ii) in paragraph (a), by deleting "0.050/o" and

inserting instead -

" 0.03% ";

(c)

after the definition of "prescribed phosphatic fertilizer" by inserting the following definition -

4. Regulation 2A inserted
After regulation 2 the following regulation is inserted -
2A. Meaning of "prescribed trace element fertilizer"

A "prescribed trace element fertilizer" is a fertilizer that -

(a) contains more than 0.005% of cadmium or cadmium compounds by weight;
(b) contains (in accordance with the table to regulation 3A) one or more of the specified ingredients iron, manganese, copper, zinc, boron, molybdenum, and cobalt; and
(c) if it contains any of the specified ingredients

nitrogen, phosphorus, potassium, calcium,

magnesium or sulphur - contains less than the minimum amount of that ingredient specified in the table to regulation 3A.

5. Regulation 3A amended
Regulation 3A is amended as follows:

(a)

before "Where" by inserting the subregulation designation "(1)";

(b) by deleting "Where" and inserting instead -

Subject to subregulation (2), where ";

(c)

at the end of the regulation by inserting the following subregulation -

(2) Subregulation (1) does not apply to a prescribed trace

element fertilizer in respect of the specified ingredients

nitrogen, phosphorus, potassium, magnesium or

sulphur.

6.            Regulation 21 amended

Regulation 21 is amended by deleting "or prescribed phosphatic fertilizer" and inserting instead -

"

prescribed phosphatic fertilizer or prescribed trace

element fertilizer

7.           Miscellaneous amendments relating to "registered"

(1) Regulation 15 is amended as follows:

(a)

by deleting "registered" in the first place where it occurs;

(b)

by deleting "if the substance is not registered as a fertilizer,".

(2) Regulation 16(1) is amended in the table, in the headings to
column 2 and column 3, by deleting "registered".
(3) Regulation 16(2) is amended by deleting "registered" in both
places where it occurs.
(4) The Second Schedule Form 6 is amended by deleting
"Registered concentration" and inserting instead —
" Concentration
