Every State inspector appointed under" The Diseases in Stock Acts, 1896 to 1898,'* "The Diseases in Pl"ants Act of 1896,"t or "The Dairy Produce Acts, 1904-1911,"t shall without further appo:ntment be deemed to be an officer under this Act, and shall exercise and perform the powers and duties conferred and imposed upon officers by this Act. 4. (1.) No person shall sell fertiliser unless he is Dealers' licensed as a dealer under this Act. Any person who g~ h~ ~ '; ; 'ie L contra venes this provision shal' be -liable to a penalty not exceeding twenty pounds. If any fertiliser is sold in Queensland by any person not licensed as a dealer under this Act, [my inspector may seize such fertiliser, which shall thereupon be deemed to be forfeited. The inspector shall forthwith report such seizure to the Minister, who shall order the disposal of such fertiliser as he thinks fit. (2.) Any person who desires to become licensed as a dealer under this Act shall apply in writing to the Minister, in the form of the First Schedule to this Act, [Schedule I.} and transmit the prescribed fee. (3.) The Minister may in h:s discretion grant to any person making such application a license as a dealer in the form of the Second Schedule to th:s Act: Provided Schedule n. that before granting a license the Minister may require any particulars in addition to those set out in the appli- cation which appear to him necessary. * 60 Vie. No. 8, Such license shall take effect from the date ment:oned therein, and remain in force until the thirty-first day of December of the year in which it is issued. It may be renewed annually on payment of the prescribed fee. (4.) Every dealer shall, when requested by such person so to do, produce his license for the inspection of any pur- chaser of fertiliser or of any officer acting in the discharge of his duties or appointed under this Act, and for any failure so to do shall be liable to a penalty not exceeding five pounds. (5.) If any dealer is convicted of any offence under this Act twice within twelve months, the Minister may in his discretion cancel his license. Certificate of 5. (1.) On or before the thirty-first day of January ingredients. in each year, every ·dealer shall deliver to the officer authorised in that behalf by the Minister a certificate, Schedule III. in the form of the Third Schedule to this Act, of the specified ingredients of each brand of fertiliser dealt in by him. Each such certificate shall be registered by such officer : Provided that in the case of fertiliser manufactured from the by-products of a meat works or boiling-down establishment, where 'the fertiliser is liable to varv in quality during ·the year, the certificate shall so state, and it shaH be sufficient to set forth in the certificate a minimum percentage of the specified ingredients. Certificate (2.) Such certificate with respect to any brand of ammaeynbdeed. fertiliser may be amended in any particular by giving one . week's notice in writing to such officer. Pu blication (3.) The particulars in any such certificate delivered of certificate. to such officer may be published in The Queensland Agri- cultural,]ournal and in such other manner as the Minister directs. Upon the sale of any fertiliser, whether paid for cgeivrteifiincvaoteicteo at the time of sale or not, the dealer shall, at the time buyer. of sale or before delivery of the same or any part thereof, give to the buyer an invoice certificate, in the form of Schedule IV. the Fourth Schedule to this Act or to the like effect, signed by the seller or his agent, and containing the particulars therein prescribed. Every such invoice certificate shall be deemed a representation or warranty by the dealer to the buyer of the truth of the matters certified thereby.

Every dealer who sells any fertiliser shall ~: ~ ~~ ~ ~! of securely affix conspicuously to ,each package thereof a "'. plainly printed label clearly and truly certifying- (a) The number of net pounds of fertiliser in the package; (b) The figure trade mark or other sign under which the fertiliser is sold; and (c) A chemical analysis stating the proportion per centum in which the fertiliser contains the three ingredients nitrogen, phosphoric acid, and potash, and the respective forms in which they respectively occur as required to be stated in the invoice certificate. (2.) In the case of bone dusts or bonemeals, the per- centages of coarse material and fine material shall be stated on the label together with the percentage of phos- phoric acid and nitrogen.. Fine material is the portion which passes through a sieve of fifty meshes to the linear inch, and coarse material is the portion retained in the mesh of the sieve. (3.) In the case of basic slag or Thomas phosphate, the percentages of coarse material and fine material shall be stated on the label together with the percentages of total phosphoric acid and citrate soluble phosphoric acid. Fine material is the portion which passes through a sieve of one hundred meshes to the linear inch, and coarse material is the portion retained in the mesh of the sieve. (4.) Every such labcl shall be deemed a representation or warranty by the dealer to the buyer of the truth of the matters certified thereby. 8. Every dealer who sells a fertiliser which, upon Salt;?f analysis under this Act, is found to contain a smaller ; le: J~ ~ ser percentage of nitrogen, potash in readily soluble form, standard. water soluble, or citrate soluble, or total phosphoric acid, than the proportions thereof respectively stated in the invoice certificate delivered in pursuance of this Act upon the sale thereof, or stated on the label affixed to the

No. 8, package containing the fertiliser in pursuance of this Act, or on the label attached to each package containing such fertiliser, and such deficiency- As to nitrogen amounts to five per centum of the total nitrogen certified to be present in fer- tilisers; or As to phosphoric acid amounts to seven per centum of the total phosphoric acid certified to be present in fertilisers; or , As to potash amounts to five per centum of the total potash certified to be present in fertilisers- shall be guilty of an offence against this Act.. Illspe~ tioll 10. (1.) An analyst or officer under this Act may, and sampling. at any reasonable time in the day time, enter any manu- factory, warehouse, store, shop, building, vessel, wharf, railway station, conveyance, carriage, vehicle, or place in Queensland where any fertiliser is manufactured, or kept, or is for sale, or is in course of delivery or transit, or is stored, and demand and take samples of any such fertiliser, and the label on any package containing the same, or an invoice certificate containing the particulars relating to the same. (2.) Every sample taken shall be divided by such analyst or officer into three parts, and each part shall be marked, sealed, and fastened by him in the presence of the person apparently in charge of the premises or fertiliser, and shall be disposed of as follows :- (a) One part shall be delivered to the person apparently in charge of the premises or fertiliser ; (b) One may be utilised for analysis; . (c) One shall be retained by ~ uch analyst or officer for future comparison: Provided that such sample may be taken at any of the places mentioned in subsection one of this section not- withstanding that there is no person present apparently in charge. In such case the officer taking the sample shall send by registered post. a notification of the taking of such sample to the person (if any) whose name and address appear on the package containing the fertiliser from which the sample is taken, or on any label or invoice certificate relating to the same.

The result of the analysis of any sample of fertiliser taken by an analyst or officer under this Act, together with the name and address of the person from whose fertiliser the sample was obtained, may be published in such manner as the Minister may direct. (4.) A statement of the result of any analysis shall be sent by post forthwith by such analyst or officer to the person from whose fertiliser the sample was obtained. 11. (1.) Any person who knowingly and fraudulently- T~ impering ( a ) a T mpers \V ' I t · h any piW k age 0 f f ert 1 'lI' ser so as to with ~ amples, procure that any sample of it taken under this Act does not correctly represent the contents of the package; or (b) Tampers with any sample taken under this Act; or (c) Wilfully obstructs, hinders, resists, or in any- wise opposes any analyst or officer in the exercise of any of his powers or duties under this Act; shall be liable to a penalty not exceeding ,twenty llounds, or to imprisonment for any period not exceeding six months. 14. (1.) A prosecution for an offence against this Act Who may may be instituted either by the person aggrieved or by an prO'8cute, inspector or by any person authorised by the Minister. B

In any proceeding for such offence, it shall be no defence that the buyer, having bought only for analysis, was not prejudiced by the sale, or that the fertiliser, though deficient in one or more constituents, was not defective in other constituents. A person alleged to have committed such offence person \I ho in respect of any fertiliser sold by him shall be entitled to ~ old to him. the same rights and remedies, civil or criminal, against the person from whom he bought the fertiliser as are available to the person who bought the fertiliser from him, and any damages recovered by him may, if the circumstances justify it, include the amount of any penalty, and costs and expenses paid by him on conviction, and the costs of and incidental to his defence on such conviction. Geneml penalty. (4.) Any person who commits any offence against this Act for which no other penalty is provided shall, without prejudice to any civil liability, be liable to a penalty not exceeding twenty pounds for the first offence, and for any subsequent offence to a penalty not exceeding fifty pounds. Snmmary (5.) All proceedings in respect of such offences may procedure. be heard and determined in a summary way under " The Justices Acts, 1886 to 1909."* Appropriation (6.) All penalties recovered under this Act shall be of penalties. pa,id into and become part of the Consolidated Revenue Fund. Evicltnce. 15.(1.} At the hearing of any civil or criminal proceeding with respect to any fertiliser analysed under this Act, the production of a certificate of analysis purporting to be under the hand of an analyst shall be sufficient evidence of the facts therein stated, unless the defendant gives notice to the plaintiff or prosecutor, at least twenty-four hours previous to the day fixed for the return of the summons or hearing, that he requires the analyst to be called as a witness. (2.) In any proceedings- (a) Parol evidence that any person is an analyst or an officer under this Act shall be deemed sufficient, unless the defendant proves the contrary; (b) Authority to do any act or take any proceeding shall be presumed until the contrary is proved; * 50 Vie. Fertilisers Act. 6185 (c) The allegation that any fertiliser was sold shall be sufficient evidence of the fact which within the meaning of "sale" as herein defined con- stitutes a sale until the contrary is proved, and the onus of proof that any fertiliser was not for sale shall be upon any person charged. 16. The Governor in Council may from time to time Power to make regulations providing for all or any purposes, ~ ~ ~ iation ... whether general or to meet particular cases, that may be convenient for the administration of this Act or that may be necessary or expedient to carry out the objects and purposes of this Act, and, where there may be in this Act no provision or no sufficient provision in respect of any matter or thing necessary or expedient to give effect to this Act, providing for and supplying such omission or insufficiency, and without prejudice to the foregoing powers- (i.) Prescribing the course to be adopted by any buyer desirous of having any fertiliser analysed; (ii.) Prescribing the fees to be paid to the analyst for making any analysis, and prescribing any other fees required by this Act to be paid. Such regulations may provide a penalty not exceeding hventy pounds for any breach thereof. All such regulations shall be published in the Gazette, and when so published 8ha11 have the same effect as if they were enacted in this Act, and shall not be questioned in any proceedings whatever. All such regulations shall be laid before both Houses of Parliament within forty days of the publication thereof if Parliament is then sitting, or, if not, then within forty days after the commencement of the next ensuing session of Parliament.
