PART 1 — PRELIMINARY

Name of Determination

  1. This determination is the Federal Financial Relations (National Specific Purpose Payments) Determination 2009 No.1.

Commencement

  1. This determination commences on the day on which this determination is made.

Definitions

  1. The following definitions are used throughout this determination:

Act means the Federal Financial Relations Act 2009.

Intergovernmental Agreement means the Intergovernmental Agreement on Federal Financial Relations that took effect on 1 January 2009. The Intergovernmental Agreement provides an overarching framework for financial transfers between the Commonwealth and the States and related collaboration on policy development and service delivery.

State includes the Australian Capital Territory and the Northern Territory.

Exemption from section 42 (disallowance) of the Legislative Instruments Act 2003

  1. Subsections 11(3), 12(3), 13(3) and 14(3) of the Act provide that this determination is a legislative instrument, but section 42 (disallowance) of the Legislative Instruments Act 2003 does not apply to this determination.

Terms and conditions

  1. Part 3 of the Act and ‘Schedule D — Payment Arrangements’ to the Intergovernmental Agreement provide that the States are required to spend each national specific purpose payment in the service sector relevant to the payment, but they will have full budget flexibility to allocate funds within that sector as they see fit to achieve any mutually agreed objectives for that sector.

PART 2 — NATIONAL SPECIFIC PURPOSE PAYMENTS

National specific purpose payment for schools

  1. In accordance with paragraph 11(2)(a) and subsection 11(5)of the Act, the amounts specified in Table 1 are to be paid, in the 2008-09 financial year, to the States specified in that table for the purpose of expenditure on schools.

National specific purpose payment for skills and workforce development

  1. In accordance with s paragraph 12(2)(a) and subsection 12(5)of the Act, the amounts specified in Table 2 are to be paid, in the 2008-09 financial year, to the States specified in that table for the purpose of expenditure on skills and workforce development.

National specific purpose payment for disability services

  1. In accordance with paragraph 13(2)(a) and subsection 13(5) of the Act, the amounts specified in Table 3 are to be paid, in the 2008-09 financial year, to the States specified in that table for the purpose of expenditure on disability services.

National specific purpose payment for housing services

  1. In accordance with paragraph 14(2)(a) and subsection 14(5) of the Act, the amounts specified in Table 4 are to be paid, in the 2008-09 financial year, to the States specified in that table for the purpose of expenditure on housing services.

Total amount of financial assistance for the 2008-09 financial year

  1. Section 15 of the Act provides that the total amount payable under subsections 11(1), 12(1), 13(1) and 14(1), for the financial year starting on 1 July 2008, must not exceed $4,000,000,000.

  1. The amounts specified in Table 4 are the total amounts determined in the 2008-09 financial year in respect of national specific purpose payments under subsections 11(1), 12(1), 13(1) and 14(1) of the Act.
