An Act to provide for t he election in New South Wales of Members of t he Par l iament of t he C o m m o n w e a l t h ; to provide tha t a Member of such Par l iament shall be incapable of be ing summoned or elected or of s i t t ing as a Member of t he Legis la t ive Council or Legis lat ive Assembly in t he Nine teen th or any subsequent Par l iament of N e w South Wales ; and for purposes consequent on or incidental

BE it enacted by the Queen 's Most Excellent Majesty, by and with the advice and consent of the Legislat ive Council and Legislat ive Assembly of New South Wales in Pa r l i amen t assembled, and by the au thor i ty of the same, as follows:— Preliminary.
1. This Act may be cited as the " Fede ra l Elections Act, 1900."
Election of senators.
2. The Governor shall appoint a r e tu rn ing officer for the Colony, who, subject to this Act, shall, within the Colony and for the purpose of any election of senators , have powers and per form duties similar to those conferred and imposed on a r e tu rn ing officer within his electoral dis tr ict for the purpose of an election to the Legislat ive Assembly; and, subject to this Act, the provisions of the Pa r l i amen ta ry Elec tora tes and Elections Act of 1893 and any Acts amending the same, re la t ing to r e tu rn ing officers shall apply to and in respect of the re tu rn ing officer for the Colony.
The wri t for any tr iennial election to fill vacant places in the
Senate shall be issued in the month of November in the yea r a t theexp i ra t ion Bu t it shall not be necessary for the re tu rn ing officer for the
Colony to pres ide or take a poll at any booth.
3. The wri t for the first election of senators shall be issued on such day as the Governor thinks fit, and the election shall be held on the twenty-fourth day thereaf ter .
expirat ion of which the places are to become vacant , and the election to fill such places shall be held on the twenty-fourth day af ter the issue of the wri t .
The wri t to elect a successor of a senator whose place has become vacant before the expirat ion of his t e rm of service shall be issued on the day of or as soon as possible af ter the issue of the wr i t s for the next general election of members of the House of Representa t ives , or on the day of the issue of the writ for the next election of senators for New South Wales , whichever election will first happen.
4. All wr i t s for the election of senators shall be re turnable on a day not la ter than the thirty-fifth clear day after the day of the issue
thereof.
5. An elector at an election of senators may vote within the division for which he is qualified to vote for a member of the House of Representa t ives , and may vote for as many candidates as there are senators to be elected, but any ballot-paper pu rpo r t ing to record more or fewer votes than the said number of senators shall be rejected at the close of the poll.
Election to the House of Representatives.
6. The divisions of New South Wales for which members of the House of Representa t ives may be chosen a re those described in the Schedule to this Act.
One member shall be chosen for each division.

7. A member of the Par l iament of the Commonwealth shall be incapable of being summoned or being nominated or elected as a member of the Legislat ive Council or Legislat ive Assembly in the Nineteenth or any subsequent Pa r l i amen t of New South Wales .
If any member of the said Council or Assembly in any such Pa r l iament is elected to the Pa r l i amen t of the Commonwealth, his seat in
| the said Council or Assembly shall,— |
(a) if no petition is lodged against such election, be vacant on the expirat ion of the t ime limited for lodging such pet i t ion; (b) if such petition is lodged, be vacant if and when such petition is finally determined in his favour.
And where such vacancy occurs in the said Assembly the election of such member to the said Assembly shall thereupon be void, and a wri t shall forthwith issue for a new election.
