Federal Court Rules 2(Amendment)

WE, Judges of Federal Court of Australia, make the following Rules of Court under the Federal Court of Australia Act 1976.

1.   Commencement

1.1   These Rules commence on 26 October 1992.

2.   Amendment

2.1   The Federal Court Rules are amended as set out in these Rules.

3.   Order 65, rule 1 (Application)

3.1   Omit the rule, substitute:

Commencement of proceedings

 “1. Originating proceedings under the Life Insurance Act 1945, except an application under rule 2 or rule 3, must be commenced by filing an application:

  • (a)

    in accordance with Form 5 in the First Schedule; and

  • (b)

    specifying the section of the Life Insurance Act 1945 under which the proceeding is brought.”.

4.   Order 65, rule 2 (Payment into Court)

4.1 Add at the end:

“(2)

An application for a declaration must be in accordance with Form 59 in the First Schedule.

“(3)

An applicant must join as respondents to the application:

  • (a)

    all persons in respect of whom it has received express notice in writing of any trust, right, equity or interest in the moneys paid into Court; and

  • (b)

    all persons who may be affected by the declaration sought.

“(4)

On the filing of an application, the applicant must also file the following documents:

  • (a)

    an affidavit showing the nature of the claim for a declaration and the material facts on which the claim is based;

  • (b)

    a notice of deposit in accordance with Form 31a in the First Schedule.”.

5.   Order 65, rules 3, 4 and 5 (Form; Parties; Documents to be filed)

5.1   Omit the rules, substitute:

Judicial management or winding up

“3.

Except for an application under s. 59 of the Life Insurance Act 1945an application under Division 8 of Part III of the Life Insurance Act 1945 by a judicial manager, the Commissioner, a liquidator or any other person interested, must be by notice of motion and be supported by affidavit.”.

6.   First Schedule

6.1   Form 59:

Omit from the heading “(Order 65, rule 3)”, substitute “(Order 65, rule 2)”.

7.   Order 1, rule 11 - Bankruptcy Rules applicable.

7.1   Subrule (2):

Omit the subrule, substitute:

“Subject to Order 41, the practice and procedure of the Court in relation to proceedings under the Bankruptcy Act 1966 shall be in accordance with the Bankruptcy Rules.”.

8.   Order 10, rule 1 (General)

8.1   Subrule 5:

Omit the word and figure “rule 1”, substitute “this rule.”.

9.   Order 48, rule 1 (Interpretation)

9.1   Definition of “ballot”:

Omit the definition, substitute “ballot”:

‘ballot’ means a ballot referred to in Division 7 of Part X of the Industrial Relations Act 1988;”.

9.2   Definition of “inquiry”:

Omit from the definition “s. 247”, substitute “s. 253m”.

10.   Order 48, rule 2 (Commencement of a proceeding)

10.1   Subrule 2 (2):

Omit “s. 247”, substitute “s. 253m”.

10.2   Subrule 2 (2):

Omit “regulation 93”, substitute “regulation 98”.

10.3   Subrule 2 (2):

Omit “made by the applicant”.
