Federal Court Rules 2(Amendment)

WE, Judges of the Federal Court of Australia, make the following Rules under the Federal Court of Australia Act 1976.

1.   Commencement

1.1   These Rules, except rule 4, commence on 17 November 1993.

1.2 Rule 4 commences on 1 January 1994.

2.   Amendment

2.1   The Federal Court Rules are amended as set out in these Rules.

3.   Order 10, rule 1 (Directions hearings)

3.1   Subrule 1(2):

Add at the end:

  • “; (j)

    in proceedings in which a party seeks to rely on the opinion of a person involving a subject in which the person has specialist qualifications, direct that all or part of such opinion be received by way of submission in such manner and form as the Court may think fit, whether or not the opinion would be admissible as evidence.”.

4.   Order 35, rule 8 (Interest)

4.1   Omit “12%”, substitute “10%”.

5.   Order 72, rule 11 (Sunset provision)

5.1   Omit “1994.”, substitute “1995.”.
