WE, Judges of the Federal Court of Australia, make the following Rules of Court under the Federal Court of Australia Act 1976.

1.   Amendment

1.1   The Federal Court Rules are amended as set out in these Rules.

[NOTE:  These Rules commence on gazettal: see Acts Interpretation Act 1901, s 48, as applied by s 59 (4) of the Federal Court of Australia Act 1976.]

2.   Order 9, rule 3 (Mode of entry)

2.1   Subrule 3 (1):

Omit “notice of appearance.”, substitute “notice of appearance in accordance with Form 15.”.

3.   Order 15A, rule 9 (Procedure)

3.1   Subrule 9 (4):

Omit “notice of motion”, substitute “application”.

4.   Order 35, rule 8 (Interest)

4.1   Omit “12% per annum”, substitute “10.5% per year”.

5.   Order 72, rule 1 (Mediation or arbitration procedure)

5.1   Omit “If, with the consent of the parties,”, substitute “If”.

6.   Order 72, rule 5 (Court may terminate mediation or arbitration)

6.1   Subrule 5 (3):

Omit the subrule, substitute:

 “(3) If the Court appoints a new mediator, the Court may order that the mediation continue in any way the Court directs.”.

7.   Order 72, rule 8 (Adjournment or termination of mediation)

7.1   Subrules 8 (2) and (3):

Omit the subrules.

8.   Order 72, rule 10 (Termination of arbitration)

8.1   Omit the rule.

9.   Order 77, rule 18 (Petition founded on failure to comply with bankruptcy notice or set up counter-claim, etc (Act, s 40 (1) (g)))

9.1   Subrule 18 (2):

Omit the subrule, substitute:

 “(2) The affidavit must be accompanied by an affidavit of service of the relevant bankruptcy notice.

 “(3) If an application mentioned in paragraph (1) (a) or (b) has been made, the affidavit must also be accompanied by a copy of the order finally deciding the application.”.

10.   First Schedule

10.1   Form 15 (Notice of appearance):

Omit “(Order 9, rule 4)”, substitute “(Order 9, subrule 3 (1))”.

10.2   Form 141 (Notice of appeal from National Native Title Tribunal):

Note following item 3 in the Application for extension of period in which to appeal:

Omit the note, substitute:

“Note: This section need only be completed if the appeal is not, or will not be able to be, instituted within 28 days starting on the day when the decision or determination of the Tribunal is given to the applicant—see subsection 169 (4) of the Native Title Act 1993 and Order 78, subrule 24 (2). The applicant must also file and serve an affidavit in accordance with Order 78, subrule 24 (3).”.

10.3   Form 151 (Summons to attend examination):

Note 2 (first occurring):

Omit “the Court of the Registrar”, substitute “the Court or the Registrar”.
